    Long time Hater, first time poster (posted this in other thread as it died).

    It seems to me that even if Mark wins, he loses. Let's say he wins the suit and Casey is ordered to pay him $10,000. How many times have you heard about a civil suit in which someone who is ordered to pay does not? Or cannot? I see it all the time in my business.

    Also, Mark Villasenor's name will be forever tainted by this. Google his name and you come up with the Caseypedia entry and all sorts of ugliness.

    I wouldn't do business with a fifty year old man who gets heavily involved in the real life equivalent of an internet flame war. Nevermind one who angrily threatens a 24 year old hippie with all the gravelly bravado of a WWF wrestler. It's pathetic.

    And let's not forget threatening Pink Lips. He kept asking for her contact information. Would you give that lunatic YOUR contact information?

    Process servers LOVE court appearances...high probability that "the bunny" will actually be there, won't be armed, and will have counsel at hand to advise him to cool his jets and shut his mouth.

    It is highly unlikely that a judge would allow the contents of a chamber discussion in an ongoing matter scheduled for fast track further hearings to be discussed openly. You'll have to satisfied all the good news about 'tards latest round of issues being "interesting" and the expeditious scheduling and wait now to see what Casey says that was so very important yesterday that wasn't the hearing. Right now my money is that he won't mention it.

  15. The flip side is that if LMP does not sue Casey, it will look as if he can be taken advantage of by any two-bit internet con-boy.

    The serious mistake that many organizations make is looking at lawsuits on a case-by-case basis; in isolation, nearly all cases will look like they're either not worth pursuing (if plaintiff), or worth settling out of court (if defendant). From a wider perspective, however, it's worthwhile to aggressively pursue certain specific cases, if only to put the fear into other would-be litigants, contract-breakers, patent violators, etc.

    A bit Machiavellian? Perhaps, but this is the legal realm, not a junior high popularity contest. And in LMP's unofficial line of work, any impact to LMP's reputation is likely to be more of an asset than a liability.

    And with respect to Casey being judgement-proof: he has little money, a lot of debt, and few worldly possessions to his name. But there's one big asset hanging out there with a firm offer putting a $15,000 price tag on it . . . the question is can the holder of the judgement get to it before (ex) family members do.

    The mega crooks out there who flipped 20+ houses in SD and other places don't post about it on a blog. The immense mayority of them get away with it.

    Face it, EN got on Casey's case because of Casey's idiocity and unrepentance. He going to court and losing whatever little he has left (IAFF is the only thing of any value under his name) will have no impact on the mega crooks.

    Speaking of which, when is EN going to initiate a hounting campaing on the headge fund managers at Bear Sterns? When are you taking those guys to court?

    You speak almost as if you feel many FBs have a choice, and are deliberately choosing to hand in the keys and slink away. They've already gotten the mortgages they shouldn't have gotten, and now they can't easily get out from under them. There are at least hundreds of "FBs" locally who have been laid off in the last twelve months because of plant closings, some car dealership closings, the vast slowdown in the real estate market, and many other assorted business failings. Now upside-down without the bottomless ATM formerly provided by escalating housing prices, these borrowers are dead in the water. They were unwise and ill-informed when securing their toxic mortgages, but it's done and it's too late to fix it. Their loans have been sliced, bundled, and sold to parties apparently unconcerned that the chance of any payback is optimistic at best.

    I just know what I read and I'm no financial expert, but I think lots of paper, such as your imperiled CDS, are going to go poof sometime relatively soon. It appears to be a house-o-cards situation, even flimsier than most people suspect, which will crush supposedly secure victims with an unexpected rain of debris. It's scary as hell, at least to me with my economics 101 level of comprehension.

    That would make a great opening shot for the interview..

    Might want to have KCRA download some of those house & pool photos to show the damage KC has done to the community and ask WTF he was thinking.


    Or contact the Sac County DA and local office of the FBI to be sure they are watching as Casey sure likes an audience. I am sure he would appreciate it.

    That being said, I was in favor of the lawsuit until I heard Mark on the Foreclosure Friday and then the Haterzcast. Then it all kind of came together, the rage, threatening Pink Lips, naming Mocha in the suit. Unprofessional, unstable.

    As awful as Casey is, I think Mark is worse. And he's only hurting himself. I can't imagine who would want to do business with such a lunatic. I would like to see our murse-toting roadrunner caught by a different coyote.

    The problem is that "shady" behavior attracts shady associates. The people Casey has become associated with have become more and more questionable as Casey has dug himself further into the legal hole--Duane is widely regarded as a straight shooter, Mark is somewhat controversial . . . and then there's Marty, and "Mocha", and "Pink Lips". The last two might be otherwise respectable individuals, but to be frank, they creep me out and it would not surprise me in the least if they were serious trouble waiting to happen.

    But Marty is not the end of it, when Casey gets desperate he will start attracting some very nasty characters indeed--it will not be long before Casey will be in the company of outright criminals and predators. That's what happens when someone is on the "shady" side of the law--criminals and predators know they're vulnerable, know they can't go to the police, and take serious advantage of them.

    FDIC and the credit union and associated agencies will NEVER allow anyone to lose principle in a US denominated CD type gauranteed instrument.

    Cold comfort in the worst case, cool comfort in even poor cases. The principal is protected not the return. Indeed even the principal can take years to get back. $10,000 USD in 2014 dollars for your 2006 2 year CD is not really satisfaction.

    I don't think things wil get that bad but understand that in crunches the fine print on "liquid" assets may contain surprises.

  54. I've tried this before. Dealing with trash merely takes effort. Dealing with waste takes effort and education and experience. Dealing with toxic waste takes all of the above and special skills and contacts and more.

    What people are doing is saying that because firemen are drawn to fires that they are no better than pyromaniacs. Experts in putting out credit/debt fires could be reasonably expected to consider Casey Serin's inferno to be a challenge.

    You know Casey, depending upon how LMP wrote the TRO, you could be handing a victory to LMP with respect to your KCRA 'interview'. Not only that, you might induce others who have inside information to spill a few of the beans to protect certain certain particulars by revealing background facts.

    Step carefully. Dealing with Judges is not like dealing with Duane, LMP, Marty or anyone else. Judges have quite a bit more authority over your life and you can't do much about their decisions.

    - Postponement. The case wasn't thrown out, nor was any injunction granted. Too complex, too much to sift through in a short amount of time. Too hard to call either way.

    - Expect EN, Caseypedia, CaseyHaterz, et al, to get polite e-mails and then C&Ds to remove any notice of "Mark Villasenor", LMP, and the like, from posts or comments right after the decision is rendered, either way. Google cleanup will take place. Chilling effects.

    - KCRA appearance will be standard puff piece.

    Huh? First of all, LMP can file C&Ds all he wants, but it doesn't mean that anybody's obligated to comply, much less public internet forums (which are not free speech venues, but outside individuals can't simply arbitrarily censor them.) My understanding is that the restraining order against IAFF is based on the contract between Casey and LMP, which (I believe) included an NDA. No contract and/or NDA with EN, Caseypedia, forums, etc., means nobody has any power to enforce a "clean-up", barring copyrighted content.

    Unless Mark has his name copyrighted . . . Mark Villasenor™. LMP™. Sweet™!

    If Casey REALLY wanted to, he probably could enforce removal of copy-and-pastes of his posts here as elsewhere; similarly, if VagueGuru wanted to enforce copyright he could have Casey take down the images. Other than that, not much is going to happen from a "clean-up" standpoint.

I firmly believe Mark KNOWS Casey doesn't have the money. There seems to be an unknown method to Mark's madness. I suggest we all see where this goes. We may all be pleasantly surprised or we may be totally disgusted by the outcome.

    So what if Mark said that to Casey? I've seen harsher things POSTED in these forums. I've seen people post his family's personal info. I've seen people make sexual cracks about Caseys pre-teen sister.

    I really wish people would get over Mark's personality issues and see where this takes all of us.

    That's what MARK does for a living. Casey is/was in no position to NOT comply with the requests. Why use a loss mitigation expert if you aren't gonna follow their plans? They NEGOTIATE settlements with creditors and that sometimes means the debtor HAS to go on a strict budget to make the other side happy.

    Again, I am not asking people to love Mark but I wish people wouldn't make assumptions about his motivation without reading the full complaint.

  77. Here's the thing about Mark and that $10k. Early on when he talked about the suit he said a number of times that he had very low expectation of collecting a cent off the suit. Thats one reason he doesnt have a lawyer, he doesnt want to pay for it on a case he doesnt realistically expect to collect on. (plus I dont think he expects to run into an opposing lawyer, whatever Marks understanding of law may be, its better than Casey's)

    Now he said later different things about the suit and money. But money alone isnt the entire goal of the suit.

    Slight problem with him doing that. If it has been dealt with all above board, shows all sides in an even light, and is from things he said in an open forum.. he is SOL.

    For the Cease and Desist, he has to show it is intentionally damaging. That the intent of the pages is to damage and it is not representative of his real persona / behavior.

    It the treatment on Caseypedia is even, it would probably not be in his best interest. Considering the Casey - Media links, having LMP do a Cease and Desist may get attention of the media... who has much deeper pockets than LMP (or most other people too).

    Part of what helps in Loss Mitigation, is the credibility of the person doing the Loss Mitigation. It is a bargaining chip to use with the loan holders. If you start negotiating with loan holders and your principle(debtor) suddenly changes direction, it harms what was negotiated in good face and effects the credibility of the person doing Loss Mitigation.

    In Loss Mitigation, you are trying to convince the loan holders that part of the money is better than none, and that you are not likely to see any if the loan holder continues in the current path. Similarly with interest rate charges.

  91. I don't think Mark is taking Casey to court over money, broken contracts, or hurt feelings.

    He's simply giving Casey what he's deserved for a long time. Mark's NOT going to be ignored like a lender, mentor, or family member. Casey has gotten away with that routine over and over. Nobody ever really confronts the guy and Casey never takes anyone, anything, or any contracts serious. He prides himself in that.

    Here's a guy who brings a shit-storm into his wifes life and then goes on vacation. Here's a guy who's raped banks for hundreds of thousands of dollars and he still hasn't stopped. Here's a guy who calls up a buddy one night and asks if he can borrow 50% for a "limited time" "advanced level" guru scaminar.

    Out of all of the people Casey has touched in the past year, nobody has really stood up to the guy. Even the ones who got screwed over. He's been given too much sympathy, too much advice in one ear and out the other. Someone needs to grab Casey by the throat and scream - what the FUCK is your problem asshole!

    Mark is trying to show Casey that not everyone walks away. That he yanked the wrong chain. He's doing a public service in preventing Casey from profiting from crimes and committing new ones. Somebody, anybody needs to stop Casey. I applaud Mark for his actions.

    I think others in this picture need to take note. If you've gotten screwed over by Casey, this would be a good time to address it. There are quite a few people who have a case that'd merit a court appearance. Joy and Erin for example. Now is the time to strike.

    Foremost, coming out of hiding here for just a bit until other aspects are executed; so (folks) don’t expect me to answer further questions or address any other details -- at least for the next few days (as it appears now). The comment above, however, warrants my immediate personal response...

    Whoever posted the above-quote seems to forget that I was a private person with private rights under both the US and California Constitutions, long before being “outted” for helping Casey. To purport “chilling effects” for any action removing my real name from Internet aspects is not only disingenuous, but hypocritical in the extreme!

    I did not and have not interjected my real identity into a public matter, rather I was outted by folks whom neither understand the law or private rights; perhaps under the misconception that their actions are protected conduct. Well, bunky, invasion of privacy is not protected even under the guise a “newsworthy” need to know or free speech! Never has been, because my REAL NAME had no bearing on the story! Get it? The outing folk could question and bring to bear my professional abilities, but my true name had no bearing on the story. PERIOD!!

    What you seem to forget is that; while blogs and the CaseyPedias of Internet-world are considered protected from libel suit by Batzel vs. Cremers and case law like it. Such protections DO NOT (and cannot Constitutionally) extend to invasions of privacy, and any redress of such intrusions doesn’t mean a restriction can be placed on Free Speech values.

    Moreover, I am on quite friendly terms with Rob Dawg whom I am very sure would remove my REAL NAME from any posts were I simply to ask him (he’s a gent, I have no worries he’d do as I request). I need no such court order to FORCE most folks to extend cooperation, as reasonable people can (and should) apply alternative means when possible.

    In addition I’ve been in contact with some of the CaseyPedia folks, and they’ve graciously agreed to edit content there; I’ve just been too busy running my practice and handling the Casey issues to ask them for what they’ve already said they would do ON A FRIENDLY BASIS!!!

    Simply put, I own MY real name and like many actors and people in the media have a right as to how that name is portrayed. That is all the more true considering I never asked to be exposed or “outted” and no amount of justification can square the reasons behind such. Pretty damn straight on that line, I have NEVER personally (myself) exposed my real identity on the blogs. And if I had no choice in the matter of exposure, which I did not, as a PRIVATE person before my engagement with Casey’s issues? Well, better brush up on case law if ya wanna debate those points to any degree.

    The FACT I was “outted” is not a point of contention with me either (I hold no anger toward the folks who did that). But the affect of certain other folks applying my REAL NAME to actions, based on the original discovery and disclosure of that real name should be corrected!     First, you are absolutely correct that privacy is not protected explicitly by the Constitution. The reasons are twofold. I shall only address one. The Founding Fathers were fearful that enumeration of natural rights in a manmade document could lead to limiting of those rights.

    Very good reply. Breathing involves only ones own actions, Mark is seeking to control the actions of others.

    The old saying goes "your rights end at my personal space" - You have the right to do what you want, until it impacts others.

    Casey's saga is a very public event prior to Mark getting invovled. Mark interjected himself into it and must live with the consequences. His name will forever be linked to this fiasco.

    His grasp of the law is humorous at best. He may request his name be removed (and, likely most will be willing to), but he will not be able to get a court to order this... that's simply a fantasy.

    That is what is so fun about Mark - he INSISTS that the world conform to his view and he threatens to use "THE LAW" when it does not.

    At least he is amusing to watch.
