Withdrawl or Capitulation?


Somewhere deep in a pile of unopened mail sits an envelope, an envelope from gator hosting services. Probably has "open immediately" and "past due" somewhere on the front.
Down: caseyserin.com, serin.us, IAFF. Good news: caseyserin.info still works. I knew that $2.24 was a good investment. Feel free to speculate away. Maybe Casey could even post a quick note.

I'm sure Sugar Daddy Duane will save the day for 'Lil Casey, and pay his hosting fee - it's his hit count that's on the line here.

I wonder how he feels now, as he's now been bitten officially by Lil' Casey's flakiness and indifference to opening his mail and paying bills.

I wonder if he knows that he's not taken on a "partner", but a child, who needs to be told when to brush his teeth and comb his hair, reminded to lift the lid, and needs daddy to pay him allowance and pay his upkeep.

I wonder if Galina has Duane's number, and she can call him 24/7 when her credit card gets refused at Nordstrom's, and Duane needs to advance them the money from July 2007.

I just want to know one thing...is there one person throughout the whole saga, just one person, who Lil' Casey did'nt burn, betray, lie to, flake out on, or rip off one way or another?

I think the only people who can say they had a positive experience with Lil' Casey is the guy who sold him the Jetta (and was smart enough to demand cash up front, you know Lil' Casey tried to arrange informal credit) and Jamba Juice, because they don't give credit.

Our poor hero will now HAVE to talk to a serious lawyer to get him out of this mess. Actually, now that I think about it, this is a pretty sweet scam for Duane. All he has to do is offer to pay Caseys legal fees in exchange for a cut of the pie. Casey has his back to the wall and pretty much has to accept Duanes terms or else his only way of making any coin is toast. Very SWEEEET deal indeed!

Casey, if you're reading this and you really want to get some form of the site back up, just remove that last post and host it with some place like NearlyFreeSpeech.net.
The guy running bugmenot.com uses them and must have raised the ire of every "free registration" site (including the NY Times) and he's still around! (although I'm not recommending any course of action, just listing some options I know about...)

Another option I can list, is if hostgator confescated your blog's data, I'm sure if you submit a post here, someone must have a mirror or saved copies... but I'm sure you've got bigger fish to fry right now, like finding a lawyer ...or is Dwayne taking care of that since he had the legal competence to tell you to post the contract/nda?

Hostgator doesn't bill you -- they have a credit card on file and charge you automatically each month.

But if you go over a predetermined usage level, they cancel you without notice. I was getting 2,000/day and moved off them because I knew I was going to get cancelled soon. Casey was getting 5,000 a day so I'm not surprised this didn't happen sooner.

The complaint from PRTwinkBitz and company is interesting. The wording is a little unclear but it seems that they assert, under penalty of perjury, that they have exclusive rights to link to the Rich Dad Poor Dad video. Linking to somebody else's copyrighted work does not violate that person's copyright because no copying occurs.

Now, despite the perjury bit, DMCA complaints which claim that linking is a copyright violation are not unusual. What *is* unusual is that in this case the claim is being made by someone who isn't even the copyright holder, and they assert that they are.

It's too bad nobody ever gets prosecuted for perjury in connection with a DMCA takedown notice. It appears to me Morgan, O'Day, and O'Day may have committed a crime, and it's one for which I personally would like to see more people prosecuted. Whatever you think of Casey's content, it's a bad day for free speech when somebody can get a site yanked without warning by falsifying a complaint.

Maybe Casey can sell VDubs and hire a lawyer. He ought to be able to get at least half of what he paid for it.

Sue Robert Kiyosaki for defamation of character on Rich Dad TV. You were in no position to attack back on his show when they ambushed you with the "Greater Fool" accusation. Your name was tarnished in front of millions on the internet. I felt so bad watching you get beat up by him verbally.

Stick it right back at these people and name all of them in a suit. Here's your ticket to getting out of 2.2 mil debt. Remember, Prlinkbiz and O'Day actually have something to lose. You've got nothing to lose. You can hit them as hard as you want. They can never get anything from you. If you are going to jail, it was bound to happen ANYWAY.

For once, I am on your side. All the "haters" should fight with Casey on this one. What he did with real estate was wrong, but in this case we have two exploitative people trying to take advantage of him.

It's great to have so many eyeballs reporting on the soap opera plot twists. This site got mentionedon Ben's blog this morning with a predictable jump in page views. The single adsense bar at the top covers expenses. One suggestion was Habitat for Humanity but we already volunteer. Instead my little Brownie reminds me that it is Girl Scout Cookie season and this year you can donate a box to the troops overseas. So, any extra "dirty pennies" will go to Girl Scout cookies for the troops.

That "contract" isn't worth the paper it is printed on.

If you still have a copy, do this:

Google "partnership agreement"

now take the first link.

What she did is take that exact contract and then changed the words "partnership" to agreement.

then she messed around with it a bit more.

the problem is, the "contract" doesn't make any sense whatsoever.

an "agreement" is not a partnership

so the thing doesn't make any sense

for example, an "agreement" can't liquidate.

an "agreement" doesn't pay salary

you see.. they didn't want a partnership.. and they called the agreement the "casey serin agreement"

so they couldn't change all the "partnership" words to casey serin

(when casey serin liquidates.. etc.)

so they changed them to something that isn't even comprehensible

there is no way a lawyer wrote that document, it absolutely doesn't make sense.

how can casey "submit" things to an "agreement"?

I think most people haven't actually read the document, they just skimmed it.

If you actually sit down and read it, you'll see it isn't worth the paper it is printed on

Duane was, of couse, acting in his own best interest - he wanted the story rights, and wanted to quickly force the issue. Smart from his point of view, but clearly NOT in Casey's interest. Casey, of course, doesn't realize any of this. Thinks Duane's still 'helping' him.

I claim a small victory and take massive satisfaction in his blog going down. I too send Prlinkbiz an email telling them how to shut the site down. Although I dont like them, they appear to be the only ones that have any leverage to hold this little thief accountable since the authorities are sitting on their asses so long.

When the site went down, I had a message pending...I will post it here (as best as I can recreate it).

Casey's real estate experience can be summed up in a simple mathematical formula.

16 counts of loan fraud.

69 mistakes since day 1.

Or, he must immediately get a REAL lawyer to determine if the vagueness of his consideration (mentoring, etc. with no timetable, definable amount of effort on their part, yadda yadda) renders the contract voidable.

People like me got out of the RE as investment angle in 2005-2006. All that are left are those who missed the last lifeboat and the rats and vermin. At least they aren't out there screwing up the entire economy and causing municipalities to pave over perfectly good land for perfectly awful excesssupply of substandard housing.

It was a free, copy-n-paste legal "consultation" for prlinkbiz and Co!
Could the "Casey Legal Defense Fund" please make note of that.

As others have remarked, it's amazing how one-sided that contract is, yet prlinkbiz would have us believe it was "win-win", as she describes (13th paragraph down): "...My partner was going to help him with all his houses(fly to see them, market research, negotiate with the banks, as well as help him get some cash going, set up a team, find a place to stay, basically hold his hand through everything) all at her own expense. My job was to document and manage the process. Casey's job? Get out of his mess."

Why isn't any of that in the contract?

On a separate note, I wonder if Casey considered, even if prlinkbiz and co's case is shabby, if they at least get a date in court, he'll have to take time and money to travel to AZ again (or hire a lawyer in AZ to represent him)?

Except to drive traffic to IAFF, there was no reason to post that "contract"... no way is "you'll have to deal with it sooner or later" (to paraphrase Casey and Dwayne) a logical rationale to post it!?
I wonder if he ran this latest move by his wife? The site take down could mean an interruption in "cashflow" and therefore some key credit card bills going delinquent...?

I always warn friends who start websites that success can be your own worst enemy if you use a hosting service. More views = more bandwith and that means more $$$.

When/if he comes back he will NEVER be able to stop the jokes about this. Gifted entrepreneurs don't forget or neglect to pay for the one thing that can help make money.

Guess he could have foregone some Jamba Juice so he could pay for his hosting costs :0

If they are of the position the contract et al is not legally binding, why nit simply address it privately with the other party and resolve the matter?

It smells of a publicity stunt gone bad. I expect that of Casey, but ine would expect Duane to rank higher on the IQ scale.

Whatever the motive was publishing the documents on the site (and knowing Casey, there was probably not much thought put into it)--It is highly entertaining. Duane never really seemed very sharp at all; and highly defensive of the posted comments; even if they were not even directed at him.

In fact, I'd say this is _all_ about Casey's mistakes.

I can't be too upset with the AZ ladies here. Not any more than I can be upset with the banks for foreclosing on Casey's houses. Casey, for better or worse, agreed to whatever was in the contract the ladies put in front of him (just like he agreed to pay back $2.2 million after quitting his job). Sure it was a bad deal--the banks shouldn't have lent Casey the money; the ladies shouldn't have mortgaged Casey's future--but bottom is that Casey just screwed up again and secured a loan for a load of crap ("mentoring") with his right to his blog (among other things).

I've been an IAFF reader since the Fool.com article back in September(who here remembers that??) so trust me that I'm a little bummed about its demise. But let's not think for a bit that this is not as much Casey's fault as the foreclosures that brought him fame in the first place.

For those of you claiming Casey can sue them, say what you want about the validity of contract, but Chicken Little DID sign the NDA and has definitely breached that agreement. Posting the contracts may have been the stupidest thing he has ever done (and that’s saying something). I don’t think Chicken Little has a legal leg to stand on, no lawyer would touch this, and Chicken Little doesn’t have the funds to pursue it anyway.

But is amusing to see someone else abuse the law to annoy Casey. The DMCA is to protect copyrighted material and trademarks --- and to give hosting companies a safe harbor. Not to settle scores.

Fair enough. To your credit, you started out pretty kind to Casey on his blog.

I'd put the two women in the "kick him when he's down" camp and there were more than a few IAFF posters in that same camp. Only difference is that, instead of just giving advice, the two women actually put a bet on Casey on the line. Casey decided, like he has many times before, to give them the big FU and they got pissed off and took our downtime entertainment away.

Here's a thought exercise: what if Duane had offered to pay Casey $750,000 instead of $750? And what if, instead of shutting down his blog, the women simply sued to keep him from getting a big check? Would as many people be as upset with them?

Casey pissed them off. They got back at him. What would you have done (besides give Casey a fairer contract--not that he would have honored it anyway)?

I live in Phoenix, and we have a term for the "Ladies" that we like to use. "Thirtythousandaires". They are easy to spot. They don't carry a purse; they have "Coach bags". They don't go get some thing out of the car; they "go get something out of the Mercedes." From a brief snooping around their website, they live in the N/ PHX/Scottsdale area, and are all style over substance. Gross. Sadly, that part of town is FULL of like-minded individuals. I am just amused that Gator hosting folded IAFF that quickly. Better safe than sorry.

Regardless of how we perceive the AZ women, Casey signed an outrageously one-sided (against him) contract. What kind of idiot would sign something like that? Rhetorical, don't answer.

Duane is not only trying to move in on the Casey story, despite what he's been telling everyone via his comments, but he's forced Casey into a no-win situation.

Before his posting of his contract, Robert, Tim from MBA, and others speculated on what the contract contained, and their speculation was spot on. But it was only just that, speculation with no confirmation.

What Casey did was sign away his life story for compensation. It happens everyday in Hollywood. Obviously the terms were not in Casey's favor especially since he decided he didn't need the AZ women's help.

So by revealing the contract, he is directly affecting Joy and Erin's businesses and their names. The action they had to take was to have the contract removed from public viewing to protect their perceived value.

Duane convinced Casey to reveal a contract that had an NDA attached. By doing so, he's exposed the AZ women (and Kiyosaki for that matter) to criticism and potential loss of business. Not a smart move. If he was going to fight it or settle it, he should have been quiet about it.

Well, for what it's worth, the women still aren't getting anything from Casey. I'd probably be annoyed if they actually got a check for being the first to dupe Casey into a one-sided contract (not counting Countrywide).

But all they're doing is throwing a wrench in Casey's daily schedule. That's likely all their contract is good for and I'm all for that.

If it makes you feel better, try to guess which Casey is spending the most time on today:

- protecting the 4(?) properties still headed for foreclosure
- paying his wife's credit card bills
- tracking down that last pesky Utah payment
- saving his marriage
- trying to get his blog back up

That helps me keep my outrage in perspective.

Once upon a time, I gave Casey the benefit of the doubt.

That went away quickly.

I have no sympathy for Casey. He has made his bed. I don't even feel sorry for his wife any more; which I did for a while. She has shown herself to be as complacent and deluded as he is. Any self-respecting woman; seeing her credit being flushed down teh toilet by her husband; would go out and flip burgers if she had to.

What happens as a result of his terrible choices has been excellent fodder for all of us; and we've all gnawed on that carcass with glee. I plan to continue to do so if he does get his site back up.

My opinion of the women, however; and their actions is completely separate from what happens to Casey.

As for the list of his activities, you give him the benefit of the doubt yourself; and paint him as being proactive... In my estimation; and that of many others, he might be working to get his blog back up; but the rest... ??? I dunno. Paying bills? That's a stretch.

Simple. What is done is done. THe real estate contracts are done, there is no changing it. The mortgages have been given no changing it.

Casey HAS TO PAY those monies he got in a fraudulent manner BACK. EVERY stinking CENT.

The only contract that was hanging over his head was the PR one.

Everything else... he needs to be a standup guy (not yet) contact them.. admit wrongdoing.. and Make FULL restitution... no matter how long it takes him.

Casey has everything going against him (his fault) and only 2 things going for him.

1) His website. Some company, some entity could figure out how to monetize the eyeballs. I am paying him for SEO only. There is a revenue stream for him here. He needs a revenue stream if he is ever going to start paying people back.

2) programming skills. Yes a lot of what he does is easy wordpress stuff, but he has other useful tech skills. If he goes on the straight and narrow for a while, I may use him as a contract employee.. maybe then again. maybe not.

There is no agreement now or in the future, that I, or anyone associated with me.... can profit from Caseys wesite...story.. movie (gimme a break.. it will NEVER happen) or any other type of deal.

I am not here to profit from Casey.

Ick - those women are worth all the bad words I can think of - I mean Casey's obviously a bottle short of a six pack, so using his star struck stupidity and their silly false deadlines to pressure him into signing something that is so clearly against his best interests - that's low. And having worked in a lot of related fields (PR, being an author/ speaker/ front of camera talent, etc.), the "contract" they had him sign is so far outside the realm of what real professionals use, it's not funny. They are skanky mean icky women and I just hope that karma comes to bite them the way it has bitten our little mop headed criminal friend. And anyone who's a big time fan of RK is really needs a reality check.

Thanks Duane. But here's why I am not convinced. His mortgages are "signed & done?" So are his credit card purchases and lord knows what else.

In case you haven't figured it out, Casey is absolutely a horrible businessman. Flash a shiny object & he'll sign anything. Who knows how bad his mortgages really are & someone should look them over for him. Prepayment penalties? Was there an error in the math? Did his broker pull a fast one? He could have thousands of dollars due him...if a broker once tried to pull a fast one of a smart guy like me you can bet they licked their chops when they saw our hero coming their way.

Yep. I am outing myself. I am not a realtor but a moderately successful owner of multiple properties. And if Casey came to me for any sort of help, knowing he is probably ADD & a poor businessman AND an admitted liar, the first thing I would want to see is how bad it really was with the mortgages.

As for Casey, you give him way too much credit. History, like credit, is an EXCELLENT gauge for looking at someone's personality. Casey's history is filled with good concepts never fleshed out, bad ideas chased until they hurt and this bizarre delusion of grandeur.

The kid thinks he's an investor. He thinks God gives him the ability to be good at finding "sweet" deals. He thinks he has some gift for spotting a good deal.

All of that is debunked and if history is any indication he will NEVER succeed. He wants to be Trump when in fact he is too lazy or unwilling to do the difficult tasks required of a REAL businessperson.

I am one of those people who never finished college. I worked my BUTT off to get to a stable financial footing (after a few missteps in my 20s) and I have never looked back. I NEVER regretted not partying with my friends to work late. I never regretted passing up the expensive meal to eat Ramen when I had NOTHING but a dream.

Today, I own a few businesses. I own 2 homes. I have over 100K in the bank. I also have study employment opps as well as consulting gigs. I LOVE life and it pisses me off to see people like Casey who think they can skip point A to get to point C. Am I a hater for this? Not at all. Trump, for example, worked hard and still does. I am no fan of his, but he has to put in long hours to run his empire. So do any of the Fortune 500 richest men. Not many get to live this lifestyle Casey dreams about. To be rich means lots of hard work managing people who work for you.

Here's a scenario: I can totally see Casey trusting his employees so much (out of laziness) that one day he finds he is bankrupt. Deal making is only one part of an empire. He doesn't get it.

Why is it he can't snap out of this delusional thinking?

In terms of a possible future Hollywood treatment of this story, I can totally see a Law & Order "ripped from the headlines" episode being based on IAFF.

Though, to make it L&O, there'd be a "Charlie Serovich" found in Riverside Park. Suspicion would fall on his wife, Gale, but her alibi about attending classes at Hudson University would hold up. Detectives Green and Cassiday would find out about Charlie's notorious website and his shady financial dealings. This would lead to "Erica Moran" and "Jill O'Shea", who are arrested with the gun hidden inside their shopping mall jewelry cart.

The big twist in the trial would wind through the whole MLM guru seminar circuit, until it's revealed that Charlie's, um, "Wealthy Father" mentor, Ray Kawasaki, had put the hit on Charlie after revealing documents were put on Charlie's blog.

Yeah, that's it. Next season. Watch for it.

Why on earth would you advise CS to post that contract knowing he had signed a non-disclosure? Even if the contract was a pile of dogshit, perhaps the non-disclosure wasn't?

Why would you ask him to show it to you (or look at it if he volunteered) as opposed to recommending he talk to counsel?

What did you expect those ladies to do once it was posted? What purpose could it serve other than to generate traffic?

For those of you wondering why Duane LeGate made Casey force his hand with the NLL here’s my guess:

Duane wants to use Chicken Little in his RETV videos. Because let’s face it, he IS the poster boy for Foreclosure. What a great story he could tell about his amazing comeback from the edge of financial ruin using the RETV techniques. God Bless you RETV!!!

Problem is he can’t do it with the NLL contract hanging out there, because if he does, they could potentially come after him and his company(s) for damages.

This is why Chicken Little has been frantically calling them to get the contract voided. Why else would he care at this point? Currently he has nothing of value for them to pursue under the terms of the contract. Why bother? This should seem to be the least of his worries.

This is why DL was so interested in the blog and CL, and tried to hide it with the altruistic bullshit. He has a vested interest here that goes beyond helping out a poor little kid.

Now granted everyone knows that the contract is a POS and would not hold water. But given that, DL could still have to pay “go away” money to the NLL if they were able to find a lawyer that would take the case on a contingency basis.

If all DL was after was the site sponsorship, he would have walked away by now as would any reasonable businessman.

For the most part this worthless piece of paper was sitting quietly in Erins drawer with almost no possibility of ever seeing the light of day.

I agree. He claims he has been watching IAFF since Oct/Nov and counseling Casey behind the scenes. DL is a thin skinned real estate wannabe, just the latest to flash a "shiny" $750 in front of Casey.

I also agree with Skeptic that frustrated by his attempts to have Casey dispose of the NLL contract, DL went for broke.

He decided to have CS post the documents and force a resolution. This resolution benefits Duane by having IAFF traffice diverted to Duane's site.

Duane states he has an attorney at a pretty good intellectual property firm in NC but I have serious doubts he ran this past them as he claims. No attorney in their right mind would suggest this course of action.

My point exactly from 10:38 AM. Of all the things Casey could conceivably be doing, his first priority is resurrecting a blog. Mind you, there isn't exactly a shortage of forums where he could "tell his story" and "educate" the masses while trying to "pay back every dirty penny".

Oh well. Clearly I'm going to see what he has to say back at IAFF (over the next 12-48). Someone (possibly) hacked the NLL site and others have been urging mail fraud in retaliation for a cease and desist letter. This isn't over yet. :-)
