Legal and ethical, harumph! The kid wants to be legal and ethical, yet, he thought that buying a shell corp would give him quick cash?

How Casey? So what if a company is four years old and current with it's filings. You will still need to show a creditor that your company makes money. Once the lender looks at D&B or the other credit worthiness providers they will run screaming.

He doesn't understand that small companies NEED to provide the personal guarantees of the owners/majority shareholders.

When I started my C-Corp, the only lender that would give me unsecured credit without a personal guarantee was Staples. They only approved me because I gave them our Staples rewards # and they saw how much we purchase quarterly on supplies. THAT was the reason we were approved.

He's a clueless maroon who needs to seriously STOP with the get rich quick stuff. The Corp idea will be so bad if he does it. He doesn't understand that the state and IRS frown upon businesses with ZERO earnings and loads of debt.

Certainly, any halfway competent lender would want to know this, and with Casey's credit rating I suspect they'd want to know one hell of a lot more besides.

And if they Google 'Casey Serin', they'd find a whole series of what are effectively signed confessions admitting what he really planned to do with the corporate credit lines.

How can Casey not foresee any of this? I'm no-one's idea of a hard-nosed businessman and I spotted the pitfalls from the second he first floated the idea!

The Muncy property is into the first for like $270k. Young Casey thinks if he can short sale for $230k like it might be worth he's good. He ignores the second mortgage holder that won't agree. Total snipe hunt on his part. All theater no content.

At least he understands that he has run out of time. Now, why avoid another foreclosure? People here in our civil and open forum have suggested it might look better in the bankruptcy. I don't get that. A single BKhas got to look better and clear faster than the "What's Up Doc?" court scene he's setting up.

You forget that his petition for BK will be contested for fraud. His loans have all gone bad within the first year, an automatic trigger event for review of all of the documents. Why would he wish to hasten his demise by filing for BK? Everday I read stories of people sent to jail that have done the exact same thing Casey has pulled. Dumb he is, but stupid he ain't.

Cute as a button she is, in some of those photos. But like someone else said, she's got Babushka written all over her! If she's got those curves at 23, imagine at 46. Which is about when Casey will be getting out of jail? (Just kidding. Maybe he'll be out before she's 30.)

Still, shouldn't harp on her appearance (good or bad); we should be worried more about her ignorance -- or her complicity in the whole scam/debacle that Casey has underway right now. And her ruined career prospects.

So it's Jan 18th now, 6 days till the "surpriiiiise!" trustee sale of the Muncy house. And he thinks he can line up a buyer for that thing on a short sale before then! Ha ha! Oh boy, what a dreamer.

Is Galina's brother in jail?

In another thread, someone dug up Galina's maiden name of Suprun and mentioned her sister is Mariya (and on Myspace). Checking the Sacramento County records, there appears to be a 20 year old brother Sergey. It just so happens there is also a 20 yo Ilya Sergeyevich Suprun in the Placer County jail (and what appears to be a judgement against him in Sac county)!

I've just added a new section devoted to Casey's catchphrases - at the moment it covers "sweet deals" and "repaying every dirty penny", but please go ahead and add others.

I also took the liberty of removing the opening-sentence description of him as "a criminal" - I know this looks like a statement of the obvious, but he hasn't yet been charged with anything, let alone tried and convicted. The last thing you want to do is give him scope for a successful libel suit - how ironic would that be?

Some of the visitors to Casey's website today included the IRS, SEC, Countrywide, HSBC, Lending Tree, Suntrust, US Postal Service, State of California, and a bunch from Farifax Virginia that are not reversable ( hehe whom could that be?)

I'm thinking young Casey did finally get around to speaking with some sort of BK attorney, as the moderation and posting has ceased for a day.

I’m still amazed to what length people go to in order to dig stuff up on me. Example of that is the entry Leigh posted above from my personal blog that I used to have last year.
The blog was supposed to be hidden from public but there was actually a back-door and somebody found it. (Homey Da Clown was the first one to let me know he found it, but I’m sure there are other).

That personal blog wasn’t that big of a deal - just my daily log of activities - very detailed and usually pretty boring. I just wanted a record of everything I do daily and also let friends/family keep up with my life.

That was actually the blog that caused my last attempt at a cash-back-at-closing deal to fail last July and that’s how this blog started.

The “disturbing” news that Bankruptcy told me that is that if I declare bankruptcy there is a good chance I can be investigated for mortgage fraud. He had a client recently who actually got criminally charged for over-stating his income!
Hey Julian you never got back to me on the financial for your trailer park. I want to know for the last year:
1) gross income and breakdown of rents per unit
2) vacancy and cap rate in the area
3) itemized expenses including insurance, taxes, utilities, maintenance, management, repairs, advertising, capital improvements, etc
4) existing financing on the property, interest rate, type, etc
5) would the seller be willing to carry back financing?
6) asking price

To follow up, I just read that blog link I posted again. A couple thoughts. I remember reading the Nouveau Riche University name on IAFF blog before Casey edited it off. The description has all the hallmarks of what Casey was describing- friend goes for free, they have properties and investors lined up, etc. etc. The blog states that a one week course is $18,000! I think that blows Casey's "No Lying (for sure!)" resolution out of the water. The kid obviously knows what he is doing is wrong and will bring negative comments to him, but he goes through with it anyway and then lies to his audience. Maybe he was introduced to Noveau Riche through his prior cited "investing club," as my above referenced blog indicates as a means by which people were exposed to NR University.

Given other posts I've read that talk about Casey's history with multi-level-marketing (MLM), I'm wondering if IAFF is just another scheme for him to build a giant MLM pyramid. He has tremendous access to a pool of people to build his pyramid on. Could there be a new type of MLM pyramid based on site referrals or directs rather than selling stuff? Just a thought.

There's a small icon on IAFF that points to the sitemeter stats for the site. View by details and you can see the last 100 visitors to the site. Some of the hits we call "very interesting" might just be workers who are interested like, but I think its too much of a coincidence that all of these organizations hit the site as soon as a new post goes up. JP Morgan Chase has been very active recently.

From what I understand, in California, I can just let the houses go to foreclose and the lender has no recourse against me.

What you think you understand has no bearing. Speaking as no expert or offering "advise" the single mortgage holder of a delinquent note can either go for payment or reposses but not both in cases with no fraud and no refinancing. Ooops.

What you don't know about your own situation could fill a book. Ohhh wait, in California there's that other law about profiting from the sale of criminal exploit stories.

Looks like someone (ahem), pointed out the Nouveau Riche University cost to Casey under his latest post. He bit BIG TIME, and responded. I guess he did pay a boatload for the week long school. Consequently, the 1+1 is that he did lie previously about how much he spent on this program. Can you imagine blowing close to 20 grand (including travel and lodging) on guru school while in the depths of debtor hell? He claims it's not a MLM scheme, but based on my link above, it sure as sh*t smells like it. Based on how I posted the link earlier today and how it mysteriously disappeared, I have a sneaking suspicion that the host site is run or sponsored by Nouveau Riche and they took it down when they saw the link here. Catch the Cache of the site (posted above) while you can!

I use to post on Casey's site but stopped b/c he's an idiot and scammer. Since he doesn't want to BK for obvious reasons....what happens when all the properties are foreclosed, the bills keep coming etc. Can he be forced to BK? Otherwise he can ultimately avoid prosecution can't he? I don't know the answers to these questions. I thought maybe someone here might know as the intelligent folks have migrated over here for discussion about casey.

there is a provision for creditors to file voluntary 7 (liquidate) and 11's (reorg) in bankruptcy --- its not used that often, but if a debtor is preferring one creditor, wasting assets or committing fraud, it can be done.

I doubt it will happen on Casey.

Casey is toast, we all know that and realized this fact early on. There is no feasible way for him to "pay back every dirty penny" until he A) gets a six figure salary or B) wins a mutlimillion dollar lottery. (I was going to put even odds on either of those happening but with his work ethic the lottery is more likely!)

For those of us not sharing CS's fuzzy thought process, what do you think the best way to handle this situation would be?

At this point I think our favorite flipper failure should hit the road with as much cash as he can scrounge up and live in Mexico for the rest of his life. Is this ethical/moral? Of course not, he'll just be running from his responsibilities like a little b*tch but lets face it, he has no other choice and he's been doing just that from the beginning.

BK is out (legal prosecution/jail time).

Paying it all back is flat out impossible.

Continuing to flip property is also impossible. He has no money, backers or credit score. Plus the fact that he runs IAFF and airs out all his dirty laundry.

What do you all think?

Me or him? I get this one from time to time as I have so rather pointed comments about certain deficiences in the US justice system and/or meddling in areas explicitly not their concern in previous posts.

If him, then yes, places like that have carnivore programs that scour for keywords and groupings. In this case somebody recently posted about his combined mail fraud, wire fraud, multi-jurisdictional involvement and such. That probably set off the flagging program. 'Course I just set off the same program didn't i? ;-)

The Adminstrative Office of the U.S. Courts hit doesn't mean anything. Probably some DC judge, law clerk, staff member or bureaucrat is just interested in the soap opera. The AO isn't an investigative organization. Their website is www.uscourts.gov.

As far as the comment on the attorney-client privilege, that is a very good point. Maybe. A court would have to decide. Speaking of which, somebody should compile a document listing everything Casey has said and all of the hard facts that we know about him. If and when the authorities do come after him, it would be good if they didn't have to spend months sifting through the junk to make their case.

Creditors can force a bankruptcy. (This used to be the rule, but now it's the exception. It's usually how it works in other countries.) If anyone is interested, this is set forth in 11 U.S.C. 303. You can find the bankruptcy code online if you want to see the language. Basically, with a debtor like Casey you would need three creditors to sign the involuntary bankruptcy petition, and their cumulative debts owed would have to be over $12K and not in dispute. Readers who really wanted to stick it to Casey could purchase some of his debt for pennies on the dollar and then force him into bankruptcy. I wouldn't advice this though since the bankruptcy judge can impose serious penalties on individuals perceived to have wrongfully forced an involuntary bankruptcy.
