Bullet Point

Duane LeGate was kind enough to make things crystal clear:

Just to clear up a few things. I am in no way any party to any legal proceedings going on. Casey asked me to buy the site. I said ok, then he wanted to sell to someone else. I said ok. THen he wanted to sell to me. I said ok. Then he wanted to sell to someone else. I said ok. Then he wanted to sell to me. I said ok, but it has to be done by noon Saturday,( I was tired of the wishy washy stuff). I waited until after noon EST, and noon PST. I emailed Casey and said I wouldnt buy it because my offer lapsed. Then Casey got mad and said I was presurring him. I will not buy Caseys site. Period.

It matters not what happens in any proceedings. I do not want Caseys site.

I am done with him. I hope this readers digest version helps.

Good for Duane. The only thing that surprises me is that it took a pretty smart guy six months to reach this point. If I were in his shoes, I would have dumped Turdflake's ass after the first clusterfuck.

Not trying to hate on anyone here but what has happened to this site? I've been following this ordeal in the shadows and have noticed that the posts here are drying up big time. Where did everyone go? I see that IAFF is getting tons of comments per post why have people stopped posting here? What happened to all of the haterz? Maybe people are just getting sick of this story i thought with all the support that Casey seems to be getting that there would be alot of hatin over on this side.
On a side note I'm glad that Duane finally pulled the rug out. Why would you want that url anyway Duane? You'd think when Casey's gone the site would stop getting the kind of traffic it's getting today.
One more question: Why does Mark care so much about suing Casey? Obviously he's got no money so why go through all of the trouble to take him to court and all. Even if he wins the court battle its not like he's going to get any money out of it right? Seems to me like time wasted for nothing but maybe there's an angle that I don't know about?
Not trying to offend anyone with my questions just curious.

A lot of the chatter that used to be here moved over to caseyhaterz.com. It has forums, which some people find easier to use; it also has stricter moderation, which some people find harder to accept.

And some of the more prolific past commenters have simply withdrawn a little, citing burnout. CHJTS isn't posting much any more, and Steph comments mostly at her blog these days.

Thankfully, most of the traffic drawn off was recycled content and trolling (though the trolls haven't abandoned EN completely), and the original content still shows up here. Read what was posted not what you wish were posted. We've talked a few times at most and exchange occasional e-mails to keep each other informed on mutual interests. I think we've offer each other advice/suggestions because as you might have noticed we are all an opinionated bunch. So, while there's very little of late we still communicate but there's very little to talk about. Your nonsense about collusion is classic fishing and then repetition to lend credence to a disruptive technique. I'll shortcut the next two dozen posts; no one can prove a negative and even proof won't satisfy everyone. You've already tinfoiled to an illogical conclusion and will no doubt spare no electrons promulgating that opinion. Carry on.

Thanks for filling me in everyone. I have been reading this blog since before the whole Casey soap opera. I'm more here for the good housing market info but kinda got sucked into this Casey comedy (hey my wife has Days of our Lives). Personally I hope this whole thing ends soon so we can get back to the overpriced and crashing housing situation. There are plenty of way worse crooks out there then Kingflopper.
Well Rob just wanted to let you know that you've got fans outside the realm of Casey.

Only two people know the answer to that, Mark and Casey.

Mark probably did cancel the hearing, why we have no idea.

The settlement probably never went in front of the judge, but the only thing that likely would have effected was the suit being dropped. Doesnt make any agreement less enforceable.

If you read Mark's open letter, it lays out what happened that day.

Casey is basically feigning ignorance that this agreement was binding. One thing that Casey is right about is that the agreement is useless if Mark does nothing to enforce. However he is doing something by taking said agreement to the judge and saying, "make him do it" Mark could just "walk away" as I understand it. If I am wrong, i stand corrected.

So, basically Mark brings suit, they settle, tell the judge they have a settlement... Both parties are then assumed to be living by said agreement until it is broken. Agreement is then taken to judge and force of government is used to force compliance. If mark wanted to walk away, he just need not take it back to the judge.

sorry if this is a repeat or gibberish, a little talking out loud going on.

That's the key - if it never got to the "tell the judge they have a settlement" part.

Mark can wave a piece of paper, but if the judge hasn't blessed it, he won't enforce it.

Yes, contract law, cooling off periods, blah, blah, blah... Long and short, a judge will not force a settlement reached on a whim. In front of the judge, if one party is saying they do not agree to a settlement the judge will not accept it. ESPECIALLY with both parties acting pro se.

I dont know contract law, but I dont know that what you stated is correct, guess we're going to find out. LMP seems to believe its enforceable, and Duane made a comment to the effect that the court blessed it, but LMP has never given any such indication.

Considering how tactful I perceive Mark to be, is that part of the plan? Cancel at the last minute. Put Fliptard into a false sense of security who then opens his pie-hole yet again and defames Mark. Mark re-schedules the hearing and now, along with his settlement agreement, brings evidence that Casey is still defaming him despite the settlement. Along with attempting to violate it al-together. The judge, in lieu of the attempted breach of the settlement and obvious continued defamation of Mark, grants the TRO ahead of schedule. Ta da!

From Marks letter it sounds like the following happened

1. they meet outside of the court right before the meeting with the judge.

2. Casey bears his soul and cries on Marks shoulder. Casey tells mark what he wants done and mark aggrees to settle with those terms (you can read for yourself in the letter)

3. They then go and have their meeting with the judge in chambers. i can only assume that they were sworn in, and the agreement was layed out for the judge and court reporter. Judge concurs and tells all to go and be well.

4. Casey then says NO DEAL! 6 days later

5. Mark is now taking said agreement which has since been typed up and taking back to the judge for further action.

Again, lots of assumptions, but this is what I can ascertain from what has been put out there.

Yeah, come to think of it, I remember mark saying that the "bearing all" moment happened after the chambers meeting.
either way, if the meeting in chambers was done under oath and the agreement explained to the judge and all parties give their agreement under oath, I would think that is binding... but I'm not a lawyer, so whatever.

Long and short... Mark is "going for the throat" so to say and is not "Walking away" he is seeking the court to enforce this agreement in whatever form it exists in, so we shall see what we shall see.

I would like to hear LossMitPro's side of why the no-show/cancellation. I know the CaseySpin™ is going on full speed.. and there are inconsistencies in Casey's timeline for his post #30 (July 17th 3:11pm).

I wonder if it had anything to do with Duane stating that he no longer wanted the domain. That the wishy-washy behavior got him fed up at the whole thing and that Duane will not pursue any buying of IAFF.

Pursuing Casey on IAFF at this point could leave LossMitPro with a domain that might not be that sellable.

Or maybe Duane and LossMitPro's behavior is due to a larger shark in the water? (pick up the pieces at a discount afterwards? just speculation here..)

I'm still not seeing how Mark's case is going to do anything to harm Casey. He's already removed his name from all posts and thats all Mark is asking in his suit. The settlement apparently was after they saw the judge so thats not going to fly either. Mark why are you wasting your time? So you can get your 1500 bucks????? Never happen anyway. So you can get the blog?? If Mark does end up with the blog he's just gonna get hated on like Casey. If all Mark cared about was his reputation then why is he so involved in the story? What about work you just have all this free time for talkcasts and court and posts how are you making money?

Question unanswered so here's some more. IMO Mark can't get his reputation back and thats not completely the fault of Casey. After everyone knew who he was he pretty much ruined his own reputation with his threats and telling supporters that he'll sue them if they give Casey money. So what does he have to gain from this? Why waste so much time on suing Casey? If Casey is being honest with the premise of Marks suit then all he has to do is remove his name which he's already done. It seems to me that Mark is BSing all of the other info that he has let out of the bag. What is in it for him the domain? Its got a buy it now price of 492.00 on go-daddy.

No I don't think LossMIT really cares about making the Haterz happy. Collections people generally don't care about stuff like that, much less what their internet rep is.

If LossMIT did go to bat for Casey and called in some favors or even just used his contacts on Casey's behalf and Casey fugged it all up, you can't just walk away from stuff like that. I believe Mark indicated that was his doing. GoDaddy was notified and placed on notice to ensure fliptard could not try to transfer ownership of the domain through sale.

alomst all registrations & all proxy domains say that, you have to unlock proxy to initiate a transfer!

LMP does not initiate a transfer so casey's excuse of waiting for an email is not valid, the seller initiates the transfer, buyer do NOT request transfers!

yes but its not that simple, if he doesnt renew by sept5, it will show up as expired but it will say 'not available' since he still has 60 or 90 days before anyone can get the domain.

Who is their right mind would actually spend $$$$ for rights to IAFF? It's the drama that draws traffic and once Casey goes so will that traffic.

Perhaps a company might be willing to pay a few thousand for the domain name but 10, 20, 30 grand? Forget it.

i posted this at CHC... it's basically my understanding about how the law suit has played out so far...

"Mark has sale rights and set up the deal with Duane... Casey then starts to shop around the price (after gushing on the talkcast that Duane is the right guy to buy, blah, blah, it's going to good hands, blah, blah, bleh, I love duane, duane loves me horse crap)

Mark hears about Casey shopping the number around and gets pissed because all sale offers must go through him. Mark offers to contact these other potential buyers to vet them out and make sure they are for real. Casey takes this as some sort of affront to his manhood and gets upset and does the passive aggressive thing of saying that he was going to transfer and sell the blog to Duane as agreed, and then does not do it, then whines on his blog about how mark and Duane are trying to run his life even though that's essentially what he asked Mark to do in the settlement. Fliptard then blogwhines that the deal is off, but according to Mark, the deal is far from being off, and in fact he is going to the judge to have it enforced via the court becasue Casey couldn't see fit to abide by the agreement he made.

Also in the agreement , the money is to go into an escrow to be transfered to Galina. Fliptard changes his mind (after talking during the soul bearing shoulder crying lunch) that he in fact DOES want some of the money to pay for a lawyer. Mark reminds casey that this is not in the agreement, so caseys goes on blog and annouces "NO DEAL" "

It's basically a way to help Galina out and take something from Casey. I doubt the domain is worth $10 at this point.

But Casey wants to make sure he gets a cut as he's about to get divorced anyway..

I see his motive. I'm thinking he thought Galina was everything to him, and Mark encouraged that thinking, and found a noble way for him to show it. But Casey doesn't understand how symbolic the cash might be to the relationship, and in any case wants to stay out of jail.

I've been thinking about the FBI. I think now they did contact Serin, mostly to coincide with this deal before him. It saves them hassle. Their timing is quite intentional. Alas, it scared him too much, giving him cause to fight. Fuck nobility, this is jail we're talking about.

And if my wife said it was over, I'd pull this same move. She has given up. He's alone now. He's got one asset that could keep him out of jail. If only he finds some super secret Kill Move to thwart Mark! LIKE GETTING A MOTHER FUCKING ATTORNEY RIGHT FUCKING NOW.

But we know he'll botch it. We know he is doomed. Beyond normal doom, his doom is karmic and spiritual. Like some comic strip character, he will always make the worst choice imaginable. And so we can even watch with a tinge of sadness, fully aware that we're powerless to help.

Also, I seem to recall that the court date required Mark to be present but not Casey; I think Mark said in a posting that Casey could be there if he wished but that it was not necessary. Consequently, it would not be incumbent upon Mark to notify Casey of a change in scheduling. It would have been polite, but I think we're past the stage of niceties here.

It's still a top hit for the keyword "foreclosure". All you have to do is change the site header to something like "That banker is going to make your family homeless. Fight back with our help".

You'll be guaranteed lot's of potential clients. Especially if your business is finding the most desperate people facing foreclosure, and making a profit from them. (I'm not pointing fingers at anyone in particular)
