Will he also disclose that he tried to close on all of his deals at the same time so that lenders would not be aware of his borrowing schemes?

If somehow, someway he were to 'win' some sort of judgment against his lenders due to predatory borrowing, it would just be a sign that the apocolypse is upon us.

Sucks that those "book" tapes were posted online and there's a chunk in there that Casey talks about lying on the residency requirements... sought counsel to find out what "shade of gray" it was...

I think he was told it was indeed illegal, then decided to worry about it later...

I would think if he tries to throw lenders under the bus, they'll turn some attention back at him.

Daly opposed the bank's foreclosure on his $14,000 home mortgage loan on the ground that there was no consideration for the loan. "Consideration" ("the thing exchanged") is an essential element of a contract. Daly, an attorney representing himself, argued that the bank had put up no real money for his loan. To everyone's surprise, Morgan admitted that the bank routinely created money "out of thin air" for its loans, and that this was standard banking practice. Plaintiff admitted that it, in combination with the Federal Reserve Bank of Minneapolis, . . . did create the entire $14,000.00 in money and credit upon its own books by bookkeeping entry. That this was the consideration used to support the Note dated May 8, 1964 and the Mortgage of the same date. The money and credit first came into existence when they created it. Mr. Morgan admitted that no United States Law or Statute existed which gave him the right to do this. A lawful consideration must exist and be tendered to support the Note.

The court rejected the bank's claim for foreclosure, and the defendant kept his house. To Daly, the implications were enormous. If bankers were indeed extending credit without consideration – without backing their loans with money they actually had in their vaults and were entitled to lend – a decision declaring their loans void could topple the power base of the world. He wrote in a local news article:

This decision, which is legally sound, has the effect of declaring all private mortgages on real and personal property, and all U.S. and State bonds held by the Federal Reserve, National and State banks to be null and void.

They have nothing to loose and will let lose on him in a way that will make Friday's nasty seem itsallgoodly.

I wasn’t going to comment on this topic given the pending settlement, but I feel the need for accuracy is important as well. (If Casey doesn’t like this, oh well, we can continue where we left off...)

These mortgage challenge schemes are illegal and have been around for sometime. They offer no credible service other than pretending a secured debt can be eliminated, simply by threat of suit based on too often erroneous grounds. Having said that I myself have used discrepancies to cause a lender to rethink its position, and therefore play-ball more with a borrower (in the context of foreclosure & collections compliance). But to claim a mortgage or other secured debt can be “forgiven” simply based on minor errors is, well, stupid in the extreme.

These firms first pretend an analysis of loan docs, and then charge thousands to “represent” borrows in purported action. Naturally, suit is never engaged but the consumer’s money is long gone. Simply, what Casey is falling for is a scam and I’ve advised him of as much sometime ago.

Moreover I PERSONALLY know Countrywide (one of Casey’s lenders) isn’t going to find this tact amusing. Although since I have my own detractors who are bound to call me a liar? Check out the link below, if you’ve any further doubts?

It’s crazy… after talking to this anti-predatory lending company I am amazed what I didn’t know. After I get my papers reviewed I should know for sure. I knew there was a lot of craziness going on in the lending industry. I saw it first hand.

But I never felt like I should be the “whistle blower”, since I didn’t really know what I was doing and what is right and what wasn’t. There was A LOT of reliance on certain “professionals”. I didn’t do any of this in a vacuum.

If only ONE person would have told me that anything I’m doing is ILLEGAL or I can go to JAIL for any of my deals or loans, I would have not gone further. The best I got was “gray area” while most of my professionals / investors / associates / gurus didn’t think there was anything wrong. Perhaps this might be the time to paint the picture with all the colors.

I guess, as they say - you don’t know what you don’t know. I will not say anymore until I have everything properly researched and backed by experts.

Good chance he's jerking everyone's chain, but this "anti-predatory lending company" seems to be the latest shiny he thinks might be his "Get Out of Jail Free Card".

Reading Casey's latest post and some of the earliest ones is interesting. In the early ones he states over and over that he isn't an expert on fraud and isn't qualified to judge what it is. The term "whistle blower" is used over and over. It's like he's personally afraid of the people who loaned him money...

Seems to be the case, and it is a shame that sounds similar to other circumstances I have recently become aware of where threats & pseudo-legal intimidation are about all a nearly impoverished 'client' appears to get for their money.

So you're just going to ignore the Al Quaeda attacks in 2004 (Madrid) and 2005 (London)? How about the daily attacks on our troops? There has been one attack every year between 2002 and 2005 in Indonesia connected with Al Quaeda.

So, you're solution is to keep supporting Israel so that either...

a) We get attacked my Islamic extremists on our own soil because we support the Jewish invasion of their lands...or

b) We keep troops in the Middle East indefinitely in order to keep them from attacking us on our land.

Yeah...both of those sound like fantastic solutions. It's not our job to play World Police, contrary to popular belief. If we had just let the Palestinians snuff out the Israeli invasion in the first place, we wouldn't be having this debate at all.

If you want to go back even further, if we hadn't allowed the morons leading the world draw border lines through ethnically diverse regions in the Middle East after World War II, Iraq wouldn't be such a mess either. Ever wonder how the Sunnis, Shiites, and Kurds all ended up living together in Iraq? Pick a world leader in 1946 and blame him.

You brought it up, so here's why we're in the Middle East, oil. Sorry until the oil is gone (and Katy-bar-the door then). There will not be any departure from the Middle East. It's been the most important strategic point globally since ships were converted from coal to fuel oil (yes I know that many are nuclear now, but almoost all the nuclear ones serve as little more than mobile airbases--and most of the air power uses oil again).

Why on earth would we (the West) abandon the prize we won in World War I (and held in World War II)?

Actually, the only real solution to stopping Al-Qaeda is to turn the entire planet into an Islamic caliphate run along strictly fundamentalist Wahhabist lines, as that's their ultimate aim - everything else (Israel, Palestine, Iraq) is merely a convenient excuse.

And since that's not going to happen, they have to be defeated by other means. (Sadly, the only truly effective ones involve infinite patience and long-term intelligence-gathering, which politicians dislike because they don't involve big explosions on the nightly TV news bulletins).

I hope Snowflake does sue the banks; it might piss them off so much that they press the issue of Mortgage fraud and sue him back. So far it seems they have cut their losses but if this does happen I hope they go after him and have his wages garnished, not that he has a job or ever will it would be nice to know that if he ever did he would lose most of his pay check for his past crimes. They have all the evidence they need from his website.

Has there ever been a successful lawsuit along those lines? I know of loads of attempts, but every time I look up the details I find the judge threw the case out within seconds of reading it.

But I generally agree with you: Casey has done many boneheadedly cretinous things, but actually threatening to sue his lenders must be one of his stupidest moves yet. If any of them were wavering about whether or not to sue him, the decision has just been made.

Actually, when I was back in Canada (Toronto) I heard about an interesting twist to this kind of situation.

Two burglars broke into the home of a practicing magician. Unbeknowst to them, the magician had an exotic pet license and had a pet cougar in his home. The animal was completely tame, mind you. But the burglars didn't know that.

Now its hard to separate fact from urban legend, but the story goes that while the burglars entered the bedroom to ranshack the jewelry, the cougar appeared and sat in the doorway, blocking the exit. When they saw the animal, they froze and then in a panic, climbed into the furniture. Where they apparantly stayed until the owner returned home, since there were no obvious exits from the bedroom other than the main door. Upon realizing what had happened the owner promptly called the police.

Now apparantly, the burglars filed a lawsuit against this individual claiming that there were no warning signs on the premises and that their lives were in danger from the cougar. I think the case was eventually tossed out on the grounds that warning signs pertaining to pets only apply if the pet exists in the yard area. If it only resides in the home, no warnings signs are mandated.

Nonetheless, a somewhat comical story.
