It appears they broke up a week or so ago, as Marty's trolls disappeared and Casey changed the way he talked about the book deal, admitting it would be self-published.

Cut Cote some slack. I don't think he's just jerking us around, playing Casey-like games with teasers. If he is, and he is found out, he will lose cred. But his past actions, over an extended period of time, warrant giving him the benefit of the doubt.

After all the half-cocked guns that have gone off over the last six months, it's OK that someone wants to proceed deliberately. Isn't that precisely what people lit into Lost Mittens about recently--that he lost his head, that he embarrassingly went for the jugular, employing nuclear legal overkill, etc?

Just as, in reverse, Casey's actions, over time, warrant disbelief of his current epiphany. Casey could rebuild his credibility, but only over an extended time, with actions marked by consistency and integrity. He's earned the scorn with which he is generally greeted today.

It shouldn't be. That was mentioned copious times in the past.

My opinion is that the LMP litigation was the final nail. He likely suspected the Feds were looking into him. But in his Casey "its all good" way, he probably glossed over it as nothing to be concerned about.

Now with the LMP litigation and the notion of what the "discovery" process could potentially dig up, he was likely advised by an attorney to cut his losses as soon as possible. Probably got a good talking to by his folks as well.

You really can't deal with the Feds unless you are extremely high up the food chain. He's screwed. He can get one of those co-operation letters for the judge, but.... mandatory sentencing and all. So he'll still serve time.

I think there is a lot of merit (if this FBI junk is true) for the feds to go after Casey and Casey alone.

The prosecutions are just starting... things are going to be a mess for a long time because of all the players involved in the bubble.

IMO,

I don't think Casey does any real time, especially if he cooperates. In the grand scheme of things he is small potatoes. They could use him as evidence to make the lenders open their books to see what other types of loans are on their books.

As said earlier, even if he gets time, it will be minimum security/Club Fed type of place. But then again, probabtion wouldn't surpirse me.

I agree with Harold. I don't see what potential benefit Casey could bring to a larger indictment. He could have played the "I'm innocent game" if he had not gone down the blog path. But with his story wide open and numerous references to his open statements regarding full knowledge of his actions, I can't fathom anything of value he can bring from a testimony standpoint.

If the Feds are investigating him, they are likely investigating him and him alone. As stated earlier, he would represent a message to all the other fliptards and wanna entrepreneurs that helped fuel this housing insanity. No one is above the law.

There are countless Caseys out there who committed mortgage fraud. Organized gangs, mafia types, foreigners, etc... have been commiting mortgage fraud all over the country. The only reason I can think the FBI goes after him at this time, is due to his media coverage and higher profile. They arrest him and prosecute him and it will make the papers. I think Casey's newfound interest in saving his marriage is based on trying to please his parents. He is in a heapload of trouble, and will most definitely be needing legal counsel and finally realizes it. My bet is that he wants to get back into his parent's good graces in the hopes that they will see that he "has seen the light and is changing his ways". And perhaps if he can con them into thinking he's really concentrating on being a better husband, then perhaps they will foot the bill for his lawyers. If they fall for it, then he will have succeeded in his largest scam to date.

The Eff Bee Eye is aware of a case of repeated criminal wrongdoing, and have it so far down on their list of priority prosecutions,as to be invisible.

Then,howevever,their very public target ends up getting dragged into court on a civil matter,where essentially their entire case is going to comeout indiscovery or cross-ex...by a loss-mitigation/debt collection guy.

Kinda embarrassing for the Byoo-row,huh?

The Byoo-row does NOT like to be embarrassed...there's a bunch of dead kids in Texas to attest to that fact.

So, this civil matter MAY have forced them to show their hand.

FWIW,Casey isn't going to testify for anyone or against anyone.

1) He'd make a LOUSY witness,he's EMINENTLY impeachable.

2) What does he have to bargain with? What does he know? He's nailed.

There was a $22K "private note" that came due and he blew past it about a month ago, but maybe that was actually the Hammar loan -- the amount is so similar. Hard to tell with him since he invents his own vocabulary for everything and changes it at whim.

Wouldn't Casey's testimony about his interactions with, say, a loan broker, be useful to prove the loan broker knew about/agreed to the mortgage fraud? I'm thinking of an exchange like "what's the number we need to his on the stated income application?" You'd need that kind of evidence for a conspiracy charge against the loan broker, and it wouldn't be easy to get elsewhere. What am I missing?

I imagine they probably could just give him what's called 'use' immunity for any testimony against mortgage brokers that they need from him, and then still nail him with the paper work.

Or convict him, then bring him back as a witness against the mortgage brokers at a later date.

He too little a fish, and has been far to public with his dealings. I mean, I don't imagine that he is the number two guy in a whole secret network or anything.

Still, I'd hate to have had any actual dealings with him. Who the fuck knows what fantasies he's going to spin.

Holiday Inn may not be so far off. Remember a few months back (in the big world, not the caseyworld), talk of the Federal Gov. bailing out "homeowners" who were going to default on mortgages they should have never taken on? Politically, there are a lot of people who would like to see and/or benefit from this whole "foreclosure wave" going down as the fault of the big, bad banks. I can't speculate on how much news coverage the trial of Casey Serin would get (in the big world), but let's say it did. He could provide a really nice narrative to go along with the spin of the big, bad banks being at fault, and some representatives could get their names in the papers by passing legislation to regulate the lending industry. Win-Win!

Also, if that happens, it's likely to make it very, very difficult for many people who didn't "get while the gettin' was good" to ever buy a home in the future.

Sigh.

So to recap:

Casey thinks he has waken up and seen the light (we shall see)

He then throws Marty under the bus (illegal agreement, wow)

Mark's lawsuit seems to be having an effect no matter what Casey wants to publicly say (sure, Casey, this is has NOTHING to do with your lawsuit, okay)

He thinks by stopping the blog he will win back his wife? I wonder about that. He harmed her, not with physical violence but with emotional distress.

Fuck him. If he is not bullshitting us, I wish him the best. I hope he salvages whatever he can and stays on the straight and narrow. Problem there is I doubt he will not completely stop. He's tried pyramid schemes before and tried again and then tried to become famous for it...he lost.

I feel good that he is validating everything we've all said for a long time now. I feel that I've done my job here. Maybe, just maybe, I can walk away from this knowing I contributed to keeping a criminal from hurting any more people.
