Nigel Alert

Yesterday, I left a note that I had a long chat with the FBI, and I needed R-Boy to contact me asap. This will be a fairly long post, so I apologize in advance. Just use the PAGE DOWN button if you find any of this tedious.

Well, at 6:30am this morning, I got a phone call from R-Boy, which proves that my own madSkillz at Internet 'search-and-find' are in pretty good shape. R-Boy and I chatted for nearly a half-hour, and as a result, I've decided to post the details here.

For all of those who have been of help researching the KC situation, first off, let me say thanks. In a big way. And in particular to R-Boy, who has been a great source of info. In particular, who to contact at the various agencies who might be interested in the whole Casey Serin saga.

Oh yeah… and this is important: WHAT was my motivation to contact the FBI about the whole KC saga? Simple. I'm a Real Estate Agent. I've been following the whole KC story for the past 6+ months, because it's amazing and interesting.

But last week I was working with a married couple, who wanted to buy a house. They had marginal credit, and I knew this from our conversations. Finally, they'd been approved to buy a 'starter home' kind of house in our area. I spent a lot of time driving them around to look at homes, and finally, they found one that would work for them.

I called their mortgage lender to get a pre-approval letter that's necessary for a formal Purchase-and-Sale Agreement. The lender told me that in the past few weeks, the scales and ratings had changed… and that my buyer was no longer eligible for a loan.

I passed this disappointing news to my buyer/client. I told him that he'd have to take a few months (maybe a year) to pay down his debts, and improve his credit score before we could make an offer on a house.

His reply? "Well, what about that guy in California who bought 8 houses with no money down?" I was… dumbfounded. Speechless. And he had a good point. After all, he has a job, is earning an income, and HE's the one who can't buy a house? Not even ONE house?

Okay. So here we go:

Based on contact info that I found here, I picked up the phone (my cell phone), and called the FBI agent that R-Boy had mentioned. The FBI switchboard put me through to his desk… but I ended up with his voice-mail. And I left a message about KC, his antics, and why I was calling. I left my cell-phone number.

About 15 minutes later, I got a call back from this FBI agent. Cool!

On the phone, this agent got right to the point: "WHERE did you get my name and phone number?" I mean, right out at the start. I explained that I got it from the Internet, and that there are a lot of websites that discuss the KC saga… and that I couldn't remember exactly which one.

Next he said: "I have your name and phone number. We're the FBI. I need this information. Are you willing to help me, or should we end this conversation now?"

Okay, now I was scared. I tried to not remember where the website was where I found the info. His response? "Take your time. Go through your Internet History. I'll stay on the phone while you find it. Take as much time as you need, and remember: we have your name and phone number."

Okay… now I was REALLY scared! What had I done wrong? I'd only called the FBI, and used the publicly-available phone number… and I called from a phone that could be traced in seconds!

So… while on the phone with FBI-guy, I pointed him to the post from the most-helpful R-Boy … the one with the FBI agent name and phone number that any of use could call to help out, etc.

At this point, this FBI agent calmed down quite a bit.

He explained to me that "calls such as this detract from his other work" – and that he didn't have time to take such calls and listen to them, because an investigation was already underway.

Aha! An investigation that was already underway! I silently cheered to myself.

I asked about the status of this investigation, and his reply was simple: "I cannot talk about any ongoing investigation." And… that makes sense to me.

So what's the upshot of all of this? Well, I've contacted the FBI. They have my real name, phone number, street address, and … a lot more. After all, they're the FBI.

This FBI agent is clearly upset with me, because I disrupted his work schedule with questions about a case that he knows about. I mean… all I did was call and ask. As a concerned, taxpayer-citizen, etc.

My reward? Well… not much. This FBI agent, who I have not named, made me feel uncomfortable (at best) about passing along information about a very visible person who has committed numerous felonious acts of Mortgage Fraud.

I pointed out to this FBI agent that this is a person who… when all the dollars hit the floor… this person has clearly STOLEN MONEY FROM BANKS to the tune of over a half-million dollars.

$500,000+. Stolen. And used for gambling on the Real Estate Market.

Overall: the FBI is not interested. But I guarantee you that if I walked into a bank tomorrow and robbed it for $500,000+ … it would be front page news, world-wide.

Oh yeah… final note: this FBI agent that I talked to? I think he asked me to promise that I wouldn't divulge any of his phone number info with any posts on the Internet. Oh wait… maybe that was another call. I really can't remember.

We just went over 10,000 page views -today-. We laugh at Nigel, we do even worse by not caring about the things he values but he'd give back Casey's left nut for those 10k views. Now it is beginnning to dawn. All of a sudden Nigel is facing the prospect of his behavior being associtiated with him professionally. I saw this coming a long time ago but my taxes pissed me off enough to push the big red button today.

Dawg, I'm glad you did. Somebody had to. I think he needs to learn some hard lessons. One of those is, if you choose to be a public figure on the internet you need to be prepared for criticism. Secondly, you can not invent how you are perceived. Casey tried it and you saw as the whole thing got ripped apart. When you piss off a community on the internet, the teardown is brutal. That is why being as sanctimonious as he is while trying to tie his presence to his professional life is going to have dire consequences. Anyone looking for a mortgage just might well look elsewhere. As would his boss.

Interestingly Nigel's boss Byron Goates is a guest writer on Gold Medallion homes' blog, which Nigel runs. And Nigel got himself a nice SLC plug out of it too. Anyone catching some conflicts of interest here? Quinn Mortensen and Kristen Nilssen seem like nice enough people, but man their little community is a little incestuous.

This is Utah though, I have to remind myself.

So anyway, I do believe that one of those bigass homes that he and snowflake visited are Gold Medallion homes. Imagine!

Jim, I have alot of respect for what you did, and I am glad we made some comment and know something is going on.

For what its worth, I was given the agent's name from the author of one of the scotsman guide articles, who had suggested I contact him. I did, and left a message, but he never called me back.

So you got the brunt. Kudos to you for going through with it. The more we make LE aware that they are dropping this ball, the sooner something happens

because I had no evidence that he was in any way involved. then Mssr Swaby pointed out that he had directly involved Byron Goates of Integrity First Financial, byron@integrityloans.com at 801-474-3333 ext. 202 and based on what Nigel claims to have told him his response was to laugh it all off. clearly he is either involved or misinformed and needs to be straightened out as to the consequences of having the likes of Nigel Swaby "on his team." It should be no secret by now that I "walk softly." I don't need to bluster or threaten. These people need to understand that the day of the mystic moneyman is over. We don't bow before the broker. Sure in the bigger picture the fact has always been that I won't take my {mumble, muble} millions or whatever the number and invest through Integrity Loans but with this negative publicity they are just that much less competitive for many other loans as well.

If I held my clients in the esteem the mortgage industry does theirs I'd deserve a spanking too.

Real Estate Carnival Recap
It was a successful week in the blogosphere for my Carnival submissions. Each one got picked up by the respective hosts.

A win, or at least a first place position, came from the submission to the Consumer Oriented Real Estate Carnival hosted by Real Opinionated. That article discussed the many loan options still available for first time home buyers.

The Carnival of Real Estate was short this week, but my post on down payments managed to make the list. Thanks Mike!

I answered some real estate questions at the Carnival of Personal Finance hosted by the Lazy Man.

Finally, the Carnival of Real Estate was hosted by New Homes in Utah, the blog of a Salt Lake home builder. I submitted Byron Goates' 2nd guest post on buying homes wholesale where it got a mention.

I like the blog carnivals as they provide good feedback for my writing/subject selection and they create a bunch of inbound links for SEO purposes. I'll be hosting the Consumer Oriented Carnival of Real Estate in early April. Thanks to all of this week's hosts for putting out some quality work.

I find it interesting that Mr. Integrity Swarmy Loan shark fails to disclose to the public the fact that Mr. Goates is his boss, or that he makes a living off of those various homesites he whores out at New Homes in Utah. And this is the same Mr. Goates that according to NS is in full approval of his actions and statements.

I wonder if Snowflakes's money man in Utah "Mr. G." is Mr. Goates? It would make sense. Snowflake flew out to Utah to what seems now to do another illegal cash back at closing- was it on one of a New Homes in Utah house? Was "Mr. G" going to finance it? If he was the builder, he would have made a ton of $$$ selling the property to snowflake, then NS and "Mr. G" would have made money on the loan. Even WHEN Snowflake defaulted, all of them would have made money.

1. Snowflake $500,000 illegal cash back at closing
2. NS & Mr. G from selling the house and financing the loan.

Perhaps RBoy, Dawg, and Homey can look into this.

It’s too bad your comment was lost in the latest Nigel hysteria. If you mentioned the purpose of the call as you describe and he called you back within 15 minutes, it seems odd that he would mention you were distracting his work. Mixed message. Overall, did you get a sense that they were seriously investigating the issue?
Although Casey is definitely small fry in the big picture, the fact that his shenanigans are so well-documented and highly publicized doesn’t make the government look like they’re doing their job so I hope someone in the Sacramento area eventually wakes up to that.

To answer your question: NO. I didn't get the sense that there was any serious investigation going on. Instead, I got the sense that he was being annoyed by phone calls. Maybe I was the first one that he could contact and 'pin down' with name and phone number... and vaguely threaten me that he was the FBI, and etc. That's just my overall take on the call.

Yet ... you bring up an interesting point. WHY would he call me almost immediately? Maybe he was looking for some info that he didn't have? Maybe his boss was telling him to look deeper into the situation? And maybe that I could provide web-link info that would make it easier for him to do his job?

I honestly don't know.

But what a ride. Wow. The FBI called me on my cell phone. Whee!

It doesn't sound like they're doing anything about Casey to me. My guess would be the FBI guy was on the phone when you called, checked his messages when he got off, got pissed off, and called you. I found a web marketing page that lists Mark Swaby as account manager for some client, but lists Nigel as the contact. Either they're the same person or related.
