Stealing FROM the IRS?

“The system in my eyes is inviting criminals like myself to steal from the IRS, banks, et cetera,” Evangelos Dimitros Soukas said in testimony before the Senate Finance Committee.

Soukas, 28, serving nearly eight years in prison for defrauding the government, banks and individuals of $1.1 million.

"I'm seeing a lot of comments, blog posts and even articles calling Casey Serin a criminal. Some ask why he's not in jail yet, while others say he's "confessed" or even been convicted. "Robert," a commenter on this board, eloquently stated,

Sorry you weren't paying attention in civics class, but that ain't the way jurisprudence works around here. If you commit a crime, it doesn't matter whether millions are outraged or no one gives a damn, the blindfolded lady decides ... not a cult of random people who take it on themselves to express their anger.

Our country has a process, indeed a system to deal with citizens who commit crimes. In a case like Casey Serin's an investigation must take place first by law enforcement officials. If they find enough evidence they believe would convict Casey, they take that evidence to a prosecutor who will convene a grand jury to review the evidence. If the grand jury believes the evidence is sufficient, they will create an indictment. At that point, Casey Serin will be arrested or arrangements my be made to turn himself in. If he goes to jail, provision may be made for him to be released before his trial. This process is known as bail.

In his first court appearance, Casey Serin will enter a plea of guilty or not guilty and bail may be set if it wasn't previously. Casey may consider pleading guilty to avoid the costs of a trial, or to obtain leniency from the court. This is known as a plea bargain. Otherwise, the prosecutor will have to present their evidence and make their case. After the trial period, a decision is reached by either a judge or a jury to determine guilt. If Casey is found guilty, then a sentencing phase takes place. Because of the crime, monetary losses and methods used to commit the crime are utilized to determine severity of the sentence.

You can see there are many steps to be taken and a long time period to be waited through before anyone can accurately call Casey Serin a criminal. In this country we have a presumption of innocence before a trial. Too many people writing about Serin as being guilty could taint the jury pool and have the trial thrown out on a technicality.

EN commenter Sprezzatura has a reasonable view on this aspect of the subject. She recently wrote -

I've said before my belief that Casey wasn't going to get prosecuted, and that his punishment would come more through an inability to escape bankruptcy and years of financial hardship.

Through luck or planning, Casey spread his borrowing around in such a way that no one institution was overly affected by his shenanigans, and therefore they're all less inclined to pursue additional penalties beyond foreclosure.

One thing we here at EN are not always good at is separating what we want to happen from what is actually likely to happen, and this is one of those areas. Just because we want him to be punished doesn't mean he is going to get that punishment in our preferred manner.

Some of you may be asking, "who cares if Casey Serin is treated fairly?" He deserves what he gets, doesn't he? It's this type of argument that creates a slippery slope to tyranny. One terrorist attack in 2001 has got our Federal Government ready to trounce all over the Bill of Rights. Every time I hear about another provision in the Patriot Act or government eavesdropping or what's happening at Guantanamo Bay, I think back to Benjamin Franklin's prescient statement -

They who would give up an essential liberty for temporary security, deserve neither liberty or security.

In the name of fighting terrorism, or Casey Serin or insert fear of the day here we are easily giving away our rights to live freely, conduct business and provide a peaceful existence for our families. It has been said,



It is better that 5, 10, 20, or 100 guilty men go free than for one innocent man to be put to death. This prinicple is embodied in the presumption of innocence.


Yes, but Casey's a scumbag. He lied on his loans. He deserves to be railroaded! He doesn't deserve the protections of the law. Again a slippery slope. People often wonder how states like Nazi Germany or North Korea or some of the African and South American dictatorships come to be. It happens slowly and with one freedom or objector removed at a time. A famous poem written about Nazi Germany reveals the process -


They came first for the Communists,
and I didn't speak up because I wasn't a Communist.


Then they came for the Jews,
and I didn't speak up because I wasn't a Jew.


Then they came for the trade unionists,
and I didn't speak up because I wasn't a trade unionist.


Then they came for the Catholics,
and I didn't speak up because I was a Protestant.


Then they came for me,
and by that time no one was left to speak up.


By treating Casey Serin fairly and utilizing the legal system that has been established for over two hundred years, we're not going light on a criminal, we're maintaining and protecting our own rights and the rights of our children. Let's not be blinded by the publicity Serin has attracted, let's simply allow the law to follow its course."

Your quote of mine is accurate; I do not think Casey will go to jail. That does not mean that he is a good person.

My family members who were rounded up by the Nazis, stuffed into trains, and shipped off to the death camps were good people. Imploying that Casey is as much of a victim as they were is an insult to their memory. Shame on you.

Playing the nazi/hitler card in any argument equals an instant loss of the debate.

Who is saying that Casey is being treated unfairly besides Casey? We the taxpayers are the ones who are being treated unfairly if he skates. Haterz are simply doing our part to make sure that law enforcement is aware of Casey's transgressions and our displeasure about them as voters.
