What Rob said was not lame, it was just one of what is likely to be a flood of comments on Casey's blog. (I contributed several tonight--I never signed on to a "boycott" as I value my freedom quite a bit).

Whether Rob does it or someone else does, the blogosphere is crying out for someone who merely _ECHOES_ (quotes verbatim, in its entirety) each of Casey's main topic starters and then lets the chips fall where they may, in responses.

Here, Rob quotes his own reply to part of what Casey said, not Casey's entire (and typically amazing) post.

Which is not to trash what Rob said, just to point out that what Casey said is much more of a topic starter in its sheer audacity (confusing a $250 option with a $1500 payment, bringing up again the easily-dismissed "raffle," and the looming deadline of a gavel auction of his most valuable property next Wednesday).

Sorry, Rob Dawg, but I have to call them as I see them. I expect to be adding more comments over in IAFF.

Things are getting close to the Singularity...don't blink.

Some interesting numbers for math geeks... Let's assume Casey's debt is $2.2 million, increasing at an average rate of 30% per year. Let's also assume the U.S. National Debt is $8 trillion, increasing at 5% per year. These are just approximations, fudge the numbers as you please. Anyway, we can then calculate when Casey's Debt will outpace the National Debt with the following calculation --

(2,200,000)*(1.30)^n = (8 trillion)*(1.05)^n

Solving for n gives a value of approximately 71. Meaning that if left unchecked, Casey's Debt will be greater than the entire Nation's Debt in 71 years!! Wow!!

I am surprised that California doesn't have a right of redemption, but after playing google monkey, it appears many states have also abolished it.

What it means is that Casey would have the right to redeem the NM property by paying the back indebtedness, plus all costs for up to either a year or six months. So this, while not exactly free money, is really really close to it, caue no way Casey will ever be able to redeem that property, even if he wanted to. $250 money for nothing, for sure plus another $1250 (and he might be able to get even more, as a poster over on IADFF points out).

I bet Casey doesn't do it. Then talks about how maybe he should or maybe he shouldn't and gets the check but sends it back and......

But this was dismissed in the first days of this blog: Casey's debt is NOT, repeat NOT, the $2.2 million that some of the early newspaper articles incorrectly stated.

Tim, yes I know -- his actual current debt is closer to $600,000 ... though increasing every day due to house price depreciation.

It actually doesn't affect the calculation that significantly, due to the wildly different interest rates. If you say Casey's debt is "only" $600K, then the time to reach National Debt level rises to 77 years, rather than 71. Not much difference... :-)

Yes, you are exactly right. I believe this is the builder/realty company offering Casey a payment in exchange for allowing the foreclosure to proceed with no further legal drama on Casey's part. New Mexico redemption period is only 30 days. Casey couldn't come up with "one dirty penny" but this is the equivalent of paying a bad tenant to move.

You might get lucky and get $250 for it, but will the buyer of that Right of Redemption actually be able to gain anything of marketable, non-negative value out of this? Seems really unlikely. And thus you'd never see the $1250.

My personal take, if I had to do it without legal advice? DEAL! Take it and run. You yourself have ZERO chance of getting that property back yourself. Anything you can get now is better than zero. Heck, you might have solicited higher offers before now, but.. well, as usual, too late!

Still, $250 can pay your health insurance and gas money for a month. Or.. hey, why not instead just use it for the cell phone bill and a Jamba Juice?

There is no libel. All comments directed at Casey are the result of his own public admissions and his publication of facts. He is a limited public figure through his promotion of himself through his blog, his radio broadcast's, cooperation with Sac Bee, New York magazine, USA Today, etc.

What would his damages for libel be? He injured his own reputation and business through his blog admissions. He also admitted his own criminal activity on his blog.
No damages, no libel.

Threats of death and physical harm, without fear of immediate personal safety, have no defense and are considered criminal.

Everyone, let's just relax for a moment. It seems very likely to me that someone (Looser Boy himself?) is trying to fool around by posting as certain people. I really don't believe that several people whose thoughts I've enjoyed reading for several months now have seriously gone off the deep end all on the same night.

A couple of days ago I predicted that if IAFF continued to face declining visits and comments, that this blog would come under fire. Sadly, that seems to likely be the case.

Yep Heidi, I did my homework on all this and you cannot sue for "libel" if you are posting your mistakes and fraud for the world to see.

As for Copyrights, what copyrights? His flickr account allows for FAIR USE on blogs and websites. I read their agreement. I can use it for COMMENTARY and DISCUSSION relating to CASEY'S public persona and admissions.

I don't think he owes money to the bank, I guess they could go after him for whatever they can get, the IRS however can go after him for the 1099 that he would receive. Despite the fact that htis has been discussed ad nauseum at Casey's where if he is insolvent the IRS cant do squat, I think the grey issue here is how he went about getting those loans, which is the mani reason he has not declared bankruptcy already. The lenders would nail him to the wall for that, and then not only can he not declare bankruptcy, but they will be charging him with a felony.

He may or may not. If he committed fraud he could owe the entire amount not satisfied at the foreclosure.

In a normal foreclosure, the lender would bid the entire loan balance so there would be no deficiency.

Casey's problem will be his tax liability as he will receive 1099's for the amount paid at the foreclosure sale. He will owe taxes on these amounts to the IRS.

That's pretty general but I hope it helps.

It depends on how the lender elects to pursue the foreclosure action.

If they accept a deed-in-lieu of foreclosure (what Looser Boy tried to do with Dallas at the 11th hour), then the bank takes deed of the house and essentially agrees to seek no future judgment.

If they pursue judicial foreclosure, then they can still go after the person after the foreclosure process ends. This very seldom happens because the process is fairly involved and costly. And if the debtor is insolvent (as is often the case), its uncertain whether a judgment will yield enough to cover the costs of pursuing it.

Non-judicial foreclosure is more common and probably the route that Looser Boy's creditors will take. It varies by state, but in most places a creditor cannot go after their debtor for any losses arising from the balance owed exceeding the amount recovered via the auction or REO sale. But they generally have greater ability to recover other costs, such as having to pay for insurance because a certain deadbeat fails to honor the terms of his mortgage.

jeez, he's really up shit creek. I just can't understand why he didn't elect something a LITTLE simpler to get rich quick. I had an extra 1K last year so I decided to research some stocks and ended up putting it all in one that's made me an 80% return this year.

Okay, back on track. California os a single recourse Stte. That means either reposess or pursue for the loan amount but not both. Casey is conting on thise but there's a catch. All that protection goes out the window when there is fraud. All that crap about intending to occupy doesn't matter as his not occupying violatesd the terms. The bank will sell for what they can get and go after Casey for the costs and the balance.

There are 2 types of foreclosures.

Judicial and Trust deed foreclosure.

When a lender does a Judicial Foreclosure (takes forever in californication)..then they can come after you for a deficiency judgement IE you owe 300k the home sold for 200k..you are on the hook for 100k.

Since this foreclosure takes time and money money money and if someone is smart they can drag out legal wranglings for YEARS..they invented another type of foreclosure.

The trust deed foreclosure.

See when you sign the Mortgage (promissory/iou note) that debt instrument is secured by a trust deed.

Think of it as your car title...the person you borrowed the money is the lien holder and you secure the loan with the car.

So you have the mortgage note secured by the title(trust deed).

Now they can give it to a 3rd party (a trustee) to faciliate a much shorter time to reposess their collateral (the car)

It saves them thousands of dollars and down time.

Now what did they have to give up to have this shortened time to get their collateral...

Yep you guessed it...they forego the right for a deficiency judgement. IE you owe 300k ..the house sells at the auction for 200k.....they cannot come after you for the 100k.

Now lenders get punished for foreclosing (please research trickle down economics--I dont have enough time to explain it to you). This hampers their ability to lend money also because the Federal reserve requirements dictate many things including penalties for non performing loans, and you guessed it ...fucking with the american dream of homeownership. (go research it...too many to list here)

Now what casey did with the countrywide financial note when he signed was move the debt from their Non performing loan column to basically an unsecured promissory note column....they dont get penalized for taking a big hit on their mortgage column. Good for them, smart business move..dumb for casey..very very dumb.

Now the way casey is working it is with shortsales...when you do a shortsale then the lenders cant come after you for the difference of what they take and what you owe....

But the amount of the debt they forgive ...IE 300k you owe 200k sale...the 100k forgiven in the debt is reported to the IRS per IRS guidelines as INCOME and you get taxed on that.

Uncle sam has to have his hand in every pie.

And most stockbrokers won't give cash back after you buy a stock.

@jade ....lots of people choose real estate...like any business it take dedication, perservation, and downright hard work to make a go of it. Most people are not cut out for it like the carleton sheet snake oil sellers would have people believe.

They attract lazy people like casey that think with minimal work you can escape to easy days with a cold corona in your hand.

I have known people that were heads and shoulders over casey lose (casey speak "loose") their shirts, homes, and families over real estate.

and I have known people that understand the art of the deal and make millions. (they dont talk to me anymore--I am poor j/k)

And I have known people that were dumber than casey but understood ....hirer smarter people than myself to do it...and they make it work.

Hell I am lazy..I admit it.

I have enough knowledge in my head about just about every avenue in real estate to write a damn book or 5.

But it is hard for me to stay motivated...I still work a job..I know I could make more money just doing rei full time in ANY MARKET.

But working my job is what keeps me motivated to do deals and organize what time I do have.....when I did R/E fulltime a few years back...I slept until noon and eventually did jack squat.

I realized I neeeeeeeeeeed that paying job to stay focused. I dont know call me stupid I guess.

good news is I just saved a bunch of money by switching to geico (og is their salesman of the year you know)

No you dont get 1099'ed to the IRS for foreclosures UNLESS the home sells at auction for more than what is owed on it. This money goes to You..then you get 1099'ed on it.

The 1099 you are thinking of is for Shortsales.

Well, I work 50 hours a week so I'm not TOO lazy but I'm well aware I'd rather spend my non-working hours doing things I enjoy, like riding my bike and traveling, than fixing up real estate. I'm trying to work on my own house, and that's enough to keep me pretty occupied! I have no idea how someone could do several at the same time.

Casey just has no self awareness. He doesn't realize how lazy he is. And he STILL has no idea what he'd do with his millions even if he had them. He doesn't know why he wants to be rich or how it would change his life. He just knows it would mean he didn't have to work.

I love to do those things too.

I work 40-50 hours a week at my job also...but I start pretty damn early in the morning...so I limit myself to R/E related things to 4-6 hours per day. Because 3-4 days a week I see the kids and my afternoons are for them.

we love to go out hiking, camping, I'm not a big fisherman though--downright loathe it actually. We do all kinds of stuff.

Just in the last couple weeks I have really had to bare down and research a couple new avenues of real estate that I am not familiar with.

Its a short term 1 time charge as I like to think of it.

Just buckle down, get it done, fill in the missing information puzzle pieces in my head...then get it off my plate and out of my life.

But I like to multitask too...at work i get to listen to headphones...so guess what...i get paid to listen to R/E audio books....

Although I must say I cheated and have been listening to the green mile and dolores claybourne on audio tape this week.

Its only because I have so many damn paper books to read...

It's all dolphs fault for not being my plutonic sugar daddy.

yeah I'm gonna go with this - I prefer to be lazy. I'll stick with stocks since I seem to be reasonably decent at picking them and I'm nowhere near organized enough to handle real estate. Casey's story scared me away from all of that.

Of course if the DC market takes a big nosedive I MIGHT try to pick up an investment property in a few years, but not right now. Prices are still way too high. It killed me buying last year but it was the right time for me.

real estate and CC debt are two entirely different investment vehicles with two very distinct set of regulations and oversite.

I wouldnt know about this because I only have 1 credit card and have never had to offer a lump sum payment.

I keep it frozen in the freezer (I kid you not).....that way if I ever really want to buy something or use it for any reason..i will have to chip it out...by then the urge should have passed to use it.


I know years and years ago back in my younger days when I had to walk uphill to the mailbox in the snow both ways..i had a repo'd car.

I paid it off a few years later for 40 cents on the dollar and was never 1099'ed for the difference.

Funny story here....the car was a lemon..I didnt know jack about negotiation or nothing back then.

The salesman that sold it to me promised all kinds of stuff verbally but not in writing.

When the car went belly up...I went in to get my verbal promises fulfilled ..now keep in mind I had a very very very very very short fuse back then.

The guy said I never said that and so did his sales manager...who was there during the negotiating and heard him say all of it.

Suffice it to say....when I went back to force the issue..they renegged...I threw the keys to the car in the sales managers face and told them to take the car and shove it up their ass.

Then the salesman got huffy and grabbed my arm and tried to throw me out of the premises...

Wrong thing to do....dont ever put your hands on me (back then atleast...now I am just a big pussy---kids do that to you)..

SO I put him against the wall with my hand around his throat..the sales manager came over and grabbed me in a bear hug and pulled me off of him...well he got a couple punches in the face over that.

At this point someone called the police and I could hear them coming and that is what brang me back to reality. See there have been 3 or 4x's in my life that my vision litteraly turns to a red tint (it hasnt happened in almost 17 years now)....lets just say its not good to be on the receiving end of that red tint.

When I heard the sirens I snapped out of it and I was holding a chair over the salesmanager about to beat him with it.

Long story short....they decided not to press charges and I was told that if I ever go back there again I would be arrested for trespassing.

As you can see I hate thieves.....I come from a different time where someones handshake is what is needed to do business..and a man is only as good as his word.

Unfortunately now we live in a world where everything has to be in writing.

As to Aelfiscine's post, if Rob buys a domain space to park this blog at, he can easily program in a BB to the site.

I'd hope Rob consider it and I would be more than willing to contribute to the tip jar if it helps him defer costs.

One mega alternative to Casey's site might be better than a few.

I look at Iamnotfacingforeclosure and that guys does good work as well.

Be very, very clear here - you have very narrow, limited rights to reproduce them. The more I read of Flickr's terms of service, the more I think they're going to get hit with a huge copyright case one of these days. I won't go into it here, it's too long a topic.

He owns his pictures until he sells or releases the copyright.

Period.

Some of the older people here may remember "The Phil Silvers Show," often just called "Sgt. Bilko." This had a similar theme, where Bilko, who ran the motor pool on some Army base, was pulling some kind of scam. Which usually backfired on Bilko....

(And at around the same time, late 50s, was "The Life of Reilly," which had a similar theme about a slacker.)

"The Rockford Files," circa the mid-70s, often had con games and gullible fools as a theme. One of the characters, Angel, was always dreaming up some new get rich quick scheme.

And currently on t.v., "My Name is Earl" has some similar themes. (I suggested "My Name is Casey" on IAFF a few months back.)

I think the time may be ripe for a new show focusing on the Gen Y crowd, doing for them what "Friends" did for the Gen X cohort. I could speculate about what some of the themes might be, but when I last did so, some Gen Y folks here claimed I was hatin' on them.

There are a handful of real copyright lawyers in the United States, and all of them are up to their asses in real work. No-one has time for Casey and Cos. nonsense. Doubly so since the actual ownership of casey's 'intellectual' property is very much in doubt.

As for libel, that will never happen. There is no way that any lawyer would want to take casey as a client simply because the discovery process deep six the case - probably before any depositions even began.

I do think it is a bit crappy though that self confessed criminals want to hide behind the courts when it suits them.

The laws are clear here. If you do not register your copyright, damages are capped and therefore limited. In California, a blogger has added protections of privacy and right to free speech.

What is also being overlooked is neither Casey or his blogger adversaries are making money off of their websites. Where is the damage? In order for a judge to reward damages it would need to be shown what kind of impact an infringing blog would have on his revenues. What kind of damage is being done to Casey's website from opinions backed up by his public photos? None that I can see. A judge would take this into account and it may be a colossal waste of time to litigate.

1. Dolph, sorry to see your sight go - as a guy who works more than 50 hours a week to support my family, pure Casey-hate filled commentary fills me with that warm fuzzy feeling.

About your copyrights? Don't sweat it. In my former life, I used to work for one of the world's largest publishers of consumer magazines. Part of my job was poking around and looking for copyright infringements. We never intended to pursue action against anybody because the threat of action would make most everybody quiver with fear. The bottom line is, if you've removed the offending material, whatever the reason, it's over. He has neither the time nor resources to devote to a suit the first hearing judge would toss for its frivolity.

Second, I can't believe that this site got shaken so badly by somebody who was clearly either Casey himself or somebody close to him. When somebody appears THAT out of character it should be a red flag to each of us. Anyone who says Casey is stupid doesn't have it quite right. He may be dumb, but he's not stupid. A little well-placed trolling here (and much of it was two sided to incite 3rd party response - I've seen it for years on Stock message boards) drives traffic back to you-know where. DON'T BUY INTO IT PEOPLE! We need to protect this forum. Don't get sucked in. If someone insults you, let it slide.

Yes, Casey's posts are now in the whining about consequences stage. I see no information that would enlighten anyone about facing foreclosure; in fact, I haven't seen anything like that for months.

He's just showing us the succession of consequences caused by his monumental complacency.

My apologies to all, especially Rob and Mel (whomever she may be).

I lost my temper badly last night...perhaps after one too many scotches after dinner. For about 5-10 minutes I was in such a "seeing red" rage that I barely knew what I was typing.

My "Michael Richards" time passed and I just logged off and tried to calm down.

No excuse. And because there is no excuse, and because I have been letting myself get worked up too much over Casey, his blog, this blog, etc., I am "DONE WITH ALL THINGS CASEY."

P.S. I was only involved in the matter with Mel, and one comment to Dolph, but not in any of the other matters. I wasn't following what Dolph was saying about copyrighted images, so I had nothing to say on this.

P.P.S. And, yes, this is really me. It was not Casey who was "attempting to get Rob's blog moderated." At least not insofar as I can see. Whatever Casey has wrong with him, he doesn't seem to ever really get angry. Which may mean he'll last a lot longer than I do!

So, sorry folks. This'll be my last message here. It's been a wild ride, but I was taking the "repartee" (which I dislike in general) way too seriously.

And spending my time writing about Casey is not good for me, at any level.

Wow, I am absolutely stunned. There was no way that I would have thought that those posts last night could have come from the same Tim whom I've enjoyed reading for nearly half a year. I am just stunned and terribly, terribly disappointed. I was 100% certain that it had to be Casey or another troll posing as Tim.

Tim, I'll agree with you one last time: its probably best that you don't post here or IAFF ever again. In fact, I hope that you're not reading this. But if you are, please go get help. You are fortunate to have the time and resources to tackle anger/alcohol problems head on. Redirect the energy you've wasted on trying to help Casey out and work on your own shit.

How many times have any of us gotten mad and said things we didn't mean? Is this really enough grounds to suggest someone go to the FBI, or that they need to "go get help?" One moment of indiscretion shouldn't raise so many hackles.

Maybe it's the internet masks, but I think everyone needs to chill out and not take things so seriously. One mad post from TMBA doesn't mean he's honestly going to come around killing people.

I see what you're saying, and I agree that one person cannot be defined by one night of internet posting. At the same time, there's simply a line that you don't cross. And Tim went well past it.

And FWIW, reporting him to the FBI is farther than I would take it, personally. But if Mel feels that step is warranted, then that's her call. Anyone has the right at any time to utilize any and every resource to legally ensure his or her safety.

You're right. Sorry if I offended any women with this comment. But in a way it's true to the mark. (Va)G only seems to be a one-dimensional character, the high-maintenance type that is happy so long as the checks come rolling in. Is she really worthy of deeper analysis or can we keep it hateful?

Also the Tim Saga is really too much to handle! His posts were harsh as hell and an extreme example of how CS can get people to fly off the handle. Even the alpha particle physics types.
