The Case for Complicity

LossMitPro has suggested that Mrs. S not be included in this mess. The reasoning is sound that absent any evidence she could very well be a victim. Evidence:

The 11 credit cards in her name are maxed out.
Her name is on many of the loans.
Her name is or was on many of the deeds.
She is featured prominently in the fix'n'flip process right up until IAFF went live.
She lives in a community property State and has been attending finance classes off and on for 5 years.
"The $1000 Contract."

She knew, she benefited, she's liable. The plural of "anecdote" is not "data" but the sum total of all available information can be. The only scrap that says she is not involved is Casey. Like I said; s-crap. S for Serin.

Imparting the information, none. The "agenda" comment comes from offering to work pro-bono for a "stunning" woman. This may be from an honest belief that she is innocent of all this (check facts, she is not), but the tone suggets otherwise - others commented on this as well, specificaly the "if she were fat / ugly" comments and the "not letting you within 50 feet" comments.

If this was an honest desire to help, it was worded in a way I could only describe as "creepy".

I would love to see G's arrainment - but your honor, she can't be gulity, she's stunning! Her looks / personality have nothing to do with her guilt or innocence. We do not have all the facts, but we have enough - she is on title for at least the three CA properties and on the mortgage (in CA, that's mandatory). All properties listed as primary residence and all executed within a short time to hide the transactions from the other lenders. Casey has admitted to the morgage fraud on his site, Galina is equally guilty. Her best defence ("I didn't know") won't work - well established that ignorance of the law is not a valid defence.

Presumptions and impressions are two different things. A presumption of innoncence (until proven guilty) is established. An impression that someone is innocent has no legal standing.

That was my original point - You are not an attorney (and to be fair, you stated that - another poster misunderstood and credited you as one). Lawyers deal in facts, not in impressions. How you feel about a client does not get entered into the record. What your client did and said is.

If you have FACTS about the Serins, by all means, state them (ie. you can verify the credit card balances, verify toilet scrubbing, verify ANY item) - or (as Duane has done), provide information not previously available. I'd love to hear any factual information you have to offer.

Did she even know about the total magnitude of the debt? Casey says that he used her credit for fixing up the houses. As long as he continued to say that "itsallgood," make the minimum payments every month, and reassure her that everything would get paid in full as soon as the houses sold, she may not have panicked until her credit card debt approached about $30k. ($30k is about the amount he made on the first condo sale.)

Was she aware of the amount of debt in Casey's name? Given that their "no debt" agreement stipulates that he can't open more lines of credit without her knowledge, I'm guessing that he wasn't too forthcoming about the number of lines of credit he had, or the total amount he owed. He might have given her some vague handwaving estimates, or told her that he was able to meet the minimum payments, and blown off more detailed inquiries.

And since Casey was so disorganized that he needed months to assemble his bills to make the financial statement so he could estimate his debt, it's not as if that information was readily available to her. Many of his bills were being sent to the houses or to PO boxes rather than to Yulia's house - remember the picture he took of the overflowing mailbox at the house he hadn't visited in months? Even if she knew where to call, lenders wouldn't disclose balances or account numbers to a spouse who wasn't listed on the account.

Sure, maybe she should have pressed him harder to show where the money was flowing. Maybe he pulled cash advances and and let her believe they were legitimate income. Maybe he played the "Honey, don't you trust me?" card. Maybe he used the same stalling tactics that he brags about using with his other lenders.

It's possible that posting the screenshots of his bank account and/or his financial spreadsheet was the first clue she had that the debt was really out of control.

Everything you say could in fact be true, only Casey & Galina know for sure. I'm just saying there seems to be a vast incongruity between the person that LossMitPro portrays and the situation as we know it.

Any sane and rational person would pay closer attention to their finances. And my question pertains to when a sane and rational person would say enough is enough. For instance, lets say all the scenarios you've brought forth did exist. What would a sane and rational person's reaction have been once they did find out the entire story? I don't think it would have been, oh yeah lets continue down the same path for another 8 months or longer. Do you?

This blog and 90% of the posts at IAFF prove that point.

Well, this “gal” is the one scrubbing other people’s toilets to help make ends meet.

She is 'scrubbing' the toilets of a few family members so she can earn the money they are giving her and KC anyway. This is per KC's own words (if anyone believes those anymore). So it isn't like she is a REAL housekeeper working for Merry Maids or something. It is probably so she can keep her dignity in tact when asking for money. And, how much do you think she is earning under the table? Maybe a few hundred bucks a month, I doubt it even covers the Jamba Juice KC drinks.

Maybe she should work on Yulia's house a little. There is still garbage not taken out 25% of the time.

For the record, Galina is kind of hot, but nowhere near as hottt as the EN ladiez.

Then again based on the celibacy books in Casey's library photo, perhaps she's a chastity belter. That would explain why Casey told T that his huge debt hasn't affected things in the bedroom: there was never anything going on in there to begin with. (except napping)

So we're all under the impression this latest blog post is for real? Am I the only one who thinks it sounds like a sales letter for a clickbank e-book? I think Mr Serin's been reading up on web marketing. We've got a clear deadline in the sales pitch (5/25). He's appealing to fear (if he doesn't raise $1K by Friday, my daily soap opera blog will be cut off!). We've got a clear call to action. Oh, and the countdown is a nice touch too.

Me thinks the witness signatures were blotted out, not for privacy reasons, but so we couldn't find the names of people who could possibly confirm or deny this story.

Galina is pretty enough - not my type (I like bad-girl goth types or intelligent redheads), but she's attractive.

I'm a sucker for a sexy brain, so it's hard for me to judge - I live in California and I know CA is chock full of drop dead gorgeous women...but most of them don't interest me once they open their mouths.

I agree; any sane and rational person would be checking every credit card statement and bill closely, especially if her partner had lied about his financial situation in the past.

And, yes, a sane and rational person would find it a deal-breaker to learn the entire story.

Unfortunately, a person who sincerely believes that divorce is only permissible in case of adultery or abuse doesn't have a lot of bargaining power when she figures out that he's lied to her yet again. She can nag him, plead with him, deny him intimacy, get her family to help, go to marriage counseling - but if he knows that separation isn't an option for her, he doesn't have to cooperate.

I think it's plausible that it might have taken her eight months* to figure out that he's simply not afraid of her "consequences."

One could argue the plausibility of Galina being in the dark all the time, and finally getting up the courage to do something after 8 months. I just don't think it is probable. I'll go with Occam's Razor on this one.

More than likely they are two slovenly, self-entitled brats without any real moral compass to guide either of them. However, a part of me wishes Galina might be the innocent bystander. Because I hate to think of there actually being a woman who knows all of what Casey is and does, and not being thoroughly repulsed by it.

I really feel for her if she is indeed boxed in a relationship that she feels she can't escape. Married to a man, and I use that term loosely, she can't be proud of or trust. But I'm not buying a ticket to that movie...sorry.

Hence; the corporation (itself, for all intent and purpose) seeks engagement of criminal complaint(s) through Law Enforcement personnel.

Hard to say, and I’d be guessing with any express benchmark. Although, frankly, speaking strictly based on what I know thus far? I’d say Galina has been “concerned” about Casey’s spending and conduct for a long time, and went along hoping his actions would produce financial recovery results.

If you’ve never dealt personally with Casey, then you don’t realize how conceiving (sincerely committed to a course) he can be (hell-of-a-salesman, when he looks in the mirror). Ask Duane, who I am confident will agree.

Once again; the immediate above as to Galina is speculation on my part!

In any event, Double-O, I hear what you’re driving at but let’s look at the external factor (and I’m not defending Galina, just pointing out observations for sake of good conversation). People facing foreclosure act differently than you or I, they DON’T act rationally more times than not. Please, take my word for the latter; I’m not simply justifying a position.

I can advise a client to do this or that (simply task, send in a payment(s) they have to lender, for example -- problem solved), they may commit to engaging it, and sure enough it won’t get done. If you’re not accustomed to dealing with people in these situations, I can see where you’d get the wrong impression. Yet folks under foreclosure threat often act like mental midgets, and I’ve dealt with some very intelligent folk who’ve fallen on hard times (Doctors, Engineers, CPA’s, etc.). Even the brightest of people seem to consistently act like their brain took a vacay. So that bears an aspect on my perspectives, yet I respect your well-thought opinions.

I once knew a "fallen" Mormon girl. Her husband was a slimy piece of crap who did nothing useful other than get her pregnant and saddle the two of them with debt. Eventually, I believe he went to jail for something or other leaving her with limited skills (fortunately she was pretty smart) and facing bankruptcy.

She divorced him when he went to jail and got custody of the kids.

Her "reward" for all this? Shunned by her whole family and most of her friends, who thought she should have stuck by him. Had to make it on her own.

I have no idea if Galina's background is quite as fucked up, but if it's anything similar, then she's completely and totally unprepared to face life on her own. Thus, Casey is able to take advantage of her.

And BTW, when things fell apart for my friend, she broke with EVERYTHING. Drank, smoked, did drugs, fucked everything that moved (male and female) and generally made up for the first 24 years of her life. Eventually settled down and did OK, but it took a while.

Virtually all the hookers I know come from similar backgrounds.

If this marriage comes unglued (which I believe will only happen after Galina has to suffer a far more intense degree of pain), then watch out world, becasue the "new" G will be on the prowl!

Galina Serin is very much part of the fraud.

She appears on several public records transfering title to her husband. So she sign on those federal loan mortgage docs with false information. False because of the occupation disclosure.

Galina Serin is preasuring Casey to keep her out of the spotlight as she is now scare that she will probably end up in Jail along with her husband.
