Court Tomorrow


Relentless observes: ”court tommorrow right? you [LossMitPro] expect a TRO or just a schedule for the next hearing?”

LossMitPro replies: No TRO, I’m asking for an order shortening time that’s all. Cuts the 664 motion time from about 20 days to around 10 (or less), and is just an in-Chamber meeting. Not a real critical step in the judge’s decision process, but helps to cut time from Casey selling IAFF and jammin outta here with the money.

Let's get real here. Does anyone actually believe Casey is a flight risk? Come on. In fact this whole business is ridiculous. Either LMP wins his case or he doesn't. And for someone supposedly upset about having their identity splashed across the internet, LMP certainly seemed to be enjoying the on-going drama.

lmp got to do his business in public for once, "ripping throats out" in front of a live internet audience. why would casey not be a flight risk? can you see him at the airport with twenty thousand dollars in his hand, buying a ticket to New Zealand? come on, that's terribly easy to visualize. he made it so.

Hmm, let me think...I seem to recall that Casey flew/fled to the other side of the planet not so long ago, so unless someone has confiscated his passport, I'll admit to thinking it's a very real possibility. What makes you so sure he wouldn't be a flight risk? It's not as if he has much of a life here any more.

I dunno why Casey doesn't fold up and leave the country.. Uzbekistan may be nicer than SacTown this time of year..

Relax dog. The reason I ask is b/c I read that Marty is willing to walk away, of course, after being reimbursed for his expenses. Seems Mark doesn't like all the negative publicity. Seems like a valid question to ask. Marty is in it to make money. Mark says he is/was in it partially for altruistic reasons. Seems he is getting burned why not just walk away?Sorry for offending you Rob with my question for Mark.

Yeah the idea of Casey leaving seems over the top. Casey went to Australia to advertise his blog and maybe make some deals. Why would he come back? He heard about the lawsuit while he was there. If he was fleeing the US a lawsuit would just be another reason to not come back. I think the fact that he did come back is fodder for thinking he is not a flight risk.

John Hoarty is on the march, calls Serin articulate, says he fudged one-two loan applications. Ok, old article. But now John's taking a 15% commission on funds for Casey's "legal defense". Even if we want to help John Hoarty and Serin's legal position out, how do we know about the other 85%? But nobody is willing to take this fairly easy job at 0%, with transparency. Which is a little unfortunate. So an opportunistic Russian steps in for a fee.

Actually, John, there is no “case” to win or lose. The matter was settled by written agreement, plain and simple, no ifs ands or buts about it. But that’s for a judge to finally decide now; my opinion doesn’t matter much in that regard, only the court’s.

And I’m not enjoying the “drama” just the mentality that WANTS me to discuss details then takes pot shots when I do. It’s pretty funny from where I stand. First I’m a good guy, then I’m questionable, and then I’m picking on poor Snowflake, or I’m a “bully,” but wait... I’m a wanna-be lawyer who doesn’t know crap from crayons! Yeeeeah, that’s the ticket!

Do you see my point? Some folks are never satisfied with the truth, so they conjure things to replace the truth. They research my background, extrapolate bits and pieces, and think that’s the whole picture; leaping to outlandish conclusions. Sooooo, who is enjoying the “drama” again??

As for my identity? As I’ve said repeatedly, folks can justify actions to their heart’s content. But they cannot diminish the truth that I (me, Mark) have never exposed my full real identity, irrespective my involvement in a public debate. “Outting” a private person whose identity was not voluntarily rendered, regardless of their involvement in the public eye, is an invasion of privacy! This is why the REAL News media often obtain releases from man-on-the-street interviews, concerning matters of public controversy.

...HELLLOOOOO, knock on computer screen??? ;)

You and everyone else (myself included) who contributes on this and on other Casey-related boards. Again if you were concerned with keeping this mess out of the public eye you wouldn't be blabbing on talk cast or the internet. You'd simply take care of the matter in court privately but hey, where's the fun is that?

Unfortunately you’ve gotten stuck with our tar baby Casey and I can’t see anyone eager to do business with you after listening to your outburst (talk cast) or reading many of the comments. In fact you (and Duane) have actually accomplished the impossible: Which is turning Casey into a somewhat sympathetic character.

Important point in general: the players in the game chose to become involved. They chose to continue to be involved. And they choose their level of involvement in the community. They are all getting something out of it -- if they weren't, they would take Nigel's approach and disengage.

Mark's involvement plays to his sense of self-importance.

Duane is emotionally involved -- no prurient slurs intended, but he clearly sees Galina as the victim and feels a duty to rescue her from Casey's damage. I don't think he will be able to walk away. And besides that, he clearly enjoys the community.

The answer to your question is simple enough, after the fact. Way after the fact.

The FACT is that Mark posted his real identity way back in about 2000 or even further when he ran a site called CreditDefenses.com with his full name disclosed in the FAQ and postings on the creditnet.com forums signing off every post with:

Although, one could obviously distinguish that that was a long time ago and on a different board and the question of legality here is tied to the current "outing" of the real personal life information of the person known as LossMitPro. But we have already establish WHO it was that outed LMP.

The question I have to ask, is what, if any rights a person really has as far has personal privacy if they willfully choose to:

1) post on the internet (EN does not have a privacy statement - neither does Casey/IAFF for that matter))
2) deal with an individual who is in the public eye (to my knowledge, Casey and Mark have NEVER signed a confidentially agreement)
3) enforce privacy concerns after a considerable about of time in which your information has been "outed" and displayed on the internet with your knowledge without protest/action on your part

Mark, please feel free to explain your rights, without dropping a ton of California Code Sections and actual court cases. It's not like anyone is going to actually review them.

That's the bit that just doesnt add up for me. You seemingly collect your 15 minutes of fame with relish but begrudge the public profile. I didnt think you could have one without the other so I'm interested in your view on this.

But it's fun to check his cites - they are wildly off and show why a real lawyer does not use Google to find case law.

His statements of law are even more fun - "Fair Use" requires permission from the author, my "REAL NAME" is mine so you can't use it... The list goes on.

Let him rant. The more he writes, the less credibility he has. Tryign to salvage his rep by putting MORE silly statements on the web is a great move (try Googling his name and see what you get - nice rep).

Now try Googling his company - I'm sure his boss must be REALLY pleased with what comes up. I know if I was looing at their company and saw that, I certainly would not want to do business with them.

He'd piss through that in about three months and he'd be stuck. It is VERY unlikely that he'd be comfortable (or even welcome) in a country with no extradition treaty (there are only a few)...

CS could TRY to run, but he'd fail at that too. Personally, I don't think he has it in him to even try.

He won't pay debts with the money (he'll blow it on something shiney), but he won't run.

Yeah, that was me. I didn't have really anything to ask Mark (I wanted to talk about the problems over on CHC), so that was the only thing that popped into my head to ask. It probably sounded pretty silly.

I wouldn't take time off from work to go to any of Mark's hearings, I don't think. I might be tempted to attend some of his criminal trial proceedings if it wasn't too inconvenient. It really depends on how busy I am at work.

The past few weeks have been really slow, so I could conceivably slip away for a few hours and run down to the courthouse without missing anything all that import here.

But for $500, I'd consider make a special trip to take his pictures. But $100 is just not enough an incentive. :)
