Courting Disaster


Keep in mind nothing is likely to happen today. The direction and extent of what will happen will be set in motion today. The outcome is unimportant. The court proceedings at 50 cents per page is what is important as those pages are eagerly awaited by uncounted numbers of others with material documanted losses.

I was just thinking about one of the fraudulent inducement of employment cases I read about when I googled that phrase. This case was not successful because the plaintiff didn't totally believe the promise that had been made in the first place (how that was revealed wasn't stated).

I was thinking, the judge or Casey's side just has to show a reasonable person would have known or should have known that Casey's promises were not to be relied upon, which I think can easily be proven by posts at IAFF and EN.

I do realize that's not the kind of defense one wants to put up -- "Your honor, everyone knows I can't be trusted!" Still, the more I think about Mark's case, the flimsier it seems.

I haven't commented on the merits because I'm not qualified and more important, I don't care. Casey plus court plus a transcript equals a packet that every lender will be unable to ignore. Somebody is going to wave a sheaf of papers at every shareholders meeting demanding satisfaction. No, not Casey but when your dividend is suspended you use the Casey's to hold management responsible.

I don't think Impac was one of Snowflake's lenders. But the somebody should have to answer to shareholders for financing so many bad loans.

In one of the fraudcasts, Casey mentioned that part of Mark's plan to settle with lenders was for Casey to go to court and tell the court he was incapable of handling his own finances, and then request the court to appoint someone to handle his finances for him... perhaps Mark himself?

Anyway, I don't know about you but I'd never continue listenning to someone who wants me to declare myself incompetent in court, whether or not I could be incompetent. That would be with you for the rest of your life, rendering you de-facto unable to get employment. Not that Casey wants to work, but just to show you that Mark's plan was pretty stupid to begin with.

Mark's plan might have included some items here and there that no reasonable person would agree to. Casey could argue Mark didn't tell him at the start of the relationship the extent of what Casey had to agree with to continue having Mark's pro-bono services.

I don't think Mark has a strong case. This is for Casey to screw up. Any half-decent lawyer can have that case thrown out in a minute.

If Mark loses and gets that on record, he did his job and should get a pat on the back no matter how anybody feels about him.

Just to be clear, Mark is NOT a lawyer, he is not admitted to any state's bar and he has not attended law school.

He has watched too many episodes of "LA Law" and "Law and Order".

A lawyer would have brought a much stronger case to the court.

Why does everyone assume Mark is going lose? This is what he does for a living...You think that he has never had to sue anyone before. He may not be a lawyer but I'm sure he is use to deadbeats that will not pay bills unless they are brought to court. It's also why he is bit of a hard-nose. Can we all just wait and see where the chips fall? Is that so hard to ask. If he loses, fine do your pee pee 2 year old dance. If he doesn't lose, who look stupid then...

Mark isn't a lawyer but he claims to be an officer of the court, and also says to have filed a plethora of lawsuits, which he has always won.

Mark has developed those "skills" of his in the process of being a collector. Isn't that what they do? They call debt beats and threaten with taking them to court, making them lose their jobs, etc. etc. if they don't pay. You need to know a few legal terms like "liable" to impress those debt beats into taking you seriously. Of course, if the legalize doesn't get blood out of the stone, then a "I'll go for your neck" might do the job.

There isn't an assumption of Mark losing it is just that in a wierd way everyone is on the same side. The people who don't like Mark and/or what he is doing are saying the suit is stupid. The people who are focused on the bigger picture say, "okay, and your point?" If Mark "wins" all the better, free vegatables with your sirloin.

I sure hope Mark's case sticks. My biggest fear is the judge throws it out as frivolous.

If (s)he does, that will be a huge win for the Casey camp -- it will reinforce his belief, as well as his supporters, that he didn't really do anything "that" bad.

It will make his crusade to start earning sweet passive income look like it's worth the effort. Teflon Serin!

In doing so, it will make a lot of the haters comments, research and anger look like a childish waste of time.

I really, really, really hope Mark's case sticks.

Was his "go for the throat" speech entertaining? Oh my yes. Have I been hooked into the whole saga, largely because of Mark? Indeed I have. Do I like asking myself questions? Clearly.

I reiterate: I will wager $50 against any of you fine ENers that Mark is going to lose this action.

I will wager $5 at 10 to 1 that the judge dismisses this today.

I will wager $1 at 100 to 1 that Mark is held in contempt of court.

To be clear: I have nothing against Mark. I don't "hate" anyone. But I just got some "sweet cash back" after financing the purchase of some mission-critical supplies, and now I would like to leverage that "income" vis-a-vis the risk-reward paradigm of gambling.

A compentent attorney would shut him down quickly. Since he is dealing with CS, he may actually win. What he will accomplish remains to be seen.

Mark is an internet bully. I've lost count of the number of people he has threatened to sue just here at EN.

His case v. CS is an abuse of the legal system (IMHO).

Actually, he negotiates with creditors on behalf of debtors for a living. He does not chase down debtors - he works for them.

He has sued before - once. He sued a non profit organization.

our legal system is slanted towards favoring the defendant. so slight technical errors can supposedly 'free' someone of their crimes. might happen today. might not. but today is only the start of casey's time in a courtroom.

There are no stupid questions. I don't know. I do know it is a lot. I know that much because I am sitting on a lot. Be careful however to not let expectations diminsh the value when finally revealed. For instance it seems pretty certain that the trip to Australia did not "make" $3000 as Casey claims. This is one of those unbelievable issues I have with his supporterz. How can you defend someone traipsing around in another country who then overdraws a joint checking account and leaves an abandonded spouse to come up with the cash to close the account? And then the little turd claims that overdraft as making money?

I beg to disagree. Anybody can suit anybody else in this country. Mark can suit me for sending $1 to Casey's Paypal account. The courts can be abused and are abused all the time. So, there is no win-win taking Casey to a courthouse.

As much as I dislike Casey's crimes and resent him getting away with it, truth is that a frivolous case thrown out of court will give even more notoriety to his story. Sweet free marketing for his upcoming book.

Headline: "Casey, the 'most hated blogger in the world' had a frivolous lawsuit filed by one of his former business associates thrown out of court. The former associate, who claimed to be an officer of the court, also threaten Casey in a public webcast with going for his throat." Heck, we could even see a crappy TV movie about it.

It can give some validity to the fallacy that Casey is just a stupid and gaullible kid instead of a rotten crook.

Casey is a perfect example of your point. He dodges and weaves and avoids any criminal prosecution repeatedly and with total ease.

He HAS broken the law and basically admits as much. Most criminals will lay low to avoid extra attention, but Casey is out there thumbing his nose at EVERYONE.

His blog is one way of being a public figure, but how many radio interviews has he done? How many articles have been written about him? How many people have threatened to sue him or have the authorities throw him in jail? How many creditors have begged for money only to (seemingly) just give up?

He's not laying low, he committed crimes and still runs around the country and world willy nilly.

Also - Are you at liberty to say if this is all the family has signed for? Is anyone else on the hook (and, if so, how much)?

A response would be apprieciated, even if it is "I don't know" or "I can't say at this time".

I understand the intent Mark has with the case. It's not much that he personally cares to win the case; he just wants Casey to be forced to expose his fraudulant activities.

If the judge gives approval for the case to move forward, Mark (and everyone else who wants to see Casey finally held accountable for his actions) will get his wish - Casey will be on record admitting to his crimes.

It just seems that Mark's case is too much of a reach at this point, too easy for the judge to dismiss.

After all of the recent threats by LMP, having the case tossed out will be a big blow to the haters - and HUGE win for Casey.

If it gets tossed, it may scare off other potential litigation efforts. Even with all the info that's available for use, it still wasn't enough for Mark's case. I'm not sure anyone else will want to spend the time trying to build and even stronger case.

One consequence of Casey "winning" very well might be newspapers asking the losing side all kinds of questions that DAs don't want to see on the front page. Mark has enough grounds to request a formal trial due to breach of contract.

Mark going off the handle has nothing to do with this case. This case is about breach of contract. No more, no less.

Once the judge gives the OK to proced with a trial, Discovery phase will set in and Casey's skeletons will POUR out like holloween on crack.

IANAL but here's my understanding:

What LMP is filing for today is an "ex parte" hearing. Basically, he's saying that an emergency situation exists that necessitates him "jumping the line" of regular litigation and getting fast action from a judge.

The judge may well say that no such emergency exists and deny the motion. that does NOT mean that the case is over, however. Having the ex parte motion denied is not proof that a 'normal' lawsuit will not succeeed.

Just something to keep in mind...

Why rush for an expeditious trial when there is a real risk it will get shot down, though?

Wouldn't he have been better served to file a "normal" lawsuit, one that is assured to hit the books, even if it wouldn't necessarily be heard immediately?

Maybe this will all be moot; per'aps the judge will approve the suit and allow it to move forward.

This needs to be handled in criminal court rather than civil. Sadly, that takes a long time. I suspect we'll see a perp walk, but it will be at least a year from now.

In the end, it was the IRS that got Al Capone... and CS is definitely on their radar. That will take even longer, but is more certain.

The above seems like your interpretation of what many of us are saying, however I do not feel it is accurate of our intent.

I personally believe that Marks actions are doing more to help Casey in that he can now point to any enemy and blame Mark and the rest of the haterz for his failures. "If only the haterz would have left me alone, I could have succeeded. If only Mark hadn't backstabbed me, I could have monetized the blog and published a bestseller, etc."

I think these actions against Casey actually serve to strengthen his perception of the victim role.

I don't agree with what I have seen of this legal strategy for several reasons. It seems as though he has gone about this in a careless manner. For the most part Casey has admitted what he has done ( although he is so deluded he doesn't think he had criminal intent.) How certain is Mark that if by forcing LE hand, they do not also go after Galina. That is something that nobody really has control over, which in my opinion makes this a horrible gamble.

If this doesn't go down the way it is suppossed to then it gives Casey a "moral" victory that he will use to falsely build himself up with and further his delusion. At the worst, Mark could be opening himself up to countersuits that might end up putting sweet passive income into Casey's pocket.

I actually see all of this "interference" as enabling. The Serins and the Supras need to sort this all out and take care of their own damn mess if they ever want a chance at changing these dynamics. They need the opportunity to stand up to Casey from their own strength, from their own morals and from their own convictions. Thats how they will become strong, not from a group of total strangers on the internet fighting their fights and cleaning up their mess.( and it is their mess, even if Casey caused it). I understand getting reasonable help and support from the outside, but knights in shining armour won't really help this family or Casey in the long run. People need to create their own bottom if they want it to be useful as a guiding point in pulling themselves up.

On a personal note, I don't like Marks legal threatening to others and threats to sue anybody who donates to Casey, etc.. That's just not how this country works and I hold those freedoms and procedures higher than any contempt I hold for Casey.

I'm trying to play out the Casey-saga if he wins. The well for above-the-brow deals is dry. Therefore, I expect to see him run back to his NRU roots. However, that's the ideal situation. I rather expect him to begin visiting his supporterz on a more regular basis. I also expect to start hearing a string of complaints from them. Either odd credit reports, or being offered a chance to buy some shares of, "Hammar" or something similar.

Actually that's a thread in itself.

Marks thinking when he got involved with Casey was that casey was in a super duper deep hole. Because of this Mark could shave considerable debt off caseys ledger. Mark could show the lenders how much Casey owed to several lenders. then the lenders would be will to take an even bigger loss than if they were the only lender owed money (or one of a few). Mark thought he would come out looking like a knight in shining armor. Having gotten casey out of hundreds of thousands of debt. What great advertisment. win-win right. Problem was Mark underestimated kc big time. Who's to blame? we already know casey is a shit.

Mark didnt show much interest on the haterzcasts in the Marty side of the equation (but certainly enough to name him and his company in the suit).

It almost looked like the intent was to drive Marty and Casey apart (kick a support leg out, a good strategy). I think Casey even said that at one point.

Marty and Casey were already at odds from what some have said and the addition of a SEO and traffic guru in the santa-flipper list kinda shows that Marty may not be working with Casey anymore. (and Casey editing the book, if you had a monetary interest in that book would you let CASEY edit it? chances he ever actually finishes that???).

I think one of Marks intentions was to get Casey on record admitting to his "shady" dealings. Please note that Casey does not have to say a thing about Cashcall, the lair loans, missing payments, etc. because such things were done outside of any agreement with Mark. Regardless if Mark became aware of any "crimes" that Casey committed his bringing them up in court if not relevant to his complaint will be set aside. Casey can actually plead the 5th Amendment on such issues. And the Judge will actually/usually seek to prevent Casey from incriminating himself.

I, for one, am amazed that the Judge is entertaining this TRO. The fact that he (the judge) has scheduled a hearing to show cause is important and makes this a whole new ball game.

The burden of proof now shifts from LMP to FLIPTARD as to why a TRO should not be filed. Hence the "show cause" part, as in show the judge why this TRO should not be enacted...

Imagine Subpoenas Duces Tecum of all of the Lenders, Mortgage Brokers, Appraisers, player involved, and all of Snowflake's shady deal paperwork he must produce. Not to mention the depositions under oath.

I am kinda missing your huge victory. A judge turned Marks request for immediate relief down and allowed this to continue as a normal case, where both sides are allowed to present their sides of the story. Thats how things should work. Mark paid his money and he is gonna get his ride.

I am totally open to somebody explaining why Casey admitting these things in court is such an amazing breakthrough. Casey had been admitting at least 20 acts of fraud for some time now. In terms of having this case solely for having Casey admit this information in court seems like a waste. The most that this judge can do is to refer the information to the District Attorney of Sacramento to look at. A judge has no authority to tell a DA who or what cases to prosecute. I sent all of this information, including Caseys admissions on his website to the Sacramento DA in February 2007. From what I understand many others have too.

On the downside, Casey has until the 20th to refine his story, refine his crimes and most importantly continue with his blog with all of this wonderful renewed interest because of all the electricity this court case generates. More hits, more revenue, more new visitors and suckers to his blog, where he will be sure to spin this into his favor.

For Christ sakes, he was about to whither on the vine and die, three weeks ago. Now he has the attention he so desperately seeks and needs.

I will give Mark huge levels of respect for keeping his mouth closed for the past few days, especially with two or three boards running with this story and commenting on him and this case.

He got access to his ex-wife's veterinary record...(case set precedent in Florida,BTW)...and it cost her 12.5k of that 25k to fight.

The best part...he got her boyfriend ,(A Hepatitis-laden convict meatbag),violated on his parole, and sent back to the Florida Man-Pound,where he died of liver failure in the prison hospital six short weeks later.

They cremated Lover-bag, and mailed his ashes home to his Mommy.

From what I hear,the scattering was even FUNNIER than the Big Lebowski finale.

Its both.

Within a TRO, the person filing has to show cause within the filing itself or it will be summarily turned down. You can't file a TRO to the effect that you want it against this defendant and then hope to present in court. Most of your presentation will be in the filing. The TRO is a summary action. The fact that it is going for another day and wasn't immediately turned down by the judge seems to indicate that the judge feels that there may be some merit to the TRO. This means the next step is Casey's. Continuance is to a date shortly later (10 business days). This indicates that it did not go to normal trail procedures. The TRO did jump the clock (so far).

I suspect that Casey, if he did go, went in typically unprepared, clueless.. maybe tried to spout some shit. Judge asked if Casey was prepared (knowing Casey... NOT) Judge then grants a continuance for Casey to get prepared and suggests that Casey gets representation.

I suspect what will happen in the future.. are a few more continuances because Casey is not prepared.. and by then the Judge will have had it (Judges don't like ignore mode).

I have had to email Rob on some things where other people were copied on. I have emailed Sharky where other people were copied on... there is no secret club.. there is no secret handshake.. and there is no information only passed to a select few.

I have seen this phrase used by RBoy more than once. And let me say on the record I like RBoy. And I am not trying to throw him under the bus, I just see him using this phrase more than anyone else and its wrong.

I am sorry that I have had to go silent, I know it pleases many, and its tough for me to do. I have made many wonderful internet friends, and I will pop in here when I can.

I know the teases thing got to people. But let me say this... if I see something that I know..KNOW.. is factually incorrect, I felt I had to say something.. and to dissprove someone would mean compromising other things in which I had promised not to. Depending on what Casey posts I will then either confirm his announcement or if he weasels out with some other story and not the big thing that happened today I will just rip him a new one for sinking even lower than ever before. The court hearing was but a distraction. I'm not going to scoop him because in his current state he'd blame the wrong people and were I to break it before him he'd have a chance to spin things his way. No warning for him or free hints on how to explain things in their best light.

It seems to me that even if Mark wins, he loses. Let's say he wins the suit and Casey is ordered to pay him $10,000. How many times have you heard about a civil suit in which someone who is ordered to pay does not? Or cannot?

Also, Mark Villasenor's name will be forever tainted by this. Google his name and you come up with the Caseypedia entry and all sorts of ugliness.

I wouldn't do business with a fifty year old man who gets heavily involved in the real life equivalent of an internet flame war. Nevermind one who angrily threatens a 24 year old hippie with all the gravelly bravado of a WWF wrestler. It's pathetic.

1. Casey tells item 1 -> Confimation and discuss.
2. Casey tells item 2 -> De-spin for truth and discuss.
3. Casey punts -> Make it clear the truth will out.

Somebody -- eek, I think it was Rboy, not sure -- posted at CHC that Casey and Mittens met in chambers and were told to try and work it out between them; the 7/20 hearing is a follow-up of sorts. I'm paraphrasing so I hope I got the gist correct.

IAFF has been down for me for quite a while.
