May I Serve You Sir?
This will likely be the only Casey post of the day. Kvetch here and leave the other threads topical. [N.B. The timestamp has been hacked to reflect a later publish dat to keep this post at the top of the stack.]
You leave one 'wrapper' per day as a starter for all ongoing Caseychat, so the other threads can go back to pre-Casey topics, with no MurseBoi content?
Not making any comment or judgment about that tack, just trying to be sure I properly understand the intent, so I can comply.
I have been lax in enforcing topicality. My fault and I was just giving clarification. Of course anyone can post damn near anything they want anwhere they want but it isn't the best use of effort.
The one wrapper bit is just because today will likely be very quiet and there's no need to make the twice a day lurkers scroll through a half dozen threads.
Just management techniques, no policy changes are expected.
While this thread is fresh, I just want to give a huge and public THANK YOU for trying to be the ringmaster for this circus so far. It is clear a *lot* of folks are fraying at the edges, and I just want to say my earlier comments today in response to Duane were pretty harsh. As I have stated earlier on multiple occasions, I think he is a gentleman and a forthright individual.
I'm sorry there seems to be some elbowing around (this happens even to the best of friends and/or family on an extended road trip, you know. Tempers get short. People get annoyed. It passes.) but the focus we all have in common, I think, is that Casey is off t5he rails, and his exploits probably need to cost him, but for GAWDSAKES, he can't be allowed to gain and then continue his methods with impunity! If so, there is no justice.
Anyway, thanks again, and let's please not let some understandable road-weary crankiness throw us all into complete melt down.
I hope Casey and Galinas marraige can be salvaged. The airing of dirty laundry was pretty detrimental to that. But not as bad as Caseys actions. I am glad Duane will be keeping quiet about some of these things.

Immagine having me standing in front of your house 24 hours a day talking about how great your home is to everyone who passes by! Thats exactly what "Talking House" is. I will set you up with your own radio transmitter that will broadcast a pre-recorded message about your home for all who drive by to listen to on their car radio. Sounds grea doesn't it? Of course it does!
If I was a neighbor and he was messing with my radio reception I would kick his ass. Would be interesting to know what the FCC thinks about that method.
It's really deceptive advertisement here to say everybody passing by will hear it. I am sure you have to dial into a certain frequency to actually listen to the crap show and the range can't be more then a dozen feet, if even that.
But hey, he doesn't call his approach THE GUERRILLA MARKETING APPROACH for nothing. He just also markets the sellers guerrilla style :-)
Low power AM transmitter, has a range of perhaps 100 feet at most. Perfectly legal with FCC. Sign tells you to tune to a frequency, typically an unused one in that area. No problems there, except of course it presumes buyers are out driving around eagerly looking for places to buy, which is not the case right now.
I think we all are fraying. It's been an emotional weekend. While I may not post as often as I used to, I do plan to keep posting observations. I just won't waste time debating people who have made up their minds.

While I happen to think it is a harmless quirk, it is at least a little interesting that the behavior (and need to have it noticed) is in line with some complaints of the 'we are in the know/ you are out/ we will control the information flow' point of view.
In other words, we are who we are, and the very traits that may well endear us to some, can drive people crazy if taken in more than small doses over a long period of time.
I am sure I have my own peccadilloes, too...

Those were special cases. People have had legal unlicensed low power FM transmitters for their trunk CD players for over ten years and they've been interfering with each other for almost as long. With low power unlicensed transmitters, you have to accept some interference.
Now what I think is stupid... what dope would want to hear a recording babbling about the house on their AM radio when they could just read the same information on the flyer?

And what's happening now that both Mark and Duane have fallen silent? Are the sources also dried up? R-Boy suggests that the inner circle is still very active; is it more the case that we're in a period of wait-and-see retrenchment?
I know, I know, I'm soliciting a "good things are coming" teaser; but I'm more interested in whether there are still "good things" on the menu.
And FWIW, I understand, and appreciate, that your hands are somewhat tied by the need to protect sources' privacy. I think many haven't acknowledged that you guys are treading a difficult path with considerable integrity; and that you're much closer to the real human cost of the whole sorry saga than us outsiders.

mejustme, Lots of people follow San Diego. It has lots of leading indicator tpye characteristics. Jim The Realtor at bubbleinfo.com is a great first place to stop. Then Piggington and others.
SD is in quiet desperation mode. The spring selling/buying season did not appear. Those that need to sell are stuck and every month that goes by is one payment less in their pockets. Banks are going to own a lot of real estate.
Opps. I saw that you mentioned it was $10,000. Did I read that wrong? What was the $10,000 for? Why did LossMitPro repeatedly say that he was doing it for free?
LMP was doing it for free. The $10k quote is what he normally would have charged someone with eight properties in default.
Depending on what written contract they have (or rather, had), it will be interesting to see how this plays out in court. If it was strictly pro-bono, LMP will lose. If there was more written in there, he may prevail... hard to guess without seeing the contract.
If it wasn't written, all bets are off (hard to prove it wasn't pro-bono).

As I understand it: Mark was doing $10K's worth of work for Casey, for free, as long as Casey met certain conditions. Casey failed to meet the conditions. Mark sees this as "fraudulent inducement" -- ie, Casey misled him in his unpaid employment by promising one thing but delivering another.
But it's all couched in legal saber-rattling, bluffing, and feinting that makes it hard to see what the real meat of the complaint is.
Just playing armchair judge here, but I don't think that fraudulent inducement has merit.
I posted on IAFF about how I googled "fraudulent inducement of employment" and the examples that came up were all about actual employment -- somebody got hired in a looser™ W2 job under false pretenses, worked there for a few years until they realized the promises were never going to be kept, and resultantly their career suffered setbacks. There weren't any cases of someone losing a few weeks of their time.
Maybe there are cases of somebody fraudulently induced to do work for someone pro bono, but I didn't find any.
I'm curious if there are precedents for anyone doing pro bono work suing the person for monetary damages. I mean, I'm sure there've been many lawyers who took on cases believing someone was innocent or given a bad deal, then made to look the fool when their client does something stupid.
It seems to me unless Mittens had in writing upfront, "Casey will do X or he will have to repay me for my time I'm offering pro bono," he's basically sounding like an Indian giver.
Keep this in mind folks, Mark no doubt knows Casey does NOT HAVE one dime to his name (dirty pennies, maybe or $7500 to be exact) to fight this as well as pay a judgement. He also needs to attach a dollar amount to file the suit, am I not wrong?

I agree with your analysis. And I still don't see how LMP has any basis for the equitable relief. And though I think he has a better shot with his "liable" claims, he still has to prove actual damages ... i.e. that someone decided not to hire him because of something Casey and/or Mocha said.
I agree that LMP is trying to get CS on record, I just think his execution has been terrible.
As much as I'd like to see CS nailed to the wall, this case is not likely to do it... and could hand CS a "win" that he'll hold up to the world to say "look, the haterz are wrong, I won!!!".
CS -NEVER- offered to pay LiMP $10k, Mark himself admits this. LiMP will have a hard time establishing damages.
The libel claims... hard to say without seeing what specifically LiMP is claiming. He will have to show specific statements by CS that damage his reputation (and his own comments to CS do NOT help him). Internet name calling does not qualify, especially since Mark was throwing names back.
Even if that stands, establishing damages will be difficult at best.

FWIW, I briefly described Lost Mitten's case to my father, who is a retired corporate attorney who handled some employment law matters back in the day and who did some pro bono work from time-to-time. He wasn't aware off the top of his head of any precedent, but said that he didn't think much of the case as I described it (with the caveat that he'd need to review the actual complaint to reach a more informed opinion, which he had no interest in doing).
My guess would be that LMP's case gets ultimately gets dismissed because of some procedural misstep (an almost inevitable fate when an amateur attempts to litigate). But from how LMP has summarized his case on these boards and the podcasts, it doesn't seem like there's a good deal of merit to it. YMMV.

Again, nice concept, poor execution. CS needs to be in criminal court, not civil. Not something LiMP can do.

I do understand the whole "get him in court to get all this on record" stuff, but everyone can't file frivolous lawsuits just to get the defendant's naughty deeds on record. Someone here or on IAFF brought that up to Mittens, that you can't use the legal system that way; one must have a real case, and Mittens did say he understood that and (he feels) he has a case.

I think both he and CS look more like third graders on the playground ready to fight - both hoping the other backs down first and afraid to back down themselves because everyone is watching.

That would be a fantastic outcome... but it won't happen. Mark would have to win, not something that will happen immediately (CS / IAFF will be long gone before this case completes with a judgement for).
Mark would also have to show damages - and CS has had offers for the site in excess of what LiMP is suing for... so he would not get sole ownership regardless.
Would it go to a third party? Unlikely. If you sue a business and win, you don't get to seize the business - you just get to -TRY- to collect the money from them.
From Casey's last fradcast, LossMitPro pretty much explained his stance with the law suit.
He said that he and Casey entered into a legal contract to help Casey for free by which Casey then sabbotagaged all of LossMitPro work.
That's breach of contract and LossMitPro has grounds for suing and winning.
What is going to bite Casey hard, is that should Casey argues ANY of LossMitPro acussations, he will open Casey to fraud charges. If Casey says nothing, he loses the case. So Casey is screwed either way.
Casey will be screwed the second he enters a court room. If Casey avoids the law suit, then LossMitPro wins and will be able to after Casey full force.
The last thing a Judge will want to hear are things like "shady" and "everyone was doing it" - that is like a HARD slap on any judge (they heard it once too many).
Like any law suit, everything comes out. It will start as a simple breach of contract law suit and quickly expand into the multiple properties Casey bought and that will open Casey up for full discovery of the evidence which Lenders of Casey can use.
What I meant to say is that Mark cannot legally disclosed what he knows, but this suit can open Casey up for "discovery" and that will open the can of worms.
Once the can of worms is open, others who "may have" been defrauded (ie Lenders) will be able to grab that data to go after Casey.
I think there is a bigger picture here being played out.
Think of this as Pandora's box. Mark is simply the opener - which is all it takes to get the ball rolling.
We should make this interesting and lay some bets on the outcome.
I'm willing to bet that the suit is either withdrawn by LMP at some point or gets dismissed because of procedural error by LMP. The latter becomes far more likely if/when Marty takes an active interest in the case and hires competent counsel to protect his interest in IAFF continuing to run. Although at this point, I'm not sure if he doesn't see Turdflake as a lost cause/sunk cost. He's got his $5k or whatever from Casey, so there's no need spending money trying to secure an extra couple hundred (possibly $1k) in extra profit from the "book" sales.

My sister was visiting for a week, and she actually tivo'ed that crap. Or maybe it was "So You Think You Can Dance". Whatever it was, it was atrocious.
Casey is a criminal. Mark wanted clicks. Mark got burned. Mark should cut his losses, lick his wounds and move on. Mark has only himself to blame for sullying his reputation. He had been warned that there was going to be trouble ahead. The haterz were right about that.

If either CS or Marty springs for a law-talking-guy, I'll bet quite a bit that Mark will be tossed out in short order. If CS handles this by himself? Well... he'd be stupid.
So at long last I ran afoul of the infrastructure VERIZON has allowed to crumble in my region. Five days ago, a slight wind moved a rotten phone pole accross the street, the stress-relief doodad popped free of the pole itself, and the DSL/phone cable running to my house was sliced through by the sheet-metal edge of a junction box. Five days I had to wait for a repair truck, borrowing friends' bandwidth to deliver work and send business emails, but missing all optional fun news.
Damn. I hadn't even caught up with last week's Kasey Krap. The volume of EN posts since then is daunting. It's getting to be too much like work to follow this soap opera, and we all know work is bad.
Summary anywhere? Perhaps there is a weekly roundup at Caseypedia or elsewhere I do not know about.

I've been skimming hundreds of posts here and at IAFF. I'm not good at finding information at Caseypedia (is it just me?) and I don't feel like registering at Caseyhaterz. Thank goodness, because those sites would suck me in for a few more hours.
He needs to establish standing. His "liable" (his original statement) claim needs to have a victim. He will try to show that CS damaged the company's reputation. Also applies to his attempts to paint CS as a competitor - needs to have the company involved for this.

What is the case is:
a) a large number of people have moved over to caseyhaterz.com for discussion because the troll problems, and the inherent single-threadedness of the blog format, made discussion here increasingly difficult, and

Just wanted to agree with LM. I don't see an anti-EN slant at CHC at all, but rather a more diverse collection of opinions and a healthier venue for general discussion. I think anyone who honestly characterizes CHC as an anti-EN forum probably has an overexaggerated sense of EN's importance. This story was always bigger than Rob, Duane, Mark or even Casey.
I was already finding the linear format limiting, which is why I rarely posted except as part of running cast commentary. When the troll invasion hit, and the "good things are coming, no they're not" stuff started, I was beginning to look for the side door.
The only thing that happened here was that the story outgrew Rob/EN, just as it outgrew Casey/IAFF before it. Doesn't at all invalidate Rob's contribution, or make EN a worse place to visit. Personally, I have more reason to visit EN now that it's not trying to do both jobs.
FMW - for the record, I've always liked your comments, and I was waiting this weekend to see you show up at CHC. I'd love to see you consider dual residency. :)

My playful foreshadowing and subtext via imagery and entendre was a fun distraction but then some people developed a sense of entitlement. It started grating on them that other people might know things they did not. The answer was to pull the telegraphing and stop distributing info as soon as practical. Better? Worse? Not my call.
It was more the way you have said a few things and the "heres the casey topic with a fake timestamp for today so every other post doesnt end up about him".
I value keeping one's word (and not flat out making crap up) above pretty much everything, never had a problem with the baiting.
I can't speak for anyone else, but I never had an issue with foreshadowing and subtext. It was playful, smart and fun. You've done a good job with it, and your narrative's been a very welcome change from Casey's hamfisted "it's all good" dialogue.
The thing I hear people saying is that they were getting tired of reading previews for a show that didn't seem to be going on. We'd been hearing "you don't know the full story" from Casey for MONTHS, and now it seemed that everyone had begun doing it.
And not for bad reasons! LMP has a court date to think about, and neither Duane nor you want to inflict damage on innocents just to throw raw meat to the crowd. But where I sit anyway, I think a lot of the conflict would have been defused immediately by just saying, "No news today, will talk when something happens, nothing to see." Instead what people got was, "I got a big bucket of red meat here, and I'm JUST ABOUT to throw it out there, BUT WAIT.."
Regarding Duane leaving, I really do think he was a bit freaked out by 200 users and 1500 posts in 24 hours. He realized he'd become the voice in the whirlwind. I'd have freaked, too.

Contrary to my harsh feelings the other day, I'll still be here. Dawg has been with us since the beginning and he still has a lot to offer in this saga.

As for Mark, Serinjustice covers it better than I ever could. I think Mark has a good chance because (as Sharky is saying) Casey is a fuck up in the worst way. He can't follow through and has no concept of when to shut up.
He will lose this case either by screwing up or in the discovery phase. Regardless of how you feel about Mark, let's give him a chance here. What he is doing is much needed. The law won't do it, so let's hope Mark can.

Good analysis. Let's look at it this way -- we are a mob with finite mob-ergs. If those mobergs are deployed in scouring out info on MurseBoi because no data is on surface, that is fruitful.
Or, if we are here, listening to dissemination of info and participating in strategizing, decision making, interpretation of data, dispatching subgroups, that's pretty efficient.
But if those mobergs are used in guessing, jumping up to the hand that withdraws the toy every time it is teasingly proffered, then set to snarling on each other, well, that is no good, and those mobergs are wasted.
Worse, because the resources and attention are diverted, no NEW and unique routes of investigation or people in the know (contacts) are established. Does anyone believe that R,D,M are somehow the holy anointed troika?
So three bad things happen: Dissension in the ranks, waste of moberg energy, and no new routes of inquiry opened into the subject. Stagflation.
So what to Rob's ego and external claims was just a little funnery, IMHO, had nothing to do with the changing of the GROUP (it did not collectively or individually), it had to do with the changing of the culture of a small insider clique, and insularity that always flows from such apartness.

Where was this? I mentioned the $18K/month here. I did not see anything about Colorado. The $18K was service on all loans including mortgages. I need to go back on the numbers, update for accrued interest and adjust for foreclosed properties and estimated 1099s, followed by what the fed tax would be on that amount and what penalties might apply to not filing estimated tax payments. I would also need to start setting up a ongoing interest schedule on the due tax.

Correct. If you actually manage a few $18k/mo payments you are obviously more creditworthy in these circumstances. First, the penalties stop and a clever debtor can "parallel renegotiate" the rest. Suddenly $18k/mo loads become half that. All of a sudden you find yourself in a situation where a young hard working entrepeneur can work those two W-2 jobs and supplement the rest with success.
At that point even the taxes get easier. The IRS does not want to prosecute and certainly does not want prision. Both cost -money- and they don't cost they produce.

Casey had a spreadsheet up (finally put up after much prodding, poking and electric cattle prods). It sort of detailed his assets/debts. I sucked it into Excel and then did a quick column looking just at the interest rates and outstanding debts to find out what the monthly interest burn was. It came out to roughly $18K at the time.
I checked my stored link and it looks like it has been taken down (Part of Casey's history revision within his Reality-Distortion-Field™). I still have the Excel file though..
One thing that get me aback about Casey 'wayback' then, was that he calls himself a businessman and entrepreneur, but never ran a quick, back of the scratchpad, raw cash burn estimate.
It is so obvious and fundamental to any business that doing it goes without saying.
He is young and got himself over his head, so they feel sorry and try to help. (the young and got himself over his head is something he plays up a lot, his song on the violin so to say).
Another is reputation, exposure. If you can pull a debt loss mitigation of this size, you would get a good reputation and good exposure. This is kind of what LossMitPro was looking at. Casey would benefit and so would LMP. Needless to say, Casey would not go along with getting his affairs in order and was proverbially chasing the shiny object.
It was pre foreclosures. That is why I need to go back and estimate the banks loss, figure out what the 1099 would look like and then penalties the IRS/FTB would assess for not doing estimated tax payments on the amount.
BTW, many people assume that not having any money left/not debt/assets etc. would leave you free and clear of 1099s. The Dot-Com bust showed many people the errors of that assumption.
A 1099 is a capital gain/loss statement. Forgiveness on a loan is considered a short term capital gain and treated as income.

There were trolls that wanted to make light of something serious and try to get a response and there were some trolls that seemed to want to reduce the board to infighting amongst members so that traffic to the blog drops. This blog also had a sharp increase in trolls when the Casey-Marty team-up occurred. It is kind of ironic that any trolling actually helped increase this blogs 'view counts' because trolls were incessantly refreshing to find something to 'bark' at.

There was even someone who posted a list of 3 books you should read if you are serious about Real Estate investing (this person was successful). Total cost if buying was under $150, but you could read them at a public library. Much less than the $15K for some Guru's scaminar.

It is clear a *lot* of folks are fraying at the edges, and I just want to say my earlier comments today in response to Duane were pretty harsh. As I have stated earlier on multiple occasions, I think he is a gentleman and a forthright individual.
I'm sorry there seems to be some elbowing around (this happens even to the best of friends and/or family on an extended road trip, you know. Tempers get short. People get annoyed. It passes.) but the focus we all have in common, I think, is that Casey is off t5he rails, and his exploits probably need to cost him, but for GAWDSAKES, he can't be allowed to gain and then continue his methods with impunity! I think we all are fraying. It's been an emotional weekend. While I may not post as often as I used to, I do plan to keep posting observations. I just won't waste time debating people who have made up their minds.
Too much to do, too little time to do it I guess (for me that is).
Sweet, other realtors do this all the time in SoCal. If it was against the law, I would think the FCC would do something about it.

And, yes, Rob, although uncommented on at the time, your pic nuances were noted and appreciated when I originally heard of the suit.
While I happen to think it is a harmless quirk, it is at least a little interesting that the behavior (and need to have it noticed) is in line with some complaints of the 'we are in the know/ you are out/ we will control the information flow' point of view.
In other words, we are who we are, and the very traits that may well endear us to some, can drive people crazy if taken in more than small doses over a long period of time.
I am sure I have my own peccadilloes, too...

Those were special cases. People have had legal unlicensed low power FM transmitters for their trunk CD players for over ten years and they've been interfering with each other for almost as long. With low power unlicensed transmitters, you have to accept some interference.
Now what I think is stupid... what dope would want to hear a recording babbling about the house on their AM radio when they could just read the same information on the flyer?

I tend to agree. While I checked out caseyhaterz.com, I suspect I'll still be spending more of my time here. Generally I only use forums when I'm dealing with a technical problem I'm unable to solve, so perhaps it's a matter of association...

Lots of people follow San Diego. It has lots of leading indicator tpye characteristics. Jim The Realtor at bubbleinfo.com is a great first place to stop. Then Piggington and others.
SD is in quiet desperation mode. The spring selling/buying season did not appear. Those that need to sell are stuck and every month that goes by is one payment less in their pockets. Banks are going to own a lot of real estate.

LMP was doing it for free. The $10k quote is what he normally would have charged someone with eight properties in default.
Depending on what written contract they have (or rather, had), it will be interesting to see how this plays out in court. If it was strictly pro-bono, LMP will lose. If there was more written in there, he may prevail... hard to guess without seeing the contract.
If it wasn't written, all bets are off (hard to prove it wasn't pro-bono).

As I understand it: Mark was doing $10K's worth of work for Casey, for free, as long as Casey met certain conditions. Casey failed to meet the conditions. Mark sees this as "fraudulent inducement" -- ie, Casey misled him in his unpaid employment by promising one thing but delivering another.
But it's all couched in legal saber-rattling, bluffing, and feinting that makes it hard to see what the real meat of the complaint is.
I guess at this point it's all wait-and-see.

I posted on IAFF about how I googled "fraudulent inducement of employment" and the examples that came up were all about actual employment -- somebody got hired in a looser™ W2 job under false pretenses, worked there for a few years until they realized the promises were never going to be kept, and resultantly their career suffered setbacks. There weren't any cases of someone losing a few weeks of their time.
Maybe there are cases of somebody fraudulently induced to do work for someone pro bono, but I didn't find any.
I'm curious if there are precedents for anyone doing pro bono work suing the person for monetary damages. I mean, I'm sure there've been many lawyers who took on cases believing someone was innocent or given a bad deal, then made to look the fool when their client does something stupid.
It seems to me unless Mittens had in writing upfront, "Casey will do X or he will have to repay me for my time I'm offering pro bono," he's basically sounding like an Indian giver.

Keep this in mind folks, Mark no doubt knows Casey does NOT HAVE one dime to his name (dirty pennies, maybe or $7500 to be exact) to fight this as well as pay a judgement. He also needs to attach a dollar amount to file the suit, am I not wrong?

I agree with your analysis. And I still don't see how LMP has any basis for the equitable relief. And though I think he has a better shot with his "liable" claims, he still has to prove actual damages ... i.e. that someone decided not to hire him because of something Casey and/or Mocha said.

As much as I'd like to see CS nailed to the wall, this case is not likely to do it... and could hand CS a "win" that he'll hold up to the world to say "look, the haterz are wrong, I won!!!".
CS -NEVER- offered to pay LiMP $10k, Mark himself admits this. LiMP will have a hard time establishing damages.
The libel claims... hard to say without seeing what specifically LiMP is claiming. He will have to show specific statements by CS that damage his reputation (and his own comments to CS do NOT help him). Internet name calling does not qualify, especially since Mark was throwing names back.
Even if that stands, establishing damages will be difficult at best.

I had this friend who I did frequent road trips with in my twenties, and she would subject me to hours upon hours of Les Miz, Miss Saigon and Cats, and Phantom until I was practically clawing my way out of the car screaming for my life and sanity.

FWIW, I briefly described Lost Mitten's case to my father, who is a retired corporate attorney who handled some employment law matters back in the day and who did some pro bono work from time-to-time. He wasn't aware off the top of his head of any precedent, but said that he didn't think much of the case as I described it (with the caveat that he'd need to review the actual complaint to reach a more informed opinion, which he had no interest in doing).
My guess would be that LMP's case gets ultimately gets dismissed because of some procedural misstep (an almost inevitable fate when an amateur attempts to litigate). But from how LMP has summarized his case on these boards and the podcasts, it doesn't seem like there's a good deal of merit to it. YMMV.

Should all the stars align and LiMP is able to get CS on the stand, he will have to show the questions are relevant to his case... and then CS will simply stand behind the 5th amendment.
Again, nice concept, poor execution. CS needs to be in criminal court, not civil. Not something LiMP can do.
He can try to force CS to take down IAFF, block the sale of the book and stop the flow of funds to CS... but he doesn't have the case to warrant any of that.
I do understand the whole "get him in court to get all this on record" stuff, but everyone can't file frivolous lawsuits just to get the defendant's naughty deeds on record. Someone here or on IAFF brought that up to Mittens, that you can't use the legal system that way; one must have a real case, and Mittens did say he understood that and (he feels) he has a case.
I hope we'll get an update here from somebody about what happens tomorrow.

I hardly consider LiMP an Oracle, but if that's your view...
I think both he and CS look more like third graders on the playground ready to fight - both hoping the other backs down first and afraid to back down themselves because everyone is watching.
CS's "last chance mark" post from the other day (since removed) was classic.

That would be a fantastic outcome... but it won't happen. Mark would have to win, not something that will happen immediately (CS / IAFF will be long gone before this case completes with a judgement for).
Mark would also have to show damages - and CS has had offers for the site in excess of what LiMP is suing for... so he would not get sole ownership regardless.
Would it go to a third party? Unlikely. If you sue a business and win, you don't get to seize the business - you just get to -TRY- to collect the money from them.
From Casey's last fradcast, LossMitPro pretty much explained his stance with the law suit.
He said that he and Casey entered into a legal contract to help Casey for free by which Casey then sabbotagaged all of LossMitPro work.
That's breach of contract and LossMitPro has grounds for suing and winning.
What is going to bite Casey hard, is that should Casey argues ANY of LossMitPro acussations, he will open Casey to fraud charges. If Casey says nothing, he loses the case. So Casey is screwed either way.
Casey will be screwed the second he enters a court room. If Casey avoids the law suit, then LossMitPro wins and will be able to after Casey full force.
I forgot to add:
The last thing a Judge will want to hear are things like "shady" and "everyone was doing it" - that is like a HARD slap on any judge (they heard it once too many).
Like any law suit, everything comes out. It will start as a simple breach of contract law suit and quickly expand into the multiple properties Casey bought and that will open Casey up for full discovery of the evidence which Lenders of Casey can use.

None of the fraud is relevant to the case and will not be allowed in.

What I meant to say is that Mark cannot legally disclosed what he knows, but this suit can open Casey up for "discovery" and that will open the can of worms.
Once the can of worms is open, others who "may have" been defrauded (ie Lenders) will be able to grab that data to go after Casey.
I think there is a bigger picture here being played out.
Think of this as Pandora's box. Mark is simply the opener - which is all it takes to get the ball rolling.
We will see.

I'm willing to bet that the suit is either withdrawn by LMP at some point or gets dismissed because of procedural error by LMP. The latter becomes far more likely if/when Marty takes an active interest in the case and hires competent counsel to protect his interest in IAFF continuing to run. Although at this point, I'm not sure if he doesn't see Turdflake as a lost cause/sunk cost. He's got his $5k or whatever from Casey, so there's no need spending money trying to secure an extra couple hundred (possibly $1k) in extra profit from the "book" sales.

Casey is a criminal. Mark wanted clicks. Mark got burned. Mark should cut his losses, lick his wounds and move on. Mark has only himself to blame for sullying his reputation. He had been warned that there was going to be trouble ahead. The haterz were right about that.

A lawyer did not write that complaint. Mark wrote it and is representing himself (he has stated that several times).
So at long last I ran afoul of the infrastructure VERIZON has allowed to crumble in my region. Five days ago, a slight wind moved a rotten phone pole accross the street, the stress-relief doodad popped free of the pole itself, and the DSL/phone cable running to my house was sliced through by the sheet-metal edge of a junction box. Five days I had to wait for a repair truck, borrowing friends' bandwidth to deliver work and send business emails, but missing all optional fun news.
Damn. I hadn't even caught up with last week's Kasey Krap. The volume of EN posts since then is daunting. It's getting to be too much like work to follow this soap opera, and we all know work is bad.
Summary anywhere? Perhaps there is a weekly roundup at Caseypedia or elsewhere I do not know about.
And why did I have to activate a Blogger account to post here? Is that a new EN thing or a technical burp?

Not so -- please don't position caseyhaterz.com as opposing EN, that's really not the case.
What is the case is:
a) a large number of people have moved over to caseyhaterz.com for discussion because the troll problems, and the inherent single-threadedness of the blog format, made discussion here increasingly difficult, and
b) a number of users at caseyhaterz.com have expressed frustration with the slow release, and frequent teasing foreshadowing, of insider information at EN. The common complaint was this: if you can't release the information yet, please stop baiting with "good things are coming" and "if you only knew what I know" previews.
I don't see widespread opposition to EN in the forums at the moment. There was one active thread on "Info Teases", but that's largely died down; most of the discussion there is normal Casey business as usual talk.
EN is not being betrayed, Rob is not being backstabbed; it's just that the forums are a better place for the everyday Casey chitchat than Rob's comments.

Just wanted to agree with LM. I don't see an anti-EN slant at CHC at all, but rather a more diverse collection of opinions and a healthier venue for general discussion. I think anyone who honestly characterizes CHC as an anti-EN forum probably has an overexaggerated sense of EN's importance. This story was always bigger than Rob, Duane, Mark or even Casey.
I was already finding the linear format limiting, which is why I rarely posted except as part of running cast commentary. When the troll invasion hit, and the "good things are coming, no they're not" stuff started, I was beginning to look for the side door.
The only thing that happened here was that the story outgrew Rob/EN, just as it outgrew Casey/IAFF before it. Doesn't at all invalidate Rob's contribution, or make EN a worse place to visit. Personally, I have more reason to visit EN now that it's not trying to do both jobs.
FMW - for the record, I've always liked your comments, and I was waiting this weekend to see you show up at CHC. I'd love to see you consider dual residency. :)

My playful foreshadowing and subtext via imagery and entendre was a fun distraction but then some people developed a sense of entitlement. It started grating on them that other people might know things they did not. The answer was to pull the telegraphing and stop distributing info as soon as practical. Better? Worse? Not my call.
It was more the way you have said a few things and the "heres the casey topic with a fake timestamp for today so every other post doesnt end up about him".
I value keeping one's word (and not flat out making crap up) above pretty much everything, never had a problem with the baiting.

I can't speak for anyone else, but I never had an issue with foreshadowing and subtext. It was playful, smart and fun. You've done a good job with it, and your narrative's been a very welcome change from Casey's hamfisted "it's all good" dialogue.
The thing I hear people saying is that they were getting tired of reading previews for a show that didn't seem to be going on. We'd been hearing "you don't know the full story" from Casey for MONTHS, and now it seemed that everyone had begun doing it.
And not for bad reasons! LMP has a court date to think about, and neither Duane nor you want to inflict damage on innocents just to throw raw meat to the crowd. But where I sit anyway, I think a lot of the conflict would have been defused immediately by just saying, "No news today, will talk when something happens, nothing to see." Instead what people got was, "I got a big bucket of red meat here, and I'm JUST ABOUT to throw it out there, BUT WAIT.."
Regarding Duane leaving, I really do think he was a bit freaked out by 200 users and 1500 posts in 24 hours. He realized he'd become the voice in the whirlwind. I'd have freaked, too.
Rob, take CHC as a compliment. You stewarded the story from Casey's care to the next stage. And you've done a good job with it. Thanks.
Contrary to my harsh feelings the other day, I'll still be here. Dawg has been with us since the beginning and he still has a lot to offer in this saga.
I may post a little less, but if I see Casey doing something bad, I'll be here posting my observations.
As for Mark, Serinjustice covers it better than I ever could. I think Mark has a good chance because (as Sharky is saying) Casey is a fuck up in the worst way. He can't follow through and has no concept of when to shut up.
He will lose this case either by screwing up or in the discovery phase. Regardless of how you feel about Mark, let's give him a chance here. What he is doing is much needed. The law won't do it, so let's hope Mark can.

I think the realization of the degree some people were hoping for the train wreck to have a large number of explosive cars may have hit a nerve.
Plus he has supported LMP, so the voracity of how far under the bus some parties were throwing him probably didnt go over well.
But he does know the really dark interesting details that may prove key in waking Casey up/making him face consequences.

Rob and Duane are still very much part of the story -- as trusted gatekeepers of the sensitive inside info. (And "trusted" is deliberately double-edged there: I trust 'em to provide well-verified info, their sources trust 'em to carefully protect them.)
Hopefully caseyhaterz.com can help here -- by taking the routine chatter, the wolves howling for new information, and the trolls that feed on the disturbance off Rob's doorstep.

The forums were not created due to unhappiness with EN. We've been asking Rob for forums for several months now. He's been too busy to do it so The Dude took the initiative.

Where was this? I mentioned the $18K/month here. I did not see anything about Colorado. The $18K was service on all loans including mortgages. I need to go back on the numbers, update for accrued interest and adjust for foreclosed properties and estimated 1099s, followed by what the fed tax would be on that amount and what penalties might apply to not filing estimated tax payments. I would also need to start setting up a ongoing interest schedule on the due tax.

Correct. If you actually manage a few $18k/mo payments you are obviously more creditworthy in these circumstances. First, the penalties stop and a clever debtor can "parallel renegotiate" the rest. Suddenly $18k/mo loads become half that. All of a sudden you find yourself in a situation where a young hard working entrepeneur can work those two W-2 jobs and supplement the rest with success.
At that point even the taxes get easier. The IRS does not want to prosecute and certainly does not want prision. Both cost -money- and they don't cost they produce.

The board is going to take over on the saga. Rob has done an outstanding job and now this blog can get focused on the original intention. Sure the traffic will decrease substantially but thats not for us haterz to worry about. Thanks for everything Rob but I'm gonna be moving to the board. Once I stopped at a single-car crash...car ate a tree,tree ate the car.
Driver had at least a broken nose and missing teeth from eating the steering wheel or the dashboard, (these were the pre-airbag days).
He was also blotto...I could smell the booze-funk on him from 2 yards away.
I turned around, got back in my car, and drove off.
Did he live? Did he die?
I don't care...fuck him.
There's a difference between helping someone who's TRYING to stay afloat,and towing some worthless deadbeat across the ocean.
It bugs me that there are people who are far,FAR more worthy of help than this little reptile.
Think of some single mother busting her ass working two shit jobs AND trying to raise her kids up right.

The $18K/month is without penalties (since Casey's Reality-Distortion-Field™ was not being very open about such things, I couldn't include them.. maybe because the mail was not getting opened).
But you can renegotiate the rates down which would help considerably.
Even still, $0 to $392,727 is one heck of a bit of jump in income. He needed to shed debt quickly and pro actively way back when he started the blog. The biggest single $ burners were the houses. My last post over on IAFF was with respect to Buckaroo Banzai. I was tempted to call in on one of the fraudcasts™ and explain it but I would not be in the 'how do you feel about that' mood.

I dont know that we have an accurate picture of exactly how deep of a hold Casey is in, mostly because CASEY doesnt know how deep of a hole he's in. (but he promises to find out this week)
All the houses are gone so its just the credit debt and any residual from the foreclosures.
Well said Sharky. I don't understand why Rob is constantly defending Mark. Mark is clearly a bottom feeder just looking for some notoriety. I guess that the 25 drinks a day are affecting his reasoning. Hey Rob you better cut back or diabetes will surely creep up on you.

Casey had a spreadsheet up (finally put up after much prodding, poking and electric cattle prods). It sort of detailed his assets/debts. I sucked it into Excel and then did a quick column looking just at the interest rates and outstanding debts to find out what the monthly interest burn was. It came out to roughly $18K at the time.
I checked my stored link and it looks like it has been taken down (Part of Casey's history revision within his Reality-Distortion-Field™). I still have the Excel file though..
One thing that get me aback about Casey 'wayback' then, was that he calls himself a businessman and entrepreneur, but never ran a quick, back of the scratchpad, raw cash burn estimate.
It is so obvious and fundamental to any business that doing it goes without saying.
Why do people try to help Casey...ego and money.
If you are in a business that helps people like Casey and you can pull off a case THIS big...nothing but good for the ego and future press.
Trouble is Casey won't go along with the program as we all know.

yes I know about the spreadsheet, it was so far out of date it wasnt funny, its on his "todo list" to update it for this week (he says).
Pretty sure that was pre-foreclosures.
They try for many different reasons.
He is young and got himself over his head, so they feel sorry and try to help. (the young and got himself over his head is something he plays up a lot, his song on the violin so to say).
Another is reputation, exposure. If you can pull a debt loss mitigation of this size, you would get a good reputation and good exposure. This is kind of what LossMitPro was looking at. Casey would benefit and so would LMP. Needless to say, Casey would not go along with getting his affairs in order and was proverbially chasing the shiny object.

It was pre foreclosures. That is why I need to go back and estimate the banks loss, figure out what the 1099 would look like and then penalties the IRS/FTB would assess for not doing estimated tax payments on the amount.
BTW, many people assume that not having any money left/not debt/assets etc. would leave you free and clear of 1099s. The Dot-Com bust showed many people the errors of that assumption.
A 1099 is a capital gain/loss statement. Forgiveness on a loan is considered a short term capital gain and treated as income.

Just seemed like EN became more ego driven with some of the personalities, rather than just hate and make fun of casey driven. IMHO, that brought a lot of the trolls out.
I gotta go now.. but if Rob Dawg or any of the other Dog-pound members has time; it might be interesting to track down all of the foreclosed properties and identify what the bank offloaded them at by looking at the sale immediately after foreclosure. (sales history going back 1 to 2 years would allow me to find the bank's sale easily).
I think it might also be useful for Galina, etc to have an idea what the IRS might be looking at. It might also help Casey get a grasp on the size of what the the IRS's may be looking at, though I think it would not register with Casey. No longer his property, out of mind....

I can understand wanting to help KC. Now, in my mid-thirties, I'm a down-to-earth business owner. But I've always had the entrepreneurial dream, and in my early twenties, I was just like KC, just a little more realistic. I listened to the "Gurus" (but didn't spend thousands on them), I wanted to get into real estate (Bay Area late nineties - could have made some serious money, but realized that being highly leverages was extremely dangerous). There but for the Grace of God go I, you know?
It's too bad, for the poor little psychopath, because when he started the blog, he received advice that was priceless. It took me ten years of hard work to learn the lessons people offered to share with him. If KC only had it in him to take good advice, I think he might have been a good part of the way out of his financial trouble by now.

I would tend to disagree. Historically this place got the highest troll response when issues contradictory to the Casey Reality-Distortion-Field™ were brought to light. There was a slight delay and then suddenly the trolls. There were trolls that wanted to make light of something serious and try to get a response and there were some trolls that seemed to want to reduce the board to infighting amongst members so that traffic to the blog drops. This blog also had a sharp increase in trolls when the Casey-Marty team-up occurred. It is kind of ironic that any trolling actually helped increase this blogs 'view counts' because trolls were incessantly refreshing to find something to 'bark' at.
I found the trolls irritating but easy to deal with. Think 8 to 13yr old mentality with nothing better to do.

I noticed that too, and pointed it out to him on his blog. There was even someone who posted a list of 3 books you should read if you are serious about Real Estate investing (this person was successful). Total cost if buying was under $150, but you could read them at a public library. Much less than the $15K for some Guru's scaminar.

Perhaps so, But I suspect that good old common sense had as much to do with it,(another of those mundane miracles that makes all the diff).

You are absolutely correct. If I ever got in to troubles like Casey (no, i'm not that dumb), I would honestly be scared to death. I would be so grateful if someone like Duane came along and gave me a ray of sunshine and a way to get the hell out of the hole I was in. Casey is just wired wrong.
