Testing the Mettle
Today we start finding out just what kind of lawyer Pookie our Marshmallow has retained. All lawyers insist they do all the talking. Real lawyers follow through. Look, we all know Casey can't shut up. He's not wired that way. Today however his lawyer finds out what we've known all along. Legally Casey is his own worst enemy. Sure, sure Casey will go with the standard "Oh, you meant blogging too?" but it won't fly with a real lawyer. The worst casey (for Casey) is if the lawyer gets curious and reads EN or Caseypedia and finds out his client is pathological. But Casey is apparently persuasive in person so there is one worse scenario. Casey could convince the lawyer to enter into legal procedings that involve discovery. After all Casey has made the recent pilgrimage to NRU and "has his story straight" so there's nothing to fear from telling the "truth." Snigger.

Why doesn't everybody get this? Mark has already won. There is no "unwinning." An attempt at jdicial reversal is an even bigger win. Casey is getting out of this particular trouble on exceedingly generous terms. Any other outcome is worse.

Just catching up with things and some of what I was going to say has been overtaken by events. Anyway, here's my take FWIW:
Casey's Lawyer has $1500 up front, probably out of some corporate credit. He's read the details and suggested Casey settles. I give it about 2 weeks before Casey gets a letter along the lines of "you have ignored our professional advice....no longer think it is desirable for us to work together...."
Casey, or Prince Sadim as I will henceforth be referring to him, (I thought that was rather good - Supporterz (or Suckerz?) ask a grown up for an explanation) will find an excuse to re-start the blog before the end of August.

What are your thoughts on Casey's lawyer realizing after spending 2-3 hours listening to Casey's story and providing another hour or so of research and leg work to read the suits, saw his $1500 running out and decided a settlement was the only thing he could do? What if realistically, Casey has no more cash and the lawyer knows Casey is about tapped and decides that he knows court appearances and filings could soone put the lawyer on the other side of the table.

@LMP -- there was a rumor that the CHC shutdown was not due to bandwidth issues or a crappy webhost, but because you were none too happy about some of the commentary posted at CHC.
That seems unlikely, since the Google archive of the site is a string of "you must be logged in to view this page," but this being the Caseysphere, people will believe anything.

CH.C was the victim of massive growth. It grew faster and bigger than expected. The majority of hosting plans either sell bandwidth by 1-2 gigs/month (which for anything more than your family blog is nothing), or you pay out the rear for unlimited b/w.
There was nothing The Dude could have really done. I think the entire experience should humble some of the moderators that may have let their pseudo-power go to their heads a little. If not, so be it.
I'm sure TheDude will get the site either moved or up in the next day or so.

Nonetheless, I’ll go on record saying that the management of CHC and I are not only on GREAT terms, but I have no issue with how they’ve handle certain matter to date. Besides that, an ISP (which CHC is considered to be under law) can only be attacked legally when certain situations apply. And none of those issues arise from anything stated on the CHC site; not where I’m concerned anyway.

I've been around the block a few times, Broward. In fact, the least thing in the universe that I am concerned about is whether the moderators at CHC are "forgiving" or not. And so far you are the only one that has brought up hacking - has The Dude accused anyone of that, or are you just trying to get some attention for yourself?
Perhaps I can help:
1) Mark and Casey did NOT sign the agreement in the presence of a judge or master. The agreement was not provided to the Master at the time the adjournment was ordered.
2) TRO's are often ordered on an ex-parte basis because they are TEMPORARY until the respondent can provide materials to the court (within 20 days). Mark's TRO and immediate request for relief from the court was REFUSED and set over to the 20th for a judge to consider evidence from Casey. Mark's evidence (if you want to call it that) was not enough to convince anyone that he required an immediate order. I do believe if Serin appeared and filed a TRO with Mark's audio and statements that the Master/Judge would have granted Serin a TRO.
3) Mark failed to appear for his "urgent" motion requesting to move up the hearing. There does not appear to be any materials in the record to indicate that Mark has filed any further materials. He is wasting the courts time.
4) Mark was very quiet when it was a possibility that Serin was gaining support and could retain counsel. Stupidly, Serin did not at the time.
5) If Mark's agreement and motion/action was valid, he would not settle at this time.
6) Mark sued Marty. Mark must have consent from Marty to dismiss or settle his action against Marty. The court record does not show he received consent.
7) Mark has a significant history of posting on other blogs with his own name with the same sort of nonsense we've seen here. I don't believe he has any reputation that could be damaged by Serin - anyone with Google can view enough of his prior garbage "liable, whom, caselaw from WW II".
8) Mark has nothing to do with Serin's blog being pulled. It appears Serin is in much "other" trouble that will probably be discussed on his podcast tonight.

Nooooo, actually not. I’ve always enjoyed a good online relationship with those folks, and the removal of certain material was their choice. But here’s where lots of folk misunderstand, and that is Free Speech rights end when you register on a system like CHC. Users HAVE NO RIGHT TO SAY WHATEVER THEY WANT. A BBS management team can practice whatever censorship or restrictions they please. And that cannot and is not actionable, in any way shape or form!

Heck, you don't need to sue them to change pageranks, you can pay them and they'll be happy to oblige. You can pay them even more and they'll get you even beter results AND deny they are doing it. Besides, do you really think there is one google database? Does anyone here think a robots dot txt file stops engines from looking? You don't think it is necessary to mantain an unadulterated reference database before applying their "magic?"

CSL, at first I wondered why someone would continue to say the samething over and over again. Then it hit me, just like when I read the Davinchi Code, you have to look within the subtext. I realized your question was actually an anagram. "Why are you here" was actually you way of saying, "hey you rare hue". Hue...hue...what could that mean? Using my 3rd grade education (I'm still working on my Alabama Master's degree for grade 4), I google'd hue and got "make or shape as with an axe".

Nobody gets it because they are blinded by an irrational hatred of Mark. Funny, I don't remember Mark being the guy who bilked the system for 2.2 million. I especially don't remember Mark starting a blog to thumb his nose at the system while looking for more questionable deals.

If you're gonna pretend to be all computer-geeky, at least get your syntax right.
*.* - unnecessary on UNIX; * is what you need to get everything (files do not necessarily contain a period like in Windows/DOS)
/r - UNIX uses hyphens, not slashes for its command line switch. A slash indicates a directory. The way you gave it, the shell would simply try to delete a directory called "r" after it deleted all files with a period in them within the working directory.
Lastly, you got your order wrong: UNIX places switches/parameters before arguments, so * would go at the end, -r in the middle. Also, you probably would want to thrown an "f" in there too just for convenience.
So the final command would be rm -rf *
If you get this VERY basic stuff wrong, I have absolutely no confidence that you know anything about TCP/IP or "basic web app layers". In fact, I don't see how TCP/IP is related to this discussion at all, and also you betray that you don't know much about "basic web app layers" by thinking that Google would just be able to delete files on their servers to make references to Mark Villaseñor go away from their cached pages.

Yes, the backwash from CH.C was obvious, hopefully with that outlet restored we can resume the usual demeanor of EN. Have I got some masive dirt on the Riverpark project and their implosion! Goodness abounds for those with patience.
Regardless of how you feel about the major players in this lawsuit (Casey or LossMitPro), below are the facts that have been confirmed by more than one source:
1. The result of the first Ex Parte hearing was an agreement between Mark and Casey to settle the lawsuit.
2. The settlement was drawn up with terms that included paying Mark's actual expenses ($1500 and change) and selling IAFF with the proceeds from that sale going into escrow to be used for the sole purpose of paying Galina's credit debt. What else was included in that agreement is largely irrelevant, but it is not disputed that both parties agreed to the settlement and signed it.
At that point, it really doesn't matter what Casey's lawyer or the judge say about it (unless it was an illegal contract because of lack of consideration, incompetent parties (debateable), etc.), the contract is still valid.
All of this blind rage towards Mark is unfounded. Regardless of his motives or methods, the end result of the lawsuit was another contract that Snowflake is trying to weasel out from under. The difference this time is that Mark is going to make sure that the terms of the contract are enforced by the courts unlike Casey's previous verbal (Duane, mentors, Chris Record) and written (PRLinkBiz, Galina) contracts.

I was using that as a common metaphor to remove references. I understand they could just remove text and index references from their POSTGRESQL databases or remove offending references.
I am an EE, not a Linux guy however I have used Linux before (years ago) - but usually use Windows now.
I remembered rm -r (/r my typo) as a programmer in my Systems dept used it years ago that caused us no end of hell until he left. And he'd often execute it from root.
I _DO_ understand IP and apps well as I have designed a 10BaseT ethernet card before (and stack). Mark seems to believe ICANN can remove the content because of their authority and location - they can't.
I am not going to begin to explain how Google would remove content from their servers - quite honestly, I don't know how they clustered and stored data on 1000's of computers to distribute it. I do know they use a customer version of Ubuntu and Linux on their servers and believe they are using POSTGRESQL.

Because there was a binding settlement between the parties. The court hates to have its time wasted. A TRO hearing on a settled matter would piss off the judge. Of course, now the judge is going to be royally pissed off at Casey if this comes back before him.

1. Contradict himself.
2. Get hit with contempt.
3. Perjury.
4. Criminal referal.
5. 72 evaluation period.
6. Summary judgement.
IANAL and don't play one on the web. Still I could elicit all those in less than 15 minutes of questioning. I know it and Casey knows it that if he ever opens his mouth in a court of law he will not walk free for years at least. And now he is also aware that he is tagged a flight risk and won't make bail. Not that I don’t appreciate your take, it’s mostly accurate. And while I shouldn’t comment on particulars, it’s enough to say that sometimes a give and take accomplishes far more than immediately meets the eye. Having said that, my litigation objectives are still met even with this revised understanding Casey exposed.
And THAT (litigation objectives) are what most folks who hate on me don’t get, there are definitive aims behind what I’ve done and what I’ll be doing shortly.

That's cool that you have a very good grasp of TCP/IP and the network stack. If what you say is true, your knowledge in that area is certainly better than mine. But I still have no idea what relevance it has to the subject at hand. Also, building a network stack doesn't tell you much about modern web apps.
Google uses a hybrid filesystem/database called GoogleFS that breaks data into "chunks" and copies them to multiple individual servers. These are indexed in a proprietary and extremely high-performance manner. I believe that currently, none of Google's software is "off-the-shelf". Everything from the Linux kernel to the filesystem to the indexing system is highly modified and/or written from scratch. In 2003, they were using a Linux based on the Red Hat distribution. There's no reason why Google would use Ubuntu on its servers. Ubuntu is a "dumbed down" version of Debian. And while they probably do use PostgreSQL *somewhere* in their systems, I doubt it's for the main indexing system.
On to other things.... ICANN obviously has no power to make Google do anything. However, Google has shown itself to be willing to remove content based on legally specious claims (although I don't know of any U.S. cases that have been adjudicated -- the current Viacom lawsuit will be very interesting to watch). E.g. in 2002 Google removed websites critical of Scientology.

I've been greatly entertained by this saga for the past year. So much that I really hate to see it go. Regardless of what Casey achieves, it's always a joy to see what he does next.
I really do believe he has the potential to dig out of his hole and meet his goals. With that in mind I'm considering giving him a large donation. 6 figures. I think spaced out over the next year to make sure he has an incentive to follow through. Not to mention keep us all entertained. I've made out good in tech over the years and have more money than I could ever spend anyway. So no big deal. I'm considering all the logistics now and expect to make it before his deadline. Losses from the sub-prime mortgage crisis in the United States could reach $100bn (£50bn), the US Federal Reserve warned yesterday.
Giving evidence to the Senate, the Federal Reserve chairman Ben Bernanke stressed that there would be a hefty cost of clearing up the bad debts resulting from the downturn in the US property market.
"The credit losses associated with subprime have come to light and they are fairly significant. Some estimates are in the order of between $50bn and $100bn of losses associated with sub-prime credit products," Mr Bernanke told a Senate banking committee hearing.
"The credit rating agencies have begun to make sure they account for those losses and they have downgraded some of these products," he said.
As Mr Bernanke was speaking, the ratings agency Standard & Poor's slashed some previously top-rated mortgage bonds to junk status, blaming the continued decline of the US housing market and bad lending practices.
Lowering its assessment on 418 classes of bonds worth $3.8bn, the credit rating agency said losses on so-called piggyback loans - second mortgages to fill in where the first provider does not loan the full value of the home - would "significantly exceed historical precedent" and "its initial assumptions".
Figures out earlier this week showed no let-up in the decline in the US housing market, where rising interest rates have pricked the real estate bubble of two years ago. Construction activity has declined as builders seek to rid themselves of unsold properties while default rates among low-income borrowers have been rising rapidly.
Mr Bernanke said this week that defaults and repossessions were likely to get worse before they got better. With inflation higher than the Fed would like, he has offered little prospect of an early cut in interest rates to ease the pressure.
Shares in New York shrugged off Mr Bernanke's warning, but the dollar fell back. The pound was trading at higher than $2.05, slightly below its 26-year peak reached earlier in the week.
In a second day of testimony to Congress on the health of the economy, the Fed chairman said the central bank would seek to prevent a recurrence of the questionable lending practices used by financial companies to persuade those on low incomes to take out home loans.
The central bank was now considering a range of changes to mortgage lending rules in the wake of the sub-prime lending crisis, including better disclosure requirements and limits on prepayment penalties, he said.
Investment bank Bear Stearns admitted this week that one of its hedge funds was worthless after it invested in US sub-prime mortgages. Another fund was "virtually worthless". Goldman Sachs has also cut the value of derivatives known as collateralised debt obligations (CDOs) that included large holdings of sub-prime mortgages.
The revelations have spooked banks in Europe and the US which are believed to hold some $1.5 trillion in CDOs. There are fears that action by Mr Bernanke and the ratings agencies will prove too little too late and be unable to prevent further hedge fund collapses.
Bankers were yesterday talking about the difficulties of raising funds on the debt markets as nervousness among lenders caused the flow of money to start drying up. A collapse in confidence could bring with it a wide-scale collapse in the value of CDOs, some argued.
Man Group, the world's largest listed hedge fund, was forced yesterday to cut the value of its broking division by a quarter before its planned flotation next week, amid fears of a deepening crisis in debt markets.
The group had hoped to raise £2bn but was forced to settle for nearer £1.5bn from the share sale after investors were unwilling to support the higher valuation.
Problems in the debt markets will also throw the spotlight on private equity firms and their attempts to raise funds for major buyouts. Several large buyouts, including the £11bn deal for Alliance Boots, are currently seeking support in the debt markets.
Some analysts said they feared a broader credit crunch if a collapse in confidence in the US mortgage market rippled out to other parts of the debt markets.

If Google or any other site ignores the robots.txt file then it shows up in the site's logs. It's very apparent and easy to find.
The format of the robots.txt file is not a standard and people frequently misconfigure them. Search engine spiders also screw up sometimes. Mistakes happen. However, Google doesn't try to get around robots.txt restrictions on purpose because it's bad for business. It gives the search engine a bad reputation if it continually does things like that.
At least try to have a vague understanding of the subject before you go spouting off next time. Better yet, stick to posting about the evils of illegal immigrants and DEM DAMN LIBBIES AND DAT DERE GLOBAL WARMING. You'll feel much more at home.

I have used Google's removal link before. They will _NOT_ remove content unless it is no longer online or unless you are the owner of the content. You must login to Google's Webmaster account and then select what you would like excluded.

Ben left off at least 1, and likely 2 zeros. Remember, the S+L crisis cost $200-300 billion in late 80's fiat. Adjusted for inflation, it would be $500 billion.

Problems:
a) the directory is protected, so I can't poke around in there
b) the plugin includes dummy "index.php" files in the cache directory, so you need the exact filename to find anything
c) each actual cache filename is randomly generated. If you'd like to see the function, Google "wp-cache" and take a peek (it's all open-source). I tried to paste it, but Blogger choked.
If you knew the filename, you could access the cache remotely. For example:

However, standard plugin settings dictate that each cache copy is replaced after 3600 seconds (every hour). Therefore, the odds are that all the good stuff has long since been cleared from the cache (i.e. old posts about Mark, etc).
However, as you can see, the entire page contents are dumped into an unprotected HTML file. The blacklist REGEX function only runs each time a new cache copy is created, after which we are all puling simple HTML.
This, of course, assumes that KC is using common sense, and has taken 15 minutes to implement a totally free plugin. It is very possible he has "tweaked" the cache plugin, which is why the posts occasionally show up as blank pages. I have no idea why he would do this.
Another reason I think IAFF is using wp-cache; MySQL usually starts bugging out around 25 consecutive users. i.e. the "slashdot effect". With so much traffic, I expect caching is routine. Even my dinky blog uses cacheing, to handle the occasional flood from digg.

3. One major security flaw with WordPress is that it allows you unlimited attempts to login. Most systems ban you after 3 failed attempts- either by a browser cookie [dumb] or by IP address [smart].
4. If someone were so inclined, they might run a brute-force cracker and gain admin access to the blog. The default username is "admin", and I doubt KC took the 15 mintes to change it.

6. The admin password is stored as an MD5 hash in the wp_users table of the MySQL db. If you were to change the admin password, and KC did NOT back up the MySQL database, it might take him awhile to figure out how to reclaim ownership of his blog.

9. If you *really* wanted to cause casey grief, I suggest skipping WordPress and FTP access, and going right for his webhost admin panel. He'll be able to straighten it out after a while, but you can cause some real headaches in there (delete backups, change FTP & MySQL creds, mess with DNS settings, etc).
10. I would NEVER advocate hacking a website, especially one belonging to such an upstanding member of society. I will be *really disappointed* if I find a the goatse image on IAFF later tonight.
