No, what you have mentioned is one of many different scenarios. Not to be flip but it's Saturday & I am sure most of us don't want to dust off our law books and give a crash course in Law 101.

If you have plenty of time to kill, the internet can be your friend.

If I was Casey, I would be very worried and speak with a real lawyer. (You know, Casey, one you pay...not one provided by folks like Mr. "Deep Pockets" Vegas lapdancecode bouncer or the RE gurus.) Of course, I would never be a Casey because all my business deals have been on the up & up and - thank GOD - have never had to be defended on the internet from a 7-11 wifi spot, of all places.

In way, I suppose it's good to be a Casey because he doesn't realize HOW MORTIFIED most normal people would be in the same situation!!

I'm reading the talk transcript right now, and between that and what Casey's posted on his blog, you'd better not file anything in court.

Casey's done some extremely dumb stuff, but this could really backfire on you in a serious way if you actually bring it to court.

You're not a CA barred attorney, so I hope you know what you're doing if you go ahead and file this, as judges have little time for frivolous pro per cases.

This sounds to me like a potentially serious case of testosterone poisoning here.

Whatever happens, whether it's Casey getting his long deserved comeuppance, or whether its YET ANOTHER example of people getting involved with Casey having to deal with unforeseen but severely negative consequences, it's going to be totally hilarious.

If there is an ex-parte hearing next week, the judge can and may order the shutdown of IAFF, pending further proceedings. Just a heads-up--if you want to mirror a copy of it, now would be a good time.

In my state, I've seen them issue injunctions cutting off people's bank accounts based on a couple of plaintiffs' allegations.

Casey's MO is he's constantly reframing things, like how he called Mark's e-mail "your little note", or that the whole thing is just so STUPID, it's just so silly.

And, on top of all of it, a golden nugget, a gift, as it were, from mumble mouth himself. He admitted, on mp3 and archived, that he's avoiding being served by CashCall in Australia.

Someone has GOT to send the link to that revelation to CashCall's lawyers.

I loved how to him, he just owes 10k. Um, no, Casey, there's interest attached, a LOT of interest attached, and they're NOT bluffing. But you keep thinking you can pop up sometime in the future at random and make a payment when you feel like it.

I can't wait to see what else is coming for the little bag of shit. I cannot get over his arrogance and his sense of entitlement.

Mark, you have to know, if you get an injunction, he'll push the limits like he did with Galina's contract. It's his nature, and personality. I do believe he will be in contempt of court within 24 hours of an injunction being placed, and I beleive he thinks he'll be able to negotiate his way around a judge's orders.

I would give anything to be in the courtroom when a judge starts getting a taste of Casey's games and headfucks.

Mark Villasenor has blatantly stolen / violated our copyrighted voice recordings from my publishers’ site. He said he is doing that to provoke my publisher to sue him. And there was another angry legal-sounding email that I got regarding this but I’m not gonna post it… well maybe later if it’s needed. It was basically to provoke me/publisher to sue him over copyright violations.

How does that make any sense? Why in the WORLD is Mark so militant? Why is this a “war” now?

Casey says there's no case number. People are accusing you of a simple shakedown and are citing the fact that you have named fictitious named posters in the suit as well. How do you know that this suit will not get tossed out like the $100 million dry cleaner lawsuit? Presumably you wouldn't waste the court's time. And presumably this isn't simply an intimidation factor.

Would really hate to see Casey call your bluff and walk away from this scot-free (and without having had to even hire an attorney.)

There are suggestions he transfer ownership of IAFF and migrate to an offshore server. Hopefully the court doesn't see this as a personal attack, because the way Casey is spinning it, you and Duane are "Trying to force him to live his life the way YOU want him to."

I personally think he's (Casey) grasping at straws.

As a lawyer, I am always amused by the confused, painfully tortured legalese concocted by these wannabe attorneys.

Just had second cup of coffee and realized that Casey is attempting to do what Duane told him to do with the NLL contract. Put it in the public domain in an attempt to turn the heat on Mark. Well all that does is prove that Casey takes nothing seriously. Proves to his family that he is willing to throw his OWN MOTHER under the bus before figuring out how to take care of this. Frankly if somebody were suing my Mom, I'd damn well talk to somebody (especially her!) about it before putting the fucking thing on my BLOG for the world to see.

Case #'s and damning evidence are likely in the unposted PDF file.

I've seen no link to the complaint, Mark has'nt posted it, and Cowardly casey did'nt either.

As I understand it, Mark has not filed yet, so it has no case number, nor would it be in Pacer.

So yeah, our anonopussy is either bloviating, or make a determination on the snippet Casey posted, which looks to be standard legal language and not hard to understand.

Maybe it's juts me, but something changed on IAFF, when i go there now my system lockes up briefly (memory, the little spinning beach ball pops up) and my system fans go on (indicating cpu usage?), which never happens on websites. As soon as I leave, the fans shut off. (Dual 2.0 G5 Mac, 3 gigs ram) I think we all need to be VERY careful going over there from now on.

Man O Man, I missed my Friday nigth beer and talk cast! Have a lot of reading to do but a Canadian EN'er asked what happens if one does not pay the IRS.

Ed and Elaine Brown were convicted of federal tax evasion in January, 2007. Because they have found there is no law requiring the filing of a 1040 income tax form and that all U.S. courts are corrupt executors of the government, they did not appear in court for their sentencing, where they were ordered to serve five and a half years in prison. They have remained in their home since April.

This tough love is a bunch of crap. It's a bunch of crap. That's all I've got to say, man. And Duane has crossed over the line many, many times. I need to tell this story on the blog. I need to tell it. I think that's what I've got to do. And Duane, I thought I could keep you under control here, but man, he kept stepping over and stepping over, and that's not right. So we'll move on. Duane... you know, he seems like he's doing something good, but he's going about it in the wrong... the worst possible way, just like Mark is. And all they're doing is aggravating me more and more as if... you know, what kind of strategy is that? No strategy at all. Making it harder and harder for me to trust them. Taking what my family tells them - get this, they take what my family tells them, and they post it all over the internet. Who does that kind of crap? They're trashing not only my name but my family members. Have I done any of that to them? No, I have never, ever posted anything negative about Duane or Mark. Yeah, I mean I've expressed my frustration with them before, probably, but I don't go out there and post private things they've told me. Personally, I think Casey needs to have a day in court - and I'm really not too bothered about the exact mechanism for getting him in there. (I doubt too many people eighty years ago were that fussed about Al Capone being fingered for tax evasion).

Since he won't respect signed contracts, and his word is worthless, and he won't listen to anything even vaguely approaching reason, it seems to me that the only thing that will (or might) have any effect on his behavior is the realization that his refusal to co-operate might actually see him doing jail time. And if it means actually hauling him up in front of a judge, so be it.

(Unlike many, I don't actually want to see him behind bars - but while transcribing the LossMitPro and Duane encounters, my head was frequently battering my keyboard at Casey's sheer boneheaded obtuseness. He can't seriously believe this crap he comes out with, can he?)

Well put. My reaction was that LMP's complaint sounds like No Limit Ladies' contract, and we don't really know LMP's motivation. I wasn't going to post this so we don't spoil the fun, but after reading the transcript I got a little worried LMP is not just yanking Casey's chain for fun. As evil as Casey is, I find it distasteful that LMP is trying to bully him with his unintelligible faux-legalese. This is not just a prank call to Casey's Aussie cell phone.

They both need to see an attorney.

When I asked you last night on the Fraudcast what you expected to encounter when you returned, your reaction made me visualize an expanding wet spot in the crotch of your pants. Now that Duane and Mark have shared some juicy sweet info with us, I understand why.

Have a great flight and holiday. You weren't sure last night when you're returning - I bet the truth is that you don't know when or where you're going next.

Eat better and wash your hair - that will increase your options in Asia, if you know what I mean. We're all whores in that we all have our price - we're getting a pretty good sense of what your price is: a one-way plane ticket, couple days room and board and free internet. Talkcast was pretty funny, I thought about calling in, but when I get rolling I start talking at about 120MPH and sound like and idiot. LMP/Duane/Annie etc did a pretty good job of taking Casey on.

However my list of things I hope I'm wrong about

1. Galina takes him back, likely not because she wants to but because she "has to"

2. LMP's lawsuit for all the grief its going to cause ends up for nothing (hopefully the judge at least takes casey offline for the 20 days Mark was talking about). Sorry Mark, while I agree with you trying to prevent Casey from profiting from fraud. I don't see what you can do before Casey is actually charged with a crime. But like I said, hopefully you can tie him in knots before the judge decides something similar.

3. Casey does find a pro-bono lawyer or Massive Marty (tm) or the family hires one.

4. Google continues to ignore Casey's SEO/ad violations.

5. Casey's supporters/advertizers continue to value greed over doing what is right (cutting Casey off).

LMP definately rattled him, I wouldnt be surprised to see him skip the flight back (not that it would help, default judgements and all).

IMHO the lawsuit is taking things too far. LMP, did "put up" like I asked him to -- that's admirable.

What isn't is that LMP inserted himself into the KC story voluntarily and he has not been directly harmed by anything KC has done. I would love to see someone who was truly hurt by KC file a lawsuit or press criminal charges. That may be the banks, Galina, CashCall, who knows? But this third party action just smells bad.

Give it up. If the people who really got bit aren't interested in suing why should anyone else. And don't give me any of that "it's my duty as a citizen" crap. You're doing it so you can get your 15 minutes and look like a big dawg on the block. Instead you look like a wannabe.

Well, anonymous, since at this point all we know is that you play a lawyer on the internet, big deal. Also, if you used your head, did it occur to you that Casey could have posted anything, including the Magna Carta, up on his site and passed it off as something Mark gave him? Already, you should know, with all of your lawyerly knowledge, that you shouldn't trust the blatherings of an admitted fraud and lawyer. Again, we're only hearing one side of the story, from a horrible liar who has used his blog to manipulate the masses and part folks from their hard-earned cash. So as long as Snowflake is afraid of "loosing" his Preciousssss, he's going to do anything it takes to discredit, dismember, and disinform.

So just chill out. Because I don't believe shit that Snowflake puts on his blog these days.

LossMitPro's serve: Snowflake is cashing in on an ongoing crime.

Snowflake's return: I didn't commit any crime. No one has charged me with any crime.

LossMitPro vollys: Snowflake has admitted to 8 counts of Mortgage Fraud in his blog.

Snowflake vollys: I made some mistakes. Everybody did it. I'm not a criminal.

LossMitPro returns with specifics of Snowflake's fraudulent acts. Hizzoner takes OFFICIAL JUDICIAL NOTICE of the allegations of Mortgage Fraud and orders loose the Dogs Of Forensic Accountancy and LossMitPro cries "Havoc!"

Can you imagine our Snowflake, on the witness stand and under oath, trying to dodge the direct examination by a prosecutor? Much different than someone on a talk cast, I'd suspect.

But I do think this needs to happen to him at some point. Can you imagine Casey's reaction to a judge announcing that answering a question with another question will be treated as contempt of court and punished accordingly?

Prosecutors are found in criminal courts where even in your wildest delusions nobody can force Casey to testify against himself.
