Oh Man You Shredd

Beazer Homes has more problems than most homebuilders. They got caught. From Businessweek we hear of the the CAO being fired for cause.
After the market close on June 27, the sixth largest residential homebuilder in the U.S. said it had fired its chief accounting officer, Michael Rand, for attempting to destroy documents, a violation of the company's document retention policy under its code of ethics.

Good on them right? Not so fast:
The chief accounting officer isn't generally the person who sets financial policy, nor does he under normal circumstances have primary responsibility to approve major financial transactions, Gieber said. That begs the question of what was going on at corporate headquarters that someone felt needed to be buried, he added.

Beazer is under suspicion not for homebuilding practices but for lending practices.

Just like Duane said he must be crapping in his pants. Between the lawsuit, having to come home immediately, having fucked up badly enough to get his own mother in trouble, leaving his wife behind and facing the certain reality that Yulia will not let his freeloading ass in HER house. The reality that his entire family realizes he's out of control and dangerous to their retirement. The reality that having made $1000 doesn't even begin to cover his bills. The fact that there are no offers of $100,000 for IAFF, and that even if there were, half of that would immediately be taken by cashcall. The fact that the other half would go to lawyers to defend himself against Mark and the certain Tax Evasion/Fraud charges that will follow. Oh my.

Yep - no more sweet leverage, but he now has the global blogging arbitrage thing going for him now. And since arbitrage now means whatever he wants it to mean, and that meaning changes from sentence to sentence, it's still all good.

If he's really, really lucky he ought to be able to milk the "eccentric infamous freeloader" angle for another couple of months. If the Oz publicity spreads a bit to Asia, plenty of opportunities there as a novelty.

Not talking about his family is how he avoids dealing with any of the real issues. As long as he sticks to the line that he made a few mistakes and is helping people and he DESERVES to make money because he is HELPING people (not that he's actually a sideshow act), then he can avoid pretty much everything. I know that I may come of as a biased Casey supporter at times, but I am actually quite neutral regarding the whole saga. It was even quite amusing there for a while and served to fill the breaks in my day. I am empassioned about the story I admit...but in my case (not that it matters)...it is more like a feeling of disdain that I have for what I call the really "hateful" haterz.

Casey, please stop supplying these people with the ammunition to attack you. Your initial intentions for starting the blog were righteous, but the whole story has become twisted. It is good drama for a movie or book but not for your REAL life. Please "come home" and I mean that in every sense of the word...spiritually and physically.

There is no court hearing on July 5th. Nothing has been filed and this has not even been given a case number.

Most of what Mark sent to Casey, he pulled off the County website and he even managed to get some of the times incorrect.

Mark is making himself look very bad and needs to learn how to keep his mouth shut if he ever hopes to get somewhere via the legal system.

Actions always speak louder than threatening words.

I know of no one who continued to work with Casey after learning the details of his crimes except for those who tried to get him to stop. no one ever worked with him at all once they discovered Casey hadn't stopped except his current taskmaster pagedaddy who is definitely going to catch some fallout precisely because they continue to work with Casey assisting with his ongoing criminal activities.

Let's get something else clear. The lawsuit is unimportant as to damage amount and libel or liability. What counts is what happens in discovery. There have got to be some real nervous loan agents or mortgage brokers or real estate agents or appraisers or certain companies with ties to all the above over the ideea of Casey's records going public.

Speculation mode on: If I were one of those enablers with a high profile I'd have seriously considered giving Casey "hush money" to make sure he never talked about the deals on his blog. By now it should be pretty obvious that Casey has been getting unmarked nonsequential small bills on a regular basis from under the table. Speculation mode off.

Why would Casey need to be in court on July 5th for an ex-parte motion. By definition, ex-parte is a one-sided communication with the Judge. The whole fucking point in ex-parte motion is for the other party, NOT, to be there.

When Mark keeps stating that Casey will need to be in court on July 5th, he continues to scream, "I am a fool and want to let everybody on the internet know it."

Somebody made an excellent point about dealing with Casey on either end of the spectrum. Those that deal with Casey, get blasted. Walk away Mark and let Casey shrivel and die with the lack of attention. You continue to be an enabler ( even through you are trying to stop him) and will only cause damage to yourself in the process.

To me this whole thing is a joke, no reason to get my blood pressure up, no need to spout off legal crap and expose oneself to ridicule.

As long as it is stirred up, Casey keeps getting free attention and free publicity.

Both extremes seem to be waiting for the big payout. Casey is waiting for his opportunities to strike gold and provide him a huge payout or passive income. he other side is waiting for the axe to fall and for justice to finally be served. In the meantime it is all just masturbation and Casey gets the exposure and pulls in new marks or a new supporter dumb enough to enable him for a week or two more.

The ex parte means Casey doesn't have to be there and the judge will still hear it. Had to be done that way as there was no tellin' when 'tard would return. Besides you know Casey, he'll ignore it and it will go away. This isn't two sides being heard. This is one side asking the judge for immediate relief from ongoing harm. Imagine how effective that would be if the injuring party could postpone indefinitely by not showing up.

Maybe. But the longer things draw on without Casey striking it rich (if such a thing is possible), the more things will stack in favor of the haterz. Every day that goes by means that his situation gets worse, not better.

As he fiddles around, looking for the next big thing, his debt mountain continues to climb higher and become even less surmountable. The interest amounts on his loans continue to climb and his inaction incurs default charges.

The longer that goes on, the bigger his magical windwall will have to be. And you know what Casey's like - if he gets any money, he spends on non-magic beans. You know, the kind that cost as much as the magic ones, but don't actually do anything.

The longer this draws out, the bigger his debt load gets and the more options his creditors get. I suspect that he will fall afoul of someone legally eventually. It could be Lost Mittens (I suppose) or it could be Cashcall. Or the IRS.

Either way, haterz can afford to wait. Casey can't afford that luxury. His best hope will eventually be either bankruptcy which has its own complications and won't spare him from the IRS, or waiting out the statute of limitations. Neither of these approaches will do anything but hinder his plan to become an entrepreneur.

You don't need to look up the cases for July 5th since the paperwork has not yet been filed, there is no case scheduled on July 5th.

Depending on the case number, once filed ( odd or even) will determine what Judge will be hearing the motion and at what time. However since Mark has not yet filed, there is no case scheduled.

Of course this is all weighed against Casey in the long run, which is why I don't let it get my blood pressure up. For nine months I haven't worried about Casey going anywhere with this, because he is Casey. Have faith in this people. Relax.

I feel the same way about our current President. I know he has very smart people around him, etc. and I want him to make better decisions, I pray he will make better decisions, but at this stage of the game I know where it is heading.

Some people are better left to self-destruct and they always do, it is their nature.

Typically the point of an ex-parte motion is to have the opportunity to go before the court and recieve an emergency injunction or restraining order.

There are instances where one would need to go before the court, and time, circumstances, or emergency reasons make it difficult to go through the normal process of serving an individual and waiting for the system to take its natural course. For instance in the case of domestic violence and obtaining a restraining order a person could request to go before a judge immediately to obtain protection without the other person needing to be found and served. The judge could grant a temporary order until the situation was able to be handed through the normal court system with normal process being served and both parites being given the opportunity to plead their case.

I do not believe Mark fits the bill in this case. There really can't be much of an emergency if he is willing to drop things if Casey contacts him and bows to his demands.

With Casey being in OZ, I could see where one may try to go this route since normal service is difficult, but I doubt a court would see stopping Caseys blogging etc. when he hasn't been convicted of a crime, as an emergency, but rather as an abuse of the court system, where others do need the protection and immediate releif that may be granted through this route.

Mark rambling that Casey will need to be there in court, shows Marks inability to understand what it is he is filing with the courts.

You know about as much about legal doctrine as Mark does. He's representing himself. This means that he might not always use exactly the right terms.

At least he has the balls to actually do something about Casey. Which is more than any of the rest of you can say. You say you're not supporters and yet you haven't done anything to stop him. Ok, just couldn’t resist this one (gez guys, if I keep getting distracted I’ll never get any work done! Part of my diabolical plan), anyway...

An “Officer of the Court” executes specific judicial functions; judge, lawyer, (some) clerks, etc. While an “Agent of the Court” carries out ancillary procedures; process server, investigator, and (in my case) ADR facilitator. This does not give me any special rights above and beyond what any other citizen has, other than an inherent responsibility to respect and observe court processes and the law. I am essentially no more or less SPECIAL than anyone else, when defending interests.

Having said that I’ve a Constitutional Right to redress grievances in court, being a “petition” upon government irrespective the popular line that only lawyers can litigate. Now if I lacked the ability then sure I’d have to hire a good attorney, but since that’s not the case why is it others think I'm outta-line? I don't get it, bitch about Casey, but do nothing more??? Yeah, riiiight, not me sorry.

I gather what folks forget is that I’m presently under fire for doing the right thing, countering a public menace that poses great harm upon innocent people. And if you THINK I’m stretching there? Check out this excerpt from the Casey & Marty contract, posted within the previous thread? Here’s the substantive quote:

I am not bashing Mark, and I am trying to help him so that he doesn't find himself in a bad situation and provide Casey with more press, and ability to spin his story.

I don't need to spend my life stopping Casey or worrying about Casey. I am not that co-dependent.
No question Casey has violated numerous laws and he has been reported to the appropriate agencies. It is in their hands. I am not going to do something to my own detriment by circumventing those channels or trying to do an end run. This is entertainment, not my fucking moral obligation.

Long ago I learned that the system is flawed. Life isn't fair. I will work on changing the system, but I refuse to take responsibility for the actions or inactions of government agencies or people that fail us. If you want to get outraged and jump on some moral high horse about your wonderful actions then go for it. Its not my job to lose sleep over Casey, I would rather care about and care for my own family.

-legal contract to never try to restart either again or otherwise profit off his previous fraud.
-guidance/requirements on paying the debt

I know you do not need me to defend you. When I spoke to you and Casey on the phone when you were helping him, which was fine, it is what you do, I was impressed with your knowledge.

All of this whilst Mark was working with HIS contacts within HIS field of work, W2 or other wise, KC just bailed out on the Loss mitigation process entirely, threw mark under the bus, again, in front of Mark business colleagues, AT HIS WORK environment, and then took out MORE LOANS, as I reckon things went down and from my recall!!!

This must be related to the issues Beazer was facing a few months back when an investigation was revealed. Stick dropped from the low 30's to 25 in aftermarket trading and then opened around 27-28. Within a few days the stock price was up to the low 30's again.s

Amen, brother. I can count on the fingers of one hand (and I don't think I need my thumb) the number of people who have taken specific action to stop Casey's madness (and I use that term consciously). You, Mark, Annie (email to G), r-boy (maybe just noise) ... calling #4 or #5...

The rest of us sit on the sidelines and cheer or snipe.

Since I was on the road last night, I called into the fraudcast from storm ridden DFW airport rather than listen through PC. I didn't intend (that word will always have a different meaning for me now) to talk to KC, just listen. But, when he called on me, two earlier marguaritas said "talk to the litle fuck". The thing I took away from my little talk with him was that instead of just knowing in my head, I now felt in my gut, that he wouldn't stop hurting himself and others until someone external stopped him.

IMO Mark is doing the right thing. There are things that Casey or anyone involved would never admit to unless forced to cough up the particulars in testimony or discovery. This is one of those cases where the judge starts reading and almost immediately changes the venue from civil to criminal court. The civil may or may not continue from there but the the wheels will finally start turning. The words and phrase Mark uses are convoluted making it easy to ridicule or misinterpret but you need to stay focused on the bigger picture. Casey's activities, many still hidden, will be before an officer of the court within days, that's the near term goal. Remember also this is a no award/reward effort. Any personal issues you may have should be held in abeyance in light of his making this effort and sacrifice.

I'm starting to get what's happening. I had two red flags initially: one, that LMP had worked with Casey before; and two, the form of the complaint. Now I see the complaint I read was typed by Casey, so the form might be ok, especially if the main purpose is to merely avoid sanctions or a quick dismissal. The first red flag is not gone, but maybe this is LMP's way of redeeming himself.

My kindergarten teacher's calling--gotta go.
