I'll just state my positions on the subject at hand upfront, so there's no confusion:

1. Casey is a twat.

2. So is Marty.

3. Galina was a naive enabler, but having been in an emotionally abusive relationship myself, I understand her lack of action earlier.

4. I'm on the fence about Nigel. I was all rah rah rah, but today's limp post (he he) makes me think otherwise.

5. I STILL say it's lame to go around trumping up faux confusion over the PageDaddy versus GoDaddy issue (yeah, that was me on the other thread dipshit, not Gaysey). Report the issue if you want, but don't report that you're a moron who can't tell the difference between websites. GoDaddy pays lawyers lots of money to figure that out for themselves.

I’m a criminal defense attorney who has worked on a number of large, white-collar cases, including a few mortgage fraud cases. I’ve been following Casey’s blog for approximately six months – mostly, like many of you, because I couldn’t look away from the constantly escalating “train wreck” that is his life.

First (I’m not sure if this has been pointed out), the FBI has a stated policy on investigating mortgage fraud. The FBI divides mortgage fraud into two categories – “fraud for property” (such as stating an inflated income to obtain a mortgage from a federally-insured institution, Casey fits in here) and “fraud for profit”, which, by definition, involves an “industry insider”. The FBI, admittedly, is much more interested in “fraud for profit”. http://www.fbi.gov/page2/march07/mortgage030907.htm

Investigating and prosecuting a case like Casey’s, even if it is a “slam dunk”, involves a massive allocation of Government resources – the time and effort spent by the FBI and the US Attorney’s office would be considerable even in a “small case” like this. Because of this, it would be unusual for them to prosecute Casey – they have much bigger things to worry about (terrorism, large white collar cases, organized crime, etc) than a single individual stating his income a little higher on a mortgage application. While I’ve definitely seen the Government move forward and indict individuals in mortgage cases where the individual was probably even less culpable than Casey, they usually only do so if it involves a “bigger picture” (they think it’s part of an organized crime scheme, they think the lending institution engaged in some unlawful conduct, etc). In the end, I would bet they won’t think it’s worth their time, so Casey gets off on the cost-benefit analysis of prosecuting him. A fact weighing against him is the fact that he did this multiple times – if the “actual loss” to the institutions is high enough (I haven’t done any sort of analysis), this could potentially change the equations

I will say this, however (and someone mentioned this earlier), the Government does not take kindly to anyone who blatantly disregards the law and publicly parades that fact around for all to see – he’s really sticking his thumb in their eye by constantly blogging about how he committed mortgage fraud and is essentially trying to build a “brand” on that fact. If they do decide to move forward against him, it will be because of this.

If they do, Casey will have a real problem, mainly because the evidence of his misconduct is easily obtainable by the Government (his tax returns, grand jury subpoenas to the banks [they might even produce this voluntarily] will quickly produce his loan applications), and he’s made multiple admissions to many people (like those recordings) as to his conduct. Casey has made so many admissions that it’s virtually pointless to even assert the Fifth Amendment in any future proceedings – he can’t possibly do any more harm to himself. His lawyer’s only goal would be trying to work out a remotely favorable plea agreement.

Lastly, despite theories posted here, it’s extremely unlikely that the FBI somehow lured Casey to Australia so they could access some kind of evidence – first, most of the important evidence is out of Casey’s control, third, they could easily obtain it without his consent anyway, and third, he isn’t Pablo Escobar – a case this small doesn’t warrant anywhere close to that kind of planning.

Nothing I said was legal advice and it shouldn’t be construed as such, just some general speculation . . .

I agree that in the normal course of events, Serin might slip through the cracks. In this case, he's bragging about his crimes, is "writing" a book about getting away with it and leaving the country.

I worked at a U.S. Attorney office years ago and I know that at that time the office was severely understaffed and the priority (at that time - first Bush admin) of the office was drug trafficking. I could see how a quiet Casey could get away with it back then. This guy is a different breed, though. Do you have any idea why this guy is still running around? Do they need assistance from his creditors?

But it's my understanding that any of his stiffed lenders could force him into bankruptcy. I don't know. I would think that at the very least they would need the cooperation of the lenders. I really want to hear 3:40 anon's take on it. My guess is that the lenders know that Casey could not have done this without the complicity of a lot of other people and a lot of those people do a lot of business with those lenders. They may be reluctant to open that can of worms. That indicates that for each one of his felonies, there is an agent, a mortgage broker and a bank loan officer that either knew, or should have known, what was going on. That's my (semi)-educated guess, though. To my knowledge, 3:40 anon is the first poster that actually is involved in federal law enforcement currently, so very curious to hear his take.

Anon: The blog was harder work than I anticipated. I doubt I'd start it again. Steph, Aspeth, Flailing and a few others have excellent coverage of this mess outside of the 100 lb gorilla, EN. When I left the blog I was dealing with some personal issues that needed my attention. Once I got over that, I realized EN was huge and I could participate here and post how I feel.

Glad you remembered the old blog. It was a fun experiment but now I know how hard Dawg and others work on these things.

BTW - I abandoned the DeRoos part (a snarky take on a commercial I kept hearing over and over where the real estate guru would say...Hi I'm Dolph DeRoos and I can make yoy rich), so it's just Dolph since I am not the guy in the commercial.

So his original application of heterodyning was quite apt, but subsequent explanation slightly askew.

Roger Hayes – First, keep in mind that cases like this move VERY slowly. With the last of his foreclosures coming in March (I don’t know when the AUSA would have independently decided to start investigating the case or when the FBI would have brought the case to him/her), this isn’t a lengthy amount of time at all. Complex federal criminal investigations can take years before anyone is ever indicted, so a few months is nothing.

Unlike many of the their state counterparts, federal prosecutors have wide discretion about whether to handle a certain case of not – their caseload is typically 1/10th of a state prosecutor (at least in New York), so they can really focus and bring all their resources to bear on a few cases (which is partially why federally conviction rates are so high). So it’s really not a matter of “slipping through” – the odds are against them ever picking it up. Of course, this varies by jurisdiction as well as a lot of other factors, but they essentially don’t have a duty to investigate every crime that comes across their desk. So in response to your question, the Office handling his case might say, “So? I have ten indictments I’m about to unseal against members of the mafia alleging murder and a thirty million dollar extortion scheme, I’ll get around to Casey Serin when I want to.”

As to why he’s still “running around” – it’s not like he’s alleged to have been a child kidnapper or anyone with an urgent need to “get off the street” – so the Government has no reason to risk making a hasty mistake by moving too quickly.

No, in my opinion, they don’t need assistance from any creditors (if you mean to obtain the loan documents). Empaneling a grandy jury and subpoenaing the creditors is their bread and butter, if they decided to invest the time in doing so. The creditors could be compeled to comply with the subpoena.

Believe me, I think Casey is pretty reprehensible – but the fact that he’s visiting Australia I don’t think will be a huge deal. He isn’t under a pending indictment or even any kind of investigation as far as anyone knows – he’s completely entitled to visit Australia if he wants.

@4:18, keylan –In short, there really isn’t secret answer – if you organize a letter writing campaign, try and make a big deal to the media, etc, that might work. Ironically, I’ve actually had non-defendant clients who were the victims of crimes (very rare) and we were trying to drum up interest in their case. Through connections, we were able to set up meetings with the appropriate Agents and Assistants and make our case to them for why they should pick up our case . . . nothing ever happened in either case we did this for (they just didn’t want to take it).

Well, if the alleged crime is simply Casey making a material misstatement (his income amount) on a mortgage application to a federally insured institution, then no. Again, a grand jury has more or less unlimited subpoena power (for documents, testimony has a different set of issues). If it’s a more complicated “scheme” involving multiple actors (and possibly a different crime than the one I just described), then they still probably don’t “need it”, but it introduces a different dynamic depending on their goals (do they want the real estate broker? Will they pressure Casey into becoming a cooperating witness against the mortgage broker, etc . . .)

Sharky – Actually, the Agents assigned to white collar cases are typically some of the most intelligent and persistant in the entire Bureau . . .

This blog aside, it wouldn’t be headlines anywhere that someone named Casey Serin was indicted for overstating his income on a series of mortgage applications. Here’s a press release from the US Attorney’s Office in the Southern District of New York this week:

“United Nations Official Convicted on Corruption Charges”. Compare that to:

“23 Year Old Indicted for Saying He Earned $75,000 a Year When He Only Really Earned $60,000”

It’s just not a priority. It really hasn’t been an extremely long time – coordinate with the FBI initially (if they didn’t bring the case to you), sort through all of the shit Casey has produced, make preliminary interviews of potential witnesses, empanel a grand jury for discovery purposes, during which you’ll have to make at least a minimal effort to authenticate his blog posts as coming from him, on top of the MUCH more important terrorism case you’re working on.

This being said, as posted before, the Government does NOT like a scofflaw. So who knows. But a delay like this is entirely routine and reasonable (at least where I practice).

Yes, I think this is a case much more likely to be handled by state authorities rather than on the federal government. If you want to invest time in this, try and locate whatever mortgage fraud division there is in in the Sacramento (or where ever he bought one of the houses) DA's office and try to set up an appointment with an ADA.

Bring with you all the documentation and information you've gathered in a neatly organized fashion - make a general timeline of Casey's activities as well as an index of everything you're brining him (tapes, etc). Maybe even an extremely detailed written narrative. Organization is the key.

Point taken, but consider that Casey doesn't live within the jurisdiction of AUSA of the Southern District of New York. Where he is, there isn't too many corrupt UN officials to be had.

At the office I worked at, they took down a money laundering operation that dealt with sums much less than Casey's $2.2M. Caveats: this was '89 or '90, the operation was connected to organized crime and I was just a clerk, so only knew what they told me (or I overheard) about the operation, so there may have been a lot more to it.

So ok, yeah, Casey may not be a good case for the feds. However, what about the states? I have a friend that is on the Bexar County (Texas) white collar crime task force, and I know for a fact that they go after guys much smaller than Casey. What's going on in Sacramento?

That's my point - there's no such thing as agents devoted solely to residential, "fraud-for-property" where the individual isn't part of some larger criminal scheme - which is why this case has a goog chance of going nowhere, at least on the federal level.

But the Government works in mysterious ways sometimes, so who knows.

If Casey was a politician or had ties to Islamic extremism, for example, this case would have had dozens of federal prosecutors working day and night.

Well, as I said before, at least for purposes of the Federal Sentencing Guidelines, the 2.2 isn't the figure that would be used - it would be offset against whatever the bank was able to recover on the properties, or in some cases, what the court determined to be the "fair market value" or the property.

For example, say Casey never misses a mortgage payment, flips the houses and makes a bunch of money, and the bank never loses a dime. Casey has still committed a federal crime, but the "actual loss" is zero, which would reduce the severity of his crime (and whatever his jail time might be).

You're probably right about the State level - they typically have less discretion about which cases to "take" - I'd focus my efforts on them.

Casey's total debt load isn't 2.2 mil, it's more like $350k - $500k. The rest was recovered through the foreclosures. Plus, all of the California 1st mortgage holders can't pursue him because their debt was forgiven in the trustee sale (probably some of the other states are the same.)

From a state prosecutor's perspective, how would the spread out nature of Casey's shenanigans affect things? I would expect that the NM prosecutor would only care about NM fraud, and so on. If that's the case, the most Casey has in one area is California, where he has two foreclosures in Sacramento and one in Modesto.

It's definitely going to lesson the the case appeal for a prosecutor. While the overall fraud is large, it's spread out. Almost like someone planned it that way...

The best hope for prosecution is in Utah, if/when the wrap falls apart. Casey apparently scammed the banks, but not individuals in CA, NM and TX. In Utah he did both. The banks are probably happy to let the charges slide and take the tax writeoff as a part of doing business. With an individual the is a much greater amount of harm done.

On another note, Casey's trip to Utah is bizarre. Nigel was just a sideshow to the whole deal, contrary to popular opinion. I want to hear more about Glenn. Were they trying to keep his identity secret from Nigel or was it just the way it happened?

The other thing about Midou25 are all of his various Internet accounts. The all seem to have been created in late 2006, but none of them have any posts other than one about computer programming. I'm probably being paranoid, but I can't help but wonder if Casey created them as a diversion. That's probably too far out, as Casey doesn't appear to speak french, and no one he is related to appears to speak it either.
