Independence Day

It looks like our young alien's "Earth Mission" is coming to an end. The nasty Eathlings have powers undreamt of on Caseyworld™. They finish what they start, use the truth in startling ways, and have a planetary defense network they call "the rule of law." Other Caseyworlders are warned to stay away. These humans protect their people and property. The Caseyalien traits of lies and betrayal and concealment only work for a brief time. Apparently these humans have the undreamt of ability to learn from mistakes and not repeat them. How can the Fliptardian race ever gain sweet passive dominion in such a crazy place? These human vermin are resourceful to the point of dawgedness. From contients away they persist upon their efforts to contain the alien "contamination" as they call it. It is this agents recommendation that the Caseyworld's highest council, Nouveau Planets Universal declare this world off limits.
Update: My bad. Wrong alien. Who does this remind you of?

Oh, and about the mp3. I believe Casey was withholding the link. The mp3 was there. After I downloaded it, linked it, and uploaded, I think an hour or so later TalkShoe released it. They weren't having any problems with their servers. I'm sure he didn't want it to ever it out but he didn't realize it was still there, we just had to type in the proper location.

He really is convinced that ALL he is doing is "Sharing his foreclosure story and helping people to not make mistakes."

Hi, I checked out link for the case above, and that's definitely not one for Casey Serin, the Serin in the case listed is a minor. I could go look in PACER (has all court filings across the nation) to see what the case was about, but I don't feel like spending the money on it today.

I will tell you though, that when I heard about Casey's legal action, I did do a PACER search for it last night, and got nothing at all. Which makes me question the action.

I would much rather see the investors he screwed take legal action against him, as they lost something tangible (and substantial) from his learning experience. But that is just me.

Well I guess I'm a little suspicious of internet lawyers who make Harvey Birdman references and type comments in the very trendy word. word. word. format. No offense, I could be mistaken, though the phenomenon of 'playing lawyer' is quite common online. Casey 'personalizes' the issue far too much. He asks 'whats in it for you' or 'why are you taking this so personally?' 'its as if I'm stepping on your toes' I think Mark's words on the talkcast are all that's needed in response: "your opinions are in conflict with the law" So... why not? Casey received advice to turn himself in months ago from Jerome, and even before that from his web comments. To Mark's credit, one of his first remarks last night was emphatically encouraging Casey to find a lawyer.

PACER is only for federal courts. It does not have data for state courts. LMP is discussing filing/appearing in Sacramento County Superior Court, which is a CA state court; and arguably the wrong venue, if Casey lives in Yolo county.

Just a few things then I’m back into seclusion, but wanted to peak out a little to make a few observations for chits-n-giggles. (Yeah I’m the clown, here for the entertainment of some.)

Firstly, thanks to all who’ve shown restraint and objectivity. I appreciate the majority of EN regulars who see past the hype and disinformation, to glean the substance and ultimate goal: hit the Hobbit where it hurts most! Also much thanks to the likes of Miguel and others for transcribing the Foreclosure Friday podcast. Saves me some time (I’ll now be able to more easily use that material in evidence).

There strangely seem to be LOTS of wanna-be lawyer types that have emerged from the woodwork (and wouldn’t ya know, they are effectively anon), citing my complaint as unmeritorious and ill-prepared. Funny, not even the Defendants have seen the full complaint (yet) only a cap-sheet. Yet these modern-day Clarence Darrels extrapolate too much from so little, as though they’ve some inside track I haven’t. Go figure?

Yes one aim behind the lawsuit is to redress matters by monetary compensation. (Doh!) That’s how our legal systems is organized, to compensate aggrieved parties monetarily. Wish there was another way but there isn’t, this is the American systems of civil justice. And after all that is what matters most to the Fliptardian, MONEY; it is his god, his life blood, his ultimate objective. What else would any good litigator target?

The topics devoted to me that Casey posted to IAFF (while I’m flattered) do much to add ammo to my already full arsenal. I’ll explain, without going into all the legal theories which support the arguments. But you’ll get the gist.

Under normal circumstances Casey may have had some protections granted by Batzel Vs. Cremers, Ninth Circuit Court of Appeals, D.C. No. CV-00-09590-SVW (2003); meaning, Casey could have been shielded from certain conduct engaged on his blog had he NOT commented about me directly (himself). Although by posting what he has concerning me, protected matter of an express non-pubic nature. He opens the whole IAFF blog to all sorts of legal remedies, fit for the king that he is. And rest assured I am redrafting the complaint (lawsuit), to accommodate Mr. Serin’s desire for more pain.

Some have wondered why I am litigating Pro Per? Well, for one I can (by skill and right), and for another that is a matter of costs control. I needn’t spend thousands on attorney fees for a case that has a real potential of non-recovery. My Pro Per status is a business decision, a more cost-effective angle.

Lastly, many have wondered WHY I claim Casey & Marty are violating the law in executing their publication deal. Fair question, one I can answer without jeopardizing other aspects, so here goes...

Below is an excerpt from the “Joint Venture” contract between Casey & Marty. It ain’t pretty and may not seem like much, but it absolutely “IS” one (of many) smoking guns all have wondered about:

For obvious reasons, due to potential creditor and IRS issues, Casey’s personal name will not appear on anything that could jeopardize any assets, accounts, etc. being seized or frozen. Steps will be taken to ensure this, as in 2006, Marty lost over $400,000 in assets as a result of his business partner’s actions, and their name being on primary accounts and assets.”

Hmmmm, let see; unlawful shielding of asset, tax evasion, criminal conspiracy, criminal conspiracy to commit fraud... Need I go on?

Thus it should be no great wonder to anyone, why Casey is wiggin out so hard; trying everything is his limted “power” to discredit and diminish what he KNOWS is coming. Death rattles, I say, the last gasps of a failed life and wasted talent. But then, I’m just the chump claiming "I am a fool and want to let everybody on the internet know it" (thanks realist) so why take my word for anything? ;)

Tell me, Mark, if you can without messing things up: the lawsuit isn't really the important thing, is it? Merely having the case heard opens up a whole host of things, doesn't it? And whether you win or lose the lawsuit, CS is in deep shit?

This is what my spidey-sense tells me. The lawsuit is not the endgame. It is the beginning of the endgame.

I could go either way on Lost Mittens. He's not funny, but he is knowledgeable about loss mitigation. I prefer funny people but loss mitigators are interesting.

Court is always messy. Accusations, counter-accusations, it all gets sorted out. But Casey's got big skeletons in his closet, and one little case might lead to much larger problems. People in that condition should not seek to publish a book based on their crimes. Or maybe he should call it If I Borrowed It.

I'm open to the idea that smoking guns have not been brought to my attention. Marty lost $400k because he partnered with a different crook? So far I just see teasers. But I'm not an official judge.

If Casey does not find an attorney to tackle this, that's practically suicidal.

Overall, this may well be a sound technique to reign the schemer Casey Serin. Profiting from mortgage fraud by selling a book about it does not sit well with me. I was open to Marty saying, "Every dirty penny will go to lenders until the debt is paid." Of course, he said instead that Serin needed "money in his pocket," the pitch that sold Casey, but did not sell me. I worked six of the nine months Casey's been napping on the internet. My taxes are paid and Monday I start at Amazon. At Nine A.M.! I have a mortgage and it's never late. Casey said once that since these were business losses, he should be insulated. Yesterday he said, "What's the big deal with taxes?" So karmically he deserves a sock in the face. Should that manifest as a matter before the court? Mittens isn't a lender, or the district attorney, but it is what it is, a civil matter of uncertain merit that might bring more serious matters to the court's attention. Justice, as Churchill said, grinds slow, but grinds exceedingly fine.

If Casey does represent himself, I sure wish someone would tape the proceedings. Comedy gold.

I like the idea a lot, but it's lacking in the execution.

And no, having the case heard doesn't open up a whole host of things. The lenders and authorities already have way more info than they need to go after Casey. For some reason at this time they don't seem inclined to do so, hopefully that changes, but some goofy lawsuit written by a guy that thinks he's "Clarence Darrel" and is suing Mocha for "liable".... and he's doing it pro se, ya the judge will giggle.

I believe that's at the root of the plan. If he's got any sense (yes, I know...), Casey should do everything in his power to avoid court proceedings, since even a trivial action might end up uncovering material that could lead to much more serious criminal proceedings later on.

Which is presumably why Mark's completely relaxed about posting the smoking-gun MP3s on his own site - Casey and Martin could sue, but would run the risk of their contents being aired in court. And I imagine this is absolutely the last thing they want to happen.

About PACER - thanks for letting me know that it's for federal cases only. I use it during the day to investigate mortgage fraud and bankruptcy cases...
Unfortunately, none of my investors lent money to fliptard, to this is just all for fun.
But I still don't know what LossMitPro lost as a result of Casey - hence the suit. Maybe that will all come out when the suit is filed?

I think Lost Mittens is pretty cagey about this. If anything, I hope he's doing a rope-a-dope on Casey using misdirection.

Keep it all on the QT. Don't give away your tactics.
